No.4909 of 2008\n                      -------------------------------------\n             Dated this the 28th day of January, 2009\n\n                                  ORDER\n<\/pre>\n<p id=\"p_1\">      Petitioners face indictment in a prosecution for offences<\/p>\n<p>punishable, inter alia, under <a href=\"\/doc\/4266\/\" id=\"a_1\">Section 308<\/a> I.P.C and <a href=\"\/doc\/244673\/\" id=\"a_1\">Section 27<\/a> of<\/p>\n<p>the Arms Act. The crux of the allegations is that the petitioners<\/p>\n<p>herein, ie. accused 1 and 2 allegedly attacked and caused<\/p>\n<p>injuries to respondents 1 and 2, spouses, who are the alleged<\/p>\n<p>victims in this crime. Investigation is complete. Final report has<\/p>\n<p>already been filed.     Cognizance has been taken.                The case<\/p>\n<p>against the petitioners has been committed to the Court of<\/p>\n<p>Session and the matter is pending as S.C.No.1898 of 2006 before<\/p>\n<p>the Assistant Sessions Judge-III, Trivandrum. Altogether there<\/p>\n<p>are 2 victims; they are respondents 1 and 2.                  Trial has not<\/p>\n<p>commenced.\n<\/p>\n<p id=\"p_1\">      2.    At this juncture, petitioners 1 and 2 along with<\/p>\n<p>respondents 1 and 2 have appeared before this Court through<\/p>\n<p>counsel to confirm that all outstanding disputes between them<\/p>\n<p>have been settled and respondents 1 and 2 have compounded the<\/p>\n<p>offences allegedly committed by the petitioners.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C. No.4909 of 2008       2<\/span><\/p>\n<p id=\"p_2\">     3.    Respondents 1 and 2 have entered appearance. They<\/p>\n<p>have     filed    separate   affidavit  to     confirm     such<\/p>\n<p>composition\/settlement. Notice was given to the learned Public<\/p>\n<p>Prosecutor.   The learned Public Prosecutor accepts that the<\/p>\n<p>disputes between the parties have been settled and respondents<\/p>\n<p>1 and 2 have compounded the offences allegedly committed by<\/p>\n<p>the petitioners.  The disputes between the parties are purely<\/p>\n<p>private and personal between them.       The State, in these<\/p>\n<p>circumstances, does not want to oppose the prayer for quashing<\/p>\n<p>of the proceedings.\n<\/p>\n<p id=\"p_3\">     4.    The   learned  counsel   for the   petitioners   and<\/p>\n<p>respondents 1 and 2 pray; the learned Public Prosecutor does<\/p>\n<p>not oppose the said prayer and I am satisfied that this is an<\/p>\n<p>eminently fit case where the extraordinary inherent jurisdiction<\/p>\n<p>available to this Court under <a href=\"\/doc\/1679850\/\" id=\"a_2\">Section 482<\/a> Cr.P.C as enabled by<\/p>\n<p>the dictum in <a href=\"\/doc\/1442974\/\" id=\"a_3\">Madan Mohan Abbot v. State of Punjab<\/a> [2008<\/p>\n<p>(3) KLT 19], <a href=\"\/doc\/393489\/\" id=\"a_4\">Nikhil Merchant v. C.B.I<\/a> [2008(3) KLT 769 (SC)]<\/p>\n<p>and Manoj Sharma v. State [2008 (4) KLT 417 (SC)] can safely<\/p>\n<p>be invoked to bring to premature termination this prosecution<\/p>\n<p>which has become unnecessary and irrelevant now.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C. No.4909 of 2008         3<\/span><\/p>\n<p id=\"p_4\">     5.    In the result:\n<\/p>\n<pre id=\"pre_1\">     a)    This Crl.M.C is allowed;\n\n     b)    S.C.No.1696 of 2006 pending before the Assistant\n\n<\/pre>\n<p id=\"p_5\">Sessions Judge-III, Trivandrum in which the petitioners herein<\/p>\n<p>are the accused and respondents 1 and 2 herein are the victims<\/p>\n<p>is hereby quashed;\n<\/p>\n<p id=\"p_6\">     c)    Needless to say, proceedings, if any, pending against<\/p>\n<p>the petitioners and their sureties under <a href=\"\/doc\/1286551\/\" id=\"a_5\">Section 446<\/a> Cr.P.C, shall<\/p>\n<p>be disposed of in accordance with law.\n<\/p>\n<p id=\"p_7\">     6.
