No.9733 of 2011\n               MAHTAB ALAM SON OF LATE MAHMOOD ALAM, RESIDENT OF VILLAGE\n               ALAKHBANI, P.S KALYANPUR, DISTRICT EAST CHAMPARAN AT\n               MOTIHARI\n                                  Versus\n                            The State Of Bihar\n                               -----------\n<\/pre>\n<p>3   29.06.2011              Heard learned counsels for the petitioner and the State.<\/p>\n<p>                            Petitioner has filed this application apprehending his<\/p>\n<p>                 arrest in connection with Kalyanpur P.S. Case No. 57 of 2007 for<\/p>\n<p>                 the alleged offence under sections 147, 149 &amp; 307 of the Indian<\/p>\n<p>                 Penal Code and section 27 of the Arms Act.\n<\/p>\n<p>                            Petitioner had earlier approached this Court for the<\/p>\n<p>                 same relief which was rejected as per the order dated 03.09.2008<\/p>\n<p>                 passed in Cr. Misc. No. 56137 of 2007 vide Annexure-1.<\/p>\n<p>                            Considering the submissions and on perusal of the<\/p>\n<p>                 averments made in the application, this Court is not inclined to<\/p>\n<p>                 take a different view. The application is, accordingly, rejected.<\/p>\n<p>                            However, since the petitioner was allowed interim<\/p>\n<p>                 protection by order dated 30th March, 2011 the petitioner must<\/p>\n<p>                 surrender within a period of three weeks and in case petitioner on<\/p>\n<p>                 surrender makes an application for regular bail, the same shall be<\/p>\n<p>                 considered in accordance with law on its own merit without being<\/p>\n<p>                 prejudiced by the present order.\n<\/p>\n<p>                            The order dated 30th March, 2011 with respect to no<\/p>\n<p>                 coercive steps being taken against the petitioner is modified to the<\/p>\n<p>                 above extent.\n<\/p>\n<p>                            The application stands disposed of.\n<\/p>\n<\/p>\n<pre>    Manish\/-                                 ( Shailesh Kumar Sinha,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Mahtab Alam vs The State Of Bihar on 29 June, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
