JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/06\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tBy<br \/>\nfiling these petitions, the petitioners have prayed for issuance of<br \/>\nan appropriate writ or direction, directing the respondent-Gujarat<br \/>\nState Road Transport Corporation to decide the applications filed by<br \/>\nthe petitioners for grant of appointment on compassionate grounds, as<br \/>\nper the prevailing policy. The petitioners have made applications to<br \/>\nthe respondent-Corporation for giving them appointments on the post<br \/>\nof Clerk.\n<\/p>\n<p id=\"p_1\">2.\tToday,<br \/>\nwhen the matter is taken up for hearing, Mr.Mukesh H. Rathod, learned<br \/>\nadvocate for the petitioners states, upon instructions, that the<br \/>\npetitioners are ready and willing to be considered for appointment on<br \/>\nany post lower than that of Clerk and for this purpose the<br \/>\npetitioners are willing to give undertakings to the<br \/>\nrespondent-Corporation. Therefore, without prejudice to the rights<br \/>\nand contentions of the petitioners regarding their appointment on the<br \/>\npost of Clerk in future, the respondent-Corporation may consider the<br \/>\npetitioners for appointment on a lower post. This concession may not<br \/>\npreclude the petitioners from making fresh applications for the post<br \/>\nof Clerk, as and when such posts are advertised in the future. The<br \/>\nlearned advocate for the petitioners further states that if the<br \/>\nrespondent-Corporation is willing to consider the petitioners for<br \/>\nposts lower than that of Clerk, the petitions may be disposed of,<br \/>\nwith appropriate directions.\n<\/p>\n<p id=\"p_2\">3.\tMr.\n<\/p>\n<p id=\"p_3\">Hardik C. Rawal, learned advocate for the respondents has submitted<br \/>\nthat the respondents will consider<br \/>\nthe case of the petitioners for grant  of appointments on<br \/>\ncompassionate grounds at posts lower than that of Clerk, subject to<br \/>\navailability  of the posts. Further, the applications made by the<br \/>\npetitioners for grant of compassionate appointment shall be<br \/>\nconsidered for the lower post, in accordance with law.\n<\/p>\n<p id=\"p_4\">4.\tHaving<br \/>\nheard the learned advocates for the respective parties and in view of<br \/>\nthe above statements made by them,  the following order is passed:\n<\/p>\n<p id=\"p_5\">\tThe<br \/>\npetitioners shall give undertakings to the respondent-Corporation to<br \/>\nthe effect that they are ready and willing to be considered for<br \/>\nappointment on compassionate grounds, on posts lower than that of<br \/>\nClerk within 3 weeks from today. The respondent-Corporation may<br \/>\nconsider the applications made by the petitioners for grant of<br \/>\nappointment on posts lower than that of Clerk, in accordance with<br \/>\nlaw, and as expeditiously as possible.
