JUSTICE DAYA CHAUDHARY\n\n\nPresent:- Mr. Adarsh Jain, Advocate for the appellants.\n\n\n\nAdarsh Kumar Goel,J.\n<\/pre>\n<p id=\"p_1\">1.         This appeal has been preferred against judgment of<\/p>\n<p>learned Single Judge dated 23.4.2009, allowing the writ petition of<\/p>\n<p>respondent Nos. 1 to 4, against order of Financial Commissioner<\/p>\n<p>dated 25.9.2007, Anenxure P.6 and restoring the order of the<\/p>\n<p>Collector dated 29.1.2002, Annexure P.4.\n<\/p>\n<p id=\"p_1\">2.         The appellants are heirs of Munshi, who was a tenant<\/p>\n<p>on the land in dispute and was survived by four sons, apart from<\/p>\n<p>the appellants, who are minor sons of pre-deceased Deen Mohd.<\/p>\n<p>and their brother Ayub, who was major.        The appellants were<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> LPA No.591 of 2009(O&amp;M)                                          2<\/span><\/p>\n<p>sued through their brother Ayub, who was major. The parties were<\/p>\n<p>represented through counsel, who made a statement on 29.7.1999<\/p>\n<p>that they will deposit the rent, interest and cost. On 24.4.2001,<\/p>\n<p>direction to make the deposit within 15 days was given with a rider<\/p>\n<p>that on default, order of eviction may be passed. The deposit<\/p>\n<p>having not been made, order of eviction was passed, which was<\/p>\n<p>affirmed on appeal but was set aside in revision and the revisional<\/p>\n<p>order was upheld by the Financial Commissioner.\n<\/p>\n<p id=\"p_2\">3.          The appellate authority rejected the objection of the<\/p>\n<p>appellants that they being minors, and no formal order of<\/p>\n<p>appointment of guardian having been passed, order against them<\/p>\n<p>was a nullity.\n<\/p>\n<p id=\"p_3\">            The finding of the Collector is as under:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                 &#8220;I have heard the arguments of the counsel for the<br \/>\n                 parties and also perused the file of the case. The<br \/>\n                 contention of the counsel for the appellants that<br \/>\n                 provisions of Order 32 Rule 2 have not been<br \/>\n                 complied with is not correct because the father of<br \/>\n                 the minor appellants had already died and as per the<br \/>\n                 Muslim law, mother cannot be appointed as the<br \/>\n                 guardian. The present suit which has been filed, the<br \/>\n                 real brother Ayub was appointed as the guardian and<br \/>\n                 the cutting made in the Vakalatnama were corrected,<br \/>\n                 is not correct because the Thumb impression of<br \/>\n                 Ayub had already been affixed on this. The lower<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> LPA No.591 of 2009(O&amp;M)                                                3<\/span><\/p>\n<p>               court had passed the order dated 24.4.2001 in the<br \/>\n               presence of both the parties. Therefore, the<br \/>\n               submission of the counsel for the appellants that<br \/>\n               they did not know about the order regarding deposit<br \/>\n               of the Batai and order of ejectment cannot be<br \/>\n               accepted. While passing the order dated 24.4.2001,<br \/>\n               15 days time was given to deposit the amount failing<br \/>\n               which the order of ejectment was passed. Till today,<br \/>\n               the amount of Batai has not been deposited by the<br \/>\n               appellants nor any application for condonation of<br \/>\n               delay in filing the appeal has been filed till date.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_4\">4.          The Commissioner reversed the above view and held<\/p>\n<p>that in absence of order of appointment of guardian, order of<\/p>\n<p>eviction was a nullity. Same view was taken by the Financial<\/p>\n<p>Commissioner.\n<\/p>\n<p id=\"p_5\">5.          Respondent Nos. 1 to 4, the landlords preferred a writ<\/p>\n<p>petition, which was heard by a learned Single Judge. The Learned<\/p>\n<p>Single Judge held that apart from the appellants, there were other<\/p>\n<p>contesting parties including their brother and uncles, who had no<\/p>\n<p>interest adverse to the appellants. The appellants were, thus,<\/p>\n<p>effectively represented and no prejudice was caused. Non<\/p>\n<p>compliance of Order 32 Rule 2 CPC, though mandatory, having<\/p>\n<p>not caused any prejudice, the order could not be treated as nullity,<br \/>\n<span class=\"hidden_text\" id=\"span_2\"> LPA No.591 of 2009(O&amp;M)                                         4<\/span><\/p>\n<p>in view of judgment of Full Bench of this Court in <a href=\"\/doc\/1526844\/\" id=\"a_1\">Amrik Singh<\/p>\n<p>and another v. Karnail Singh and others<\/a>, AIR 1974 P&amp;H 315.