The respondent was appointed as per Government<br \/>\nResolution and said power was withdrawn by Government and therefore,<br \/>\npetitioner &#8211; school cannot continue the workman in service<br \/>\nbecause power has been withdrawn by State Government.\n<\/p>\n<p id=\"p_3\">3.1\tLearned<br \/>\nAGP Mr.Sharma also submitted that respondent workman was not<br \/>\nappointed after following due recruitment procedure and this school<br \/>\nhas been maintained by State Government as per their Rules and this<br \/>\nbeing not a commercial establishment and respondent was appointed as<br \/>\nAssistant Cook in the year 1994. Before Labour Court, detailed reply<br \/>\nwas submitted by petitioner vide Exh.17 and certain documents have<br \/>\nalso been produced on record by petitioner and one witness Acharya<br \/>\nManiben Jivabhai Katara was examined vide Exh.54 and also produced<br \/>\norder passed by the Director of Schedule Caste, Welfare Department<br \/>\nvide Exh.56. He also submitted that workman has not completed 240<br \/>\ndays continuous service and he has also not proved it, even though<br \/>\nLabour Court has committed gross error in setting aside termination<br \/>\norder. He further submitted that he was appointed on contingency and<br \/>\nentire work of cook had been handed over by Government to Contractor<br \/>\non contract basis. Therefore, if respondent workman is prepared to<br \/>\nwork under the Contractor, then on certain conditions he may be<br \/>\nreinstated in service. He also submitted that these facts have been<br \/>\ndisclosed by petitioner vide Exh.15 and 17. But this aspect has not<br \/>\nbeen considered by Labour Court. He further submitted that Labour<br \/>\nCourt has committed gross error in granting 20% back wages of interim<br \/>\nperiod without any justification and workman has not proved<br \/>\nunemployment of entire period. He also submitted that when workman<br \/>\nwas not appointed after following recruitment procedure in Government<br \/>\nschool, then he is not entitled any relief from Labour Court. In<br \/>\nshort, his submission is that Labour Court has committed gross error<br \/>\nin granting relief in favour of respondent.\n<\/p>\n<p id=\"p_4\">4.\tI<br \/>\nhave considered submissions made by both learned advocates appearing<br \/>\non behalf of respective parties and also perused award passed by<br \/>\nLabour Court, Himmatnagar. The facts are not much in dispute between<br \/>\nthe parties. The respondent workman was appointed on contingency work<br \/>\npaying wages of Rs.580\/- for 29 days working and the work of cooking<br \/>\nhas been handed over to contractor and now, it has been continued on<br \/>\ncontract basis. The kitchen of the school is continued on contract<br \/>\nbasis. According to petitioner, as per Government Finance Department<br \/>\nresolution dated 10.1.1988, the respondent workman was appointed so<br \/>\nlong on the post of Assistant Cook of regular appointment is made by<br \/>\nGovernment. Therefore, he was allowed to work on hour basis and<br \/>\nreceiving salary from petitioner. The respondent has to work as<br \/>\nAssistant Cook, Safai Kamdar, Chowkidar and Hamal. These are the work<br \/>\nof contingency was being done by respondent &#8211; workman.<br \/>\nAccording to petitioner, no employee or person can be recruited by<br \/>\nschool without following due procedure of Recruitment Rules. The<br \/>\npetitioner has not issued any appointment orders in favour of<br \/>\nrespondent workman. But vide Exh.21 to Exh.44, advance receipts have<br \/>\nbeen produced by petitioner for a period of 1994-1995 and 1995-96<br \/>\nwherein 240 days continuous service has been established. These<br \/>\ndocuments have been supported by evidence of workman as well as<br \/>\nevidence of witness of petitioner &#8211; Acharya Maniben J. Katara.<br \/>\nTherefore, Labour Court has come to conclusion that though 240 days<br \/>\ncontinuous service has been established on the basis of documents<br \/>\nvide Exh.21 to Exh.44, even though <a href=\"\/doc\/607947\/\" id=\"a_1\">Section 25(F)<\/a> of I.D.Act,1947 has<br \/>\nnot been followed and same has been violated and workman is covered<br \/>\nby definition of <a href=\"\/doc\/1418464\/\" id=\"a_1\">Section 2(s)<\/a> of I.D.Act,1947 and considering the<br \/>\nfact that mandatory provisions have been violated, then order of<br \/>\ntermination is held to be ab-initio void and considering evidence of<br \/>\npetitioner that now work of kitchen has been handed over to<br \/>\ncontractor and that kitchen is continued on contract basis,<br \/>\ntherefore, workman if required to be reinstated by petitioner, then<br \/>\nhe should have to be reinstated under contractor. However, Labour<br \/>\nCourt has considered interim period being more than 10 years, workman<br \/>\nremained without work and therefore, only 20% back wages has been<br \/>\ngranted in favour of workman.\n<\/p>\n<p id=\"p_5\">5.\tLooking<br \/>\nto records, advance receipt has been produced by petitioner, evidence<br \/>\nof Acharya Maniben J. Katara vide Exh.54 and evidence of workman,<br \/>\nLabour Court has rightly come to conclusion that workman has<br \/>\nestablished 240 days continuous service and undisputedly, <a href=\"\/doc\/607947\/\" id=\"a_2\">Section<br \/>\n25(F)<\/a> of I.D.Act,1947 is not followed which renders the termination \/<br \/>\nretrenchment ab-initio void and accordingly, relief of reinstatement<br \/>\nunder contractor has been rightly granted with 20% back wages. For<br \/>\nthat, Labour Court has not committed any error which requires<br \/>\ninterference by this Court. The Labour Court has given detailed<br \/>\nreasons in support of its conclusion and Labour Court has applied the<br \/>\nmind and appreciated oral and documentary evidence. For that, finding<br \/>\nof fact recorded by Labour Court cannot consider to be baseless and<br \/>\nperverse. This Court is having a very limited jurisdiction under<br \/>\n<a href=\"\/doc\/1331149\/\" id=\"a_3\">Article 227<\/a> of the Constitution of India, this Court cannot act as an<br \/>\nappellate authority and therefore, according to my opinion, Labour<br \/>\nCourt has not committed any error which requires interference by this<br \/>\nCourt while exercising powers under <a href=\"\/doc\/1331149\/\" id=\"a_4\">Article 227<\/a> of the Constitution<br \/>\nof India.
