Justice M.SASIDHARAN NAMBIAR\n\n Dated :20\/01\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n           ------------------------------------------\n            Crl.M.C.NO.2149 OF 2009\n           ------------------------------------------\n           Dated 20th          January 2010\n\n\n                         O R D E R\n<\/pre>\n<p id=\"p_1\">          Petitioner filed C.M.P.7831\/2008<\/p>\n<p>under  <a href=\"\/doc\/768169\/\" id=\"a_1\">Section      451<\/a>       of       Code         of  Criminal<\/p>\n<p>Procedure    for           interim                custody     of<\/p>\n<p>Rs.10,00,000\/- out of the money seized                      and<\/p>\n<p>produced   in       crime            No.546\/2008              of<\/p>\n<p>Kuttippuram Police Station contending that<\/p>\n<p>Rs.10,00,000\/- was deposited by him before<\/p>\n<p>the accused and it was not returned                          and<\/p>\n<p>therefore, he is entitled to                         that amount<\/p>\n<p>out of  Rs.1,08,92,920\/- seized. Petitioner<\/p>\n<p>sought interim custody of the amount. By<\/p>\n<p>order   dated         5\/6\/2009                 petition      was<\/p>\n<p>dismissed. This petition is filed under<\/p>\n<p><a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of Code of Criminal Procedure<\/p>\n<p>to quash   the said order                        and to grant<\/p>\n<p>interim custody of the amount.<\/p>\n<p>Crmc 2149\/09<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           2<\/span><\/p>\n<p id=\"p_1\">            2. Learned counsel  appearing  for the<\/p>\n<p>petitioner and learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p id=\"p_2\">            3.  Learned counsel argued that order<\/p>\n<p>of the learned Magistrate itself shows that<\/p>\n<p>investigating officer admitted that Rs.10 Lakh<\/p>\n<p>was    deposited   by  the  petitioner    with  the<\/p>\n<p>accused      and  in  such  circumstances, learned<\/p>\n<p>Magistrate was not justified in dismissing the<\/p>\n<p>petition.     It   is  argued  that money  is  for<\/p>\n<p>circulation and if interim custody is given<\/p>\n<p>petitioner could utilise the money and he is<\/p>\n<p>prepared to furnish any security and therefore,<\/p>\n<p>the amount is to be released.\n<\/p>\n<p id=\"p_3\">            4. Learned Public Prosecutor   opposed<\/p>\n<p>the        petition    contending   that     though<\/p>\n<p>Rs.98,30,46,000\/- was collected by the accused<\/p>\n<p>only      Rs.1,08,92,920\/-  could  be  seized   and<\/p>\n<p>Crmc 2149\/09<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                          3<\/span><\/p>\n<p>petitioner alone     cannot claim that amount. At<\/p>\n<p>best,       he will   only   be  entitled   to   a<\/p>\n<p>proportionate amount and in such circumstances,<\/p>\n<p>it cannot be allowed.\n<\/p>\n<p id=\"p_4\">            5. In view of the statement of the<\/p>\n<p>learned counsel that       petitioner alone raised<\/p>\n<p>the     claim  and  other  depositors     did  not<\/p>\n<p>approach      the   learned   Magistrate,   Public<\/p>\n<p>Prosecutor directed to       file a statement of<\/p>\n<p>investigating officer. Statement is filed to<\/p>\n<p>the effect that     824 persons had approached the<\/p>\n<p>police       to get back their money and total<\/p>\n<p>amount claimed comes to Rs.14,98,25,000\/- out<\/p>\n<p>of which only Rs.1,08,92,920\/- was seized. It<\/p>\n<p>is also submitted that accounts of the accused<\/p>\n<p>was    also   freezed and  including  the  freezed<\/p>\n<p>amount it would come to Rs.Five crores and if<\/p>\n<p>that amount is       divided among the depositors<\/p>\n<p>Crmc 2149\/09<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                           4<\/span><\/p>\n<p>and petitioner will get only 1\/5326 out of Five<\/p>\n<p>crores, which would only be Rs.9,388\/-. It is<\/p>\n<p>also submitted that two persons had already<\/p>\n<p>approached      Sub court to get back the amount.<\/p>\n<p id=\"p_5\">            5.
