No.5471 of 2011\n                              MANOJ TIWARI SON OF AGNIDEO TIWARI\n                                                Versus\n                                      THE STATE OF BIHAR\n                                              -----------\n<\/pre>\n<p id=\"p_1\">2.   20.4.2011             Heard learned Counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p id=\"p_1\">                           The petitioner seeks bail in a case instituted for the<\/p>\n<p>                 offence u\/ss.25(1-B)A\/26\/35 of the <a href=\"\/doc\/1934415\/\" id=\"a_1\">Arms Act<\/a>.<\/p>\n<p id=\"p_2\">                           The petitioner was granted bail by an order dated<\/p>\n<p>                 10.11.2010 vide Cr.Misc.No.38554 of 2010, but on verification<\/p>\n<p>                 that he was an accused in only one other case which was<\/p>\n<p>                 mentioned in the First Information Report. On verification it<\/p>\n<p>                 was found that the petitioner was an accused in another case<\/p>\n<p>                 of the year 2005 in which he was on police bail.<\/p>\n<p id=\"p_3\">                           Considering that the petitioner on merits was granted<\/p>\n<p>                 bail by this Court, let the petitioner above named be released<\/p>\n<p>                 on bail on furnishing bail bond of Rs.5,000\/- (Five thousand)<\/p>\n<p>                 with two sureties of the like amount each or any other surety<\/p>\n<p>                 to be fixed by the court concerned to the satisfaction of Chief<\/p>\n<p>                 Judicial Magistrate, Buxar in Brahmpur P.S. case No.358 of<\/p>\n<p>                 2009, subject to the conditions (i) That one of the bailor will<\/p>\n<p>                 be a close relative of the petitioner who will give an affidavit<\/p>\n<p>                 giving genealogy as to how he is related with the petitioner.<\/p>\n<p>                 The bailor will undertake to furnish information to the Court<\/p>\n<p>                 about any change in address of the petitioner. (ii) That the<\/p>\n<p>                 bailor shall also state on affidavit that he will inform the court<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   -2-<\/span><\/p>\n<p>            concerned if the petitioner is implicated in any other case of<\/p>\n<p>            similar nature after his release in the present case and<\/p>\n<p>            thereafter the court below will be at liberty to initiate the<\/p>\n<p>            proceeding for cancellation of bail on ground of misuse, (iii)<\/p>\n<p>            That the petitioner will give an undertaking that he will receive<\/p>\n<p>            the police papers on the given date and be present on date<\/p>\n<p>            fixed for charge and if he fails to do so on two given dates<\/p>\n<p>            and delays the trial in any manner, his bail will be liable to be<\/p>\n<p>            cancelled for reasons of misuse, (iv) That the petitioner will<\/p>\n<p>            be well represented on each date if he fails to do so on two<\/p>\n<p>            consecutive dates, his bail will be liable to be cancelled.<\/p>\n<p id=\"p_4\">                     A sum of Rs.750\/- shall be deposited before the<\/p>\n<p>            District Legal Aid Committee, Buxar by the petitioner before<\/p>\n<p>            he is released on bail.\n<\/p>\n<p id=\"p_5\">\n<pre id=\"pre_1\">Narendra\/                       ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Manoj Tiwari vs The State Of Bihar on 20 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
