Radhakrishnan, J.\n\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                     W.P.(C) No. 36005 OF 2008\n                                    and\n                     W.P.(C) No.14773 OF 2009\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 18th day of December, 2009\n\n                               JUDGMENT\n<\/pre>\n<p id=\"p_1\">S.R.Bannurmath, C.J.\n<\/p>\n<p id=\"p_1\">     This Public Interest Litigation is filed alleging menace to the<\/p>\n<p>environment in respect of the unauthorised erection of Bio-waste<\/p>\n<p>Treatment Plant in the public Stadium in Kozhencherry Grama<\/p>\n<p>Panchayat.\n<\/p>\n<p id=\"p_2\">     2. In this regard, this Court had appointed a Commissioner<\/p>\n<p>to look into the matter and submit a report.                   The Advocate<\/p>\n<p>Commissioner studied the facts situation in detail and submitted<\/p>\n<p>that presently there is no possibility of any health hazard because<\/p>\n<p>of the operation of the Bio-waste Treatment Plant.<\/p>\n<p id=\"p_3\">     3.   The Pollution Control Board is the authority which is<\/p>\n<p>required to consider the grant of consent and as such we direct<\/p>\n<p>the Pollution Control Board to consider the issuing of consent to<\/p>\n<p>operate the Bio-waste Treatment Plant in accordance with law<\/p>\n<p>after giving opportunity to the petitioner also to represent his<\/p>\n<p>W.P.(C) No. 36005 OF 2008 and<br \/>\nW.P.(C) No.14773 OF 2009<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                 -:2:-<\/span><\/p>\n<p>case. It is made clear that if after six months of the starting of<\/p>\n<p>the operation of the Bio-waste Treatment Plant, if any health<\/p>\n<p>hazard effect is found, it is open for the Pollution Control Board to<\/p>\n<p>take appropriate action in this regard.<\/p>\n<p id=\"p_4\">     With this observation, the Writ Petitions are disposed of.<\/p>\n<p id=\"p_5\">                                         S.R.
