On 11.12.1992,<br \/>\nthe petitioner had canvassed a case of one Smt. Hiraben Dabhi, who<br \/>\nwas allotted Policy No 850875434. However, the insured expired on<br \/>\n21.01.1993 due to throat cancer.\n<\/p>\n<p id=\"p_2\">2.1.\t\tOn<br \/>\n30.09.1994, the Sr. Divisional Manager, Gandhiangar issued charge<br \/>\nsheet cum show-cause notice to the petitioner to show cause as to why<br \/>\nappropriate action be not taken against him for committing breach of<br \/>\nRegulation 8(2)(b) of the LIC  of India (Agents) Regulations, 1972<br \/>\n[ the Regulations  for short]. The petitioner submitted her reply<br \/>\nto the said charge sheet cum show-cause notice vide reply dated<br \/>\n18.10.1994. However, vide order dated 22.11.1994, the Sr. Divisional<br \/>\nManager, terminated the agency of the petitioner and forfeited the<br \/>\ncommissions.\n<\/p>\n<p id=\"p_3\">2.2.\t\tAgainst<br \/>\nthe said order, the petitioner preferred an appeal before the Zonal<br \/>\nManger, LIC, Mumbai vide letter dated 07.01.1995. As there was no<br \/>\nresponse to the said letter dated 07.01.1995, the petitioner sent<br \/>\nseveral reminders. On 13.11.1999, the petitioner addressed a Memorial<br \/>\nto the Chairman, LIC. As no decision was taken by the Chairman, LIC,<br \/>\nthe petitioner preferred Special Civil Application No. 11695\/2000<br \/>\nbefore this Court. This Court, vide order dated 20.11.2000, disposed<br \/>\nof the petition with a direction to the Chairman of LIC to decide the<br \/>\nMemorial preferred by the petitioner within a period of one month<br \/>\nfrom the date of receipt of writ of the order. Pursuant thereto, the<br \/>\nChairman, LIC rejected the Memorial preferred by the petitioner vide<br \/>\norder dated 24.02.2001. Hence, this petition.\n<\/p>\n<p id=\"p_4\">3.\t\tThe<br \/>\nlearned counsel for the petitioner has contended that the Sr.<br \/>\nDivisional Manager, Gandhinagar while issuing charge sheet cum<br \/>\nshow-cause notice dated 18.10.1994, has not made any reference to<br \/>\nRegulation 19 of the Regulations. However, he has submitted that even<br \/>\nif the termination is on germane grounds, the same will not authorize<br \/>\nthe respondents-authorities to forfeit the commission. While passing<br \/>\nthe impugned order, the authorities have recorded the finding  that<br \/>\nfraud has been committed by the petitioner, but no finding has been<br \/>\narrived at regarding forfeiture of commission. Hence, the impugned<br \/>\norders passed by the respondents-authorities is bad in law and<br \/>\ndeserves to be quashed and set aside.\n<\/p>\n<p id=\"p_5\">4.\t\tThe<br \/>\nlearned counsel for the respondent has contended that the impugned<br \/>\norder passed by the respondents-authorities terminating the agency of<br \/>\nthe petitioner and forfeiting the commission is in accordance with<br \/>\nthe Regulations and, therefore, this Court may not interfere in this<br \/>\npetition. He has also placed reliance on the decision of the Division<br \/>\nBench of this Court rendered in Letters Patent Appeal No. 213 of 2007<br \/>\ndated 26.06.2009, whereby the Division Bench on the facts of the case<br \/>\nhas held that the LIC was justified in terminating the agency and<br \/>\nforfeiting the commission payable to  the petitioner in that case.\n<\/p>\n<p id=\"p_6\">5.\t\tHeard<br \/>\nlearned counsel for the parties and perused the documents on record.<br \/>\nFrom the record, it transpires that the petitioner had canvassed a<br \/>\nproposal of said [late] Smt. Hiraben Udesinh Dabhi on 11.12.1992.<br \/>\nHowever, the said life assured expired on account of throat cancer on<br \/>\n21.01.1993 that is when the duration of the policy was only 23 days.<br \/>\nIt also appears that the deceased life assured was suffering from<br \/>\ncancer of throat  prior to the date of proposal for insurance. The<br \/>\nlife assured had also taken necessary treatment for the said ailment<br \/>\nand the said facts were know to the petitioner before canvassing a<br \/>\nproposal. Thus it is a finding that the petitioner had failed to<br \/>\ndischarge the functions as set out in Regulation 8(2)(b) of the<br \/>\nRegulations. In view of the above findings arrived at by the<br \/>\nrespondents-authorities, I am of the opinion that the authorities<br \/>\nwere completely justified in terminating the agency of the<br \/>\npetitioner.\n<\/p>\n<p id=\"p_7\">5.1.\n<\/p>\n<p id=\"p_8\">However, from the record it appears that the authorities have not<br \/>\nspecified any reasons or given any reasons with regard to forfeiture<br \/>\nof the commission for the earlier proposals  given by the petitioner.<br \/>\nAs per the provisions of  Regulation 19 of the Regulations, when the<br \/>\nauthority has arrived at the finding that fraud has been committed by<br \/>\nthe petitioner, then there must also be a finding regarding the fact<br \/>\nthat the commission for the earlier proposal is not  required to be<br \/>\nforfeited after having taken benefit of earlier proposals canvassed<br \/>\nby the petitioner. In view the above facts, I am of the opinion that<br \/>\nit is not open for the authorities to take the aforesaid stand and<br \/>\nthey have no right to forfeit the earlier commissions. Thus, the<br \/>\npetitioner is entitled for the commissions for the proposals which<br \/>\nwere canvassed prior to the proposal in question i.e. with respect to<br \/>\nthe deceased life assured.\n<\/p>\n<p id=\"p_9\">6.\t\tIn<br \/>\nview of the above, the petition is partly allowed. The impugned order<br \/>\ndated 22.11.1994 passed by the Sr. Divisional Manager, is modified to<br \/>\nthe extent that order with regard to terminating the agency of the<br \/>\npetitioner is confirmed and the order with regard to forfeiture of<br \/>\ncommissions is quashed and set aside. The respondents-authorities are<br \/>\ndirected to pay the commissions towards the proposals canvassed by<br \/>\nthe petitioner prior to the date of the proposal in question i.e.<br \/>\nwith respect to the deceased life assured, within a period of 60 days<br \/>\nfrom today and if the said amount is not paid by the<br \/>\nrespondent-authorities, then the petitioner will be entitled for<br \/>\ninterest @ 11% on the outstanding amount of commission as aforesaid<br \/>\nfrom 01.01.1996.
