PATTANAIK (J)\n\nCITATION:\n 1996 AIR 1010\t\t  1996 SCC  (7) 392\n JT 1996 (1)   561\t  1996 SCALE  (1)479\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p id=\"p_1\">     This appeal  is filed  against the order of the Central<br \/>\nAdministrative Tribunal, Calcutta Bench dated March 11, 1987<br \/>\nmade in\t ND OA\tNo.12\/A&amp;N\/87. The  appellant claimed  higher<br \/>\nscale  of   pay\t as   Head  Compounder.\t Though\t the  Health<br \/>\nDepartment in  Adaman &amp;\t Nicobar Island\t had recommended  to<br \/>\nconsider his  case for\tgrant of special pay, the Government<br \/>\nafter elaborate\t consideration in  proceedings dt. April 21,<br \/>\n1976 considered\t that question\tof  prescribing\t any  higher<br \/>\nscale of pay for the post of Head Compounder.\n<\/p>\n<p id=\"p_2\">     Ms. Lily  Thomas, the learned counsel appearing for the<br \/>\nappellant relying  upon Fundamental Rule 9(25) Clause 7(iii)<br \/>\ncontended that\tthe appellant is entitled to the special pay<br \/>\non par\twith others  which is being denied to the appellant.<br \/>\nShri A.N.  Jayaram, the learned Additional Solicitor General<br \/>\nappearing for the respondents stated that this grievance was<br \/>\nnot made  by the  appellant at\tany point of time. As a fact<br \/>\nall those  who are  working in\tAndaman &amp; Nicobar Island, as<br \/>\nper the\t Fundamental Rules,  are being\tpaid Andaman special<br \/>\npay and\t the appellant is not discriminated on that account.<br \/>\nAccepting the contention of the counsel for the respondents,<br \/>\nwe are\tof the\tconsidered view\t that the  grievance of\t the<br \/>\nappellant is  not well\tfounded. It  is needless  to mention<br \/>\nthat  whatever\t direction  that  have\tbeen  given  by\t the<br \/>\nGovernment of  India under the Fundamental Rules for payment<br \/>\nof special pay to the employees working in Andaman &amp; Nicobar<br \/>\nIsland, they  are entitled for the same and accordingly such<br \/>\nspecial pay  be paid  to all  the eligible persons including<br \/>\nthe appellant.\n<\/p>\n<p id=\"p_3\">     The appeal is dismissed with the above observations.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India A.J Joseph vs Union Of India &amp; Ors on 8 January, 1996 Equivalent citations: 1996 AIR 1010, 1996 SCC (7) 392 Author: K Ramaswamy Bench: Ramaswamy, K.
