On hearing learned counsels of both the sides and on duly<br \/>\nconsidering the reasons set forth by the petitioner, there appears to<br \/>\nbe justifiable reason to accede to the request of petitioner without<br \/>\nemphasizing on procedurality or technicality. It also needs to be<br \/>\nnoted that petitioner is a Co-operative Bank and after the first<br \/>\norder of Tribunal, it had further pursued the remedy by filing Misc.<br \/>\nApplication twice. Cumulatively, when the reasons are appreciated,<br \/>\nthis Court is of the opinion that the application deserves to be<br \/>\nallowed. Accordingly,  Application for condonation of delay is<br \/>\nallowed.  Registry is directed to number the Tax Appeal and place the<br \/>\nsame on board next week for hearing, after completing the formality<br \/>\nof registration  <\/p>\n<p>3.\tOJ<br \/>\nMisc.
