DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">Learned<br \/>\n\tcounsel for the applicant submits that charge sheet is filed and in<br \/>\n\tan unfortunate event which took place wherein son of the applicant<br \/>\n\thas also committed suicide.  It is further submitted that the<br \/>\n\tapplicant has roots in the society, will not flee from justice and<br \/>\n\tby imposing suitable conditions, the applicant may be enlarged on<br \/>\n\tbail.\n<\/p>\n<p id=\"p_1\">Heard<br \/>\n\tLearned APP for the respondent &#8211; State.\n<\/p>\n<p id=\"p_2\">Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences coupled with the fact that<br \/>\n\tcharge sheet is filed, without discussing<br \/>\n\tthe evidence in detail, at this stage, I am inclined to enlarge the<br \/>\n\tapplicant on bail  in connection with C.R.No.I-167\/2010 registered<br \/>\n\twith Sayla Police Station for the offences punishable under <a href=\"\/doc\/619940\/\" id=\"a_1\">sections<br \/>\n\t363<\/a>, <a href=\"\/doc\/796352\/\" id=\"a_1\">366<\/a>, <a href=\"\/doc\/92983\/\" id=\"a_2\">306<\/a> &amp; <a href=\"\/doc\/112749\/\" id=\"a_3\">114<\/a> of the Indian Penal Code, on furnishing<br \/>\n\tbond of Rs.10,000\/- (Rupees ten thousand only) with one surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and on<br \/>\n\tconditions that the applicant shall :\n<\/p>\n<p id=\"p_3\">[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p id=\"p_4\">[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_5\">[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p id=\"p_6\">[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m .\n<\/p>\n<p id=\"p_7\">[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p id=\"p_8\">[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p id=\"p_9\">[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p id=\"p_10\">4)\tIf<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p id=\"p_11\">5)\tBail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p id=\"p_12\">Rule<br \/>\n\tis made absolute.