<\/p>\n<p>Finally, it was concluded as under:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;I have considered the rival contentions raised before<br \/>\n            me by the counsel. The provisions may be mandatory<br \/>\n            and this may require compliance but the aspect of<br \/>\n            prejudice as observed by Full Bench in Amrik Singh&#8217;s<br \/>\n            case (supra) cannot be completely ignored. In other<br \/>\n            words, it is to be seen if the non compliance of these<br \/>\n            provisions would lead to any prejudice to the case of<br \/>\n            the respondents or not. The provisions of Rule 3 seem<br \/>\n            to require of a plaintiff that he must move an<br \/>\n            application for appointment of a guardian where minor<br \/>\n            alone is sued. In fact that was the situation, according<br \/>\n            to the counsel for the petitioners, in the case of<br \/>\n            Gurpreet Singh (minor) v. Chhatterbhuj Goel, 1991(2)<br \/>\n            RLR 460. The facts in the present case are in somewhat<br \/>\n            different context. Respondents were minors but were<br \/>\n            impleaded through their brother, who was a major. He<br \/>\n            had an equal interest to protect for himself as well as<br \/>\n            for his minor brothers. Respondents, who were minors<br \/>\n            had major brother and other relatives who all were<br \/>\n            represented by the same counsel. The case was decided<br \/>\n            by the Assistant Collector on the basis of a statement<br \/>\n            made by the counsel that they were prepared to deposit<br \/>\n            the Batai. It was not a contested case where there was<br \/>\n            any need to take stand. The respondents thus would not<br \/>\n            have apparently suffered any prejudice on account of<br \/>\n<span class=\"hidden_text\" id=\"span_3\"> LPA No.591 of 2009(O&amp;M)                                           5<\/span><\/p>\n<p>            the order passed and now impugned. The ratio of law<br \/>\n            laid down by the Full Bench decision of this Court in<br \/>\n            the case of Amrik Singh (supra) thus would be attracted<br \/>\n            to the facts and circumstances of the present case. Even<br \/>\n            if it is assumed that there was non compliance of the<br \/>\n            provisions of Order 32 Rule 3, the decision as rendered<br \/>\n            cannot be termed as void as observed by the Full bench<br \/>\n            in the case of Amrik Singh (supra). Would not it be<br \/>\n            sheer injustice to the petitioners to reopen this case<br \/>\n            when it was decided on the basis of stand taken by the<br \/>\n            respondents but the petitioners are yet to receive either<br \/>\n            Batai or possession of this land?\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                  In view of the facts as noticed that the interest of<br \/>\n            the minors was fully represented by their own brother,<br \/>\n            who did not have any interest adverse to the interest of<br \/>\n            the minors. In fact he had the same interest to defend<br \/>\n            the case. It cannot be assumed that there was any<br \/>\n            prejudice caused to the case of the minors. It can also<br \/>\n            be noticed that the minors were effectively represented<br \/>\n            before the court and thus the decision will not be void.<br \/>\n            The minors thus would not be able to ignore or avoid<br \/>\n            the same. The object of Order 32 Rule 3 is to see that<br \/>\n            the minor&#8217;s interest does not suffer and he is properly<br \/>\n            represented in a suit filed against him. I have assured<br \/>\n            myself that the minors have not suffered any prejudice<br \/>\n            and were properly represented by their brother who had<br \/>\n            an identical interest to protect. To an extent, this<br \/>\n            requirement of appointing a guardian for minor had<br \/>\n            been taken care of by impleading the minors through<br \/>\n<span class=\"hidden_text\" id=\"span_4\"> LPA No.591 of 2009(O&amp;M)                                         6<\/span><\/p>\n<p>            their brother. That is why, the court perhaps did not<br \/>\n            consider it appropriate to appoint a guardian&#8230;.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_6\">6.          We have heard learned counsel for the appellants and<\/p>\n<p>perused the record.\n<\/p>\n<p id=\"p_7\">7.          It has not been disputed that apart from the appellants,<\/p>\n<p>their real elder brother and uncles were duly impleaded as parties<\/p>\n<p>being legal heirs of Munshi, the original tenant and they were<\/p>\n<p>represented by a counsel. They did not, in any manner, act to the<\/p>\n<p>detriment of the appellants, in collusion with respondent nos. 1 to<\/p>\n<p id=\"p_8\">4. They were also equally affected by the order. In these<\/p>\n<p>circumstances, no prejudice has been caused in absence of formal<\/p>\n<p>order of appointment of guardian, as their brother could be their<\/p>\n<p>guardian who was himself a party. The matter is, thus, fully<\/p>\n<p>covered by Full bench judgment of this Court in Amrik Singh<\/p>\n<p>(supra).\n<\/p>\n<p id=\"p_9\">8.          Learned counsel for the appellants relies upon judgment<\/p>\n<p>of Hon&#8217;ble Supreme Court in <a href=\"\/doc\/1278358\/\" id=\"a_1\">Ram Chandra Arya v. Man Singh<\/p>\n<p>and another<\/a>, AIR 1968 SC 954, to submit that in absence of<\/p>\n<p>guardian, decree would be void. In that case, the decree was ex<\/p>\n<p>parte without service of the contesting party, who was a lunatic.<\/p>\n<p>Other judgments relied upon are also on the principle that in<\/p>\n<p>absence of a guardian, the decree would be void. The matter<br \/>\n<span class=\"hidden_text\" id=\"span_5\"> LPA No.591 of 2009(O&amp;M)                                       7<\/span><\/p>\n<p>having already been considered by Full Bench of this Court in<\/p>\n<p>Amrik Singh (supra) and there being effective representation<\/p>\n<p>through a counsel, the order passed was not be liable to be<\/p>\n<p>interfered with.\n<\/p>\n<p id=\"p_10\">9.          We, thus, do not find any ground to interfere with the<\/p>\n<p>view taken by the learned Single Judge.\n<\/p>\n<p id=\"p_11\">10.
