\nAdditional Sniall Causes Accident
\nClaims   (for short,
\nTribunal:   0′ compensation on the
\nground  of $75, 140\/ – awarded in
\nhis faifoiirt as’- claim for $06.00 lakhs, is
\nin2_;\u00a71equate.”‘ ~   it <\/p>\n
  appellant claims to be aged about 34<\/p>\n
‘-years, Working as driver of Auto, and earning a sum of<\/p>\n
3530,0000,\/4’ \u00e9ber month. He was hale and healthy prior to<\/p>\n
2 the date of accident. That at about 6:30 A.M., on 15-<\/p>\n
AV\u00a7l’2N–2002, on K.K. Road, near Shivananda Circle,<\/p>\n
Bangalore, the appellant met with an accident on<\/p>\n
A<\/p>\n
account of rash and negligent driving by the driver of<\/p>\n
offending bus bearing No.KA~o7\/E561. As aresjult of<\/p>\n
the same, the appellant fell down <\/p>\n
grievous injuries, such as fracture  <\/p>\n
sinus, fracture of right frontal b:one_”ar1d anteriolr :c::a’ii,i_al<\/p>\n
fossa, diffuse cerebral oe.d”erna vvith.  <\/p>\n
damage to eye sight,,.etc.\n<\/p>\n
3. It is the case of  that on account
\nof the  he has taken<\/p>\n
treatment in’ the Hospital as in-<\/p>\n
patie’rit’,”‘duringlli$vliic’l1;perio’d,'”h’e has spent considerable:<\/p>\n
amount \u00ab.towards,conveggance, nourishing food and<\/p>\n
attendant “chargeslincluding medical expenses and other<\/p>\n
 Aiiicide’ntal expelnsesl and the Doctor has assessed whole<\/p>\n
   at 40% and the Ophthalmologist has<\/p>\n
a’s_ses_serlf.w30% disability towards visual blindness and<\/p>\n
 ., therefore, he has to be compensated adequately.<\/p>\n
4. On account of the injuries sustained in the<\/p>\n
 accident, the appellant filed the claim petition under<\/p>\n
Section 166<\/a> of the Motor Vehicles Act, before the<\/p>\n

5. We have heard learned counsel for appellant<\/p>\n
and learned counsel for Corporation for considerable<\/p>\n
length of time.\n<\/p>\n

and agony. It is stated that he has taken treatment for<\/p>\n
a total period of ll days in the Hospital. Durir.ig.this<\/p>\n

apart from medical expenses. The.’_’doctor_ has assessed<\/p>\n
the Visual disability at .4\u20ac:J\u00b0\/oh inll’<\/p>\n

life and  find some difficulty in doing his work as<\/p>\n
 by effectiyely as before. Having regard to the nature of<\/p>\n
l ‘;_l’inj*uries sustained in the accident, we presume that he<\/p>\n
 would have taken follow-up treatment and bed rest at<\/p>\n
least for a period of three months. Since the appellant<\/p>\n

expenses. Having regard to the nature of injuries<\/p>\n
