Jagannadha Rao<br \/>\nMs. Meena  Chakraborty, and  Raj Kumar\tMehta, Advs. for the<br \/>\nappellant<br \/>\n\t\t      J U D G M E N T<br \/>\n     The following Judgment of the Court was delivered;<br \/>\nS.B. MAJMUDAR, J<br \/>\n     In this  appeal by\t special leave the order of the High<br \/>\nCourt of  Orissa at  Cuttack dated August 17, 1981 passed in<br \/>\nCivil Revision No.2 of 1981 has been brought in challenge.\n<\/p>\n<p id=\"p_2\">     The question  involved is\tone or\tjurisdiction of\t the<br \/>\nDeputy Labour  Commissioner, Orissa  to entertain claims for<br \/>\nworkmen&#8217;s  compensation\t in  connection\t with  the  accident<br \/>\ncaused to  the workmen\tin the\tcourse of and arising out of<br \/>\nemployment at  Rourkela in  Orissa State.  The High Court in<br \/>\nthe   impugned judgment\t has refused  to review\t its earlier<br \/>\ndecision  to   the  effect   that  it  is  only\t the  Labour<br \/>\nCommissioner at\t Rourkela who  could  have  entertained\t the<br \/>\nclaim and not the Deputy Labour Commissioner, Orissa.\n<\/p>\n<p id=\"p_3\">     A few  relevant facts leading to this proceeding may be<br \/>\nnoted at  the outset.\tOne Smt. Dukhi Jena, respondent No.2<br \/>\nherein who  is shown  to be  the proforma respondent filed a<br \/>\nclaim petition\tbefore the  Deputy Labour  Commissioner-cum-<br \/>\ncommissioner\tfor    workmen&#8217;s    Compensation,    Orissa,<br \/>\nBhubaneswar, claiming  compensation  from  Respondent  No.1,<br \/>\nAbhimanyu Gouda\t on the ground that her deceased husband was<br \/>\na Khalasi  in a\t truck belonging to Abhimanyu Gouda.  He met<br \/>\nwith a\tfatal accident\ton May\t9, 1974\t in the\t vicinity of<br \/>\nRourkela town  in the State of Orissa.\tThe appellant is the<br \/>\nauthority before  who such  claim was raised.  The appellant<br \/>\nafter hearing  the parties  exercised  his  jurisdiction  as<br \/>\nCommissioner  for  Workmen&#8217;s  Compensation  and\t awarded  an<br \/>\namount of  Rs. 8,000\/-\tby way of compensation to respondent<br \/>\nNo.2 and  made it  payable by  the respondent  No.1.   Being<br \/>\naggrieved by  the order\t of the appellant, the Deputy Labour<br \/>\nCommissioner-cum-Commissioner  for  Workmen&#8217;s  Compensation,<br \/>\nOrissa at Bhubaneswar, the respondent No.1, the owner of the<br \/>\ntruck filed  an appeal\tin the\tHigh Court  of Orissa  being<br \/>\nMiscellaneous Appeal  No.289 of 1997.  The High Court by its<br \/>\njudgment dated\tNovember 12,  1980 allowed the appeal of the<br \/>\nrespondent No.1 by holding that the appellant, Deputy Labour<br \/>\nCommissioner, Orissa  at Bhubaneswar  had no jurisdiction to<br \/>\nentertain the  claim petition  filed by\t the respondent No.2<br \/>\nIt is  pertinent to  note that\tthe appellant was not made a<br \/>\nparty in  that appeal  nor was\tany opportunity given to the<br \/>\nappellant  to\thave  his   say\t in   connection  with\t his<br \/>\njurisdiction to\t entertain the\tclaim petition.\t   The\tHigh<br \/>\nCourt held  that since\tthe accident had taken place outside<br \/>\nthe jurisdiction of the appellant, only the Commissioner for<br \/>\nworkmen&#8217;s Compensation at Rourkela could entertain the claim<br \/>\npetition and not the appellant.\n<\/p>\n<p id=\"p_4\">     The appellant  having come\t to know about the aforesaid<br \/>\ndecision of  the High Court moved the High Court in a review<br \/>\npetition which\tcame to\t be disposed of on August 17,1981 by<br \/>\nthe impugned  order which  recites that\t the application was<br \/>\nnot maintainable and the opposite party ( O.P. ) states that<br \/>\nhe will\t file a separate petition for review of the judgment<br \/>\nwas not\t brought to  the notice of the High Court and he was<br \/>\npermitted to file such application.\n<\/p>\n<p id=\"p_5\">     We may  state at  this state  that against the original<br \/>\norder of  the  High  Court  dated  November  12,  1980,\t the<br \/>\nrespondent No.2, the original claimant, filed a civil appeal<br \/>\nbeing C.A.  No. 10106 of 1983 before this Court.  this court<br \/>\nby order  dated October\t 28,  1983  directed  the  Insurance<br \/>\nCompany to pay a sum of Rs. 8000\/- to the respondent No.2 in<br \/>\nfull  and   final  settlement  of  her\tclaims\tagainst\t the<br \/>\nInsurance Company.  In addition thereto, this Court directed<br \/>\nthe respondent\tNo.1 to pay an equal amount of Rs. 8000\/- to<br \/>\nthe respondent No.2. It was further directed that out of Rs.<br \/>\n14,000\/- deposited  by the respondent No.1 before the Deputy<br \/>\nLabour\tCommissioner,  Rs.  8,000\/-  will  be  paid  to\t the<br \/>\nrespondent No.2.  It is also not in dispute that pursuant to<br \/>\nthe order  of this court the Insurance Company paid a sum of<br \/>\nRs. 8,000\/-  to the respondent No.2 and out of the deposited<br \/>\namount of  Rs. 14,000\/- by the respondent No.1, an amount of<br \/>\nRs. 8,000\/-  was to  be paid  to the respondent No.2 and the<br \/>\nbalance amount\tof Rs.\t6,000\/-\t plus  interest\t was  to  be<br \/>\nrefunded to  the respondent  No.1. In  view of the aforesaid<br \/>\ndecision of  this Court\t in C.A. No. 10106 of 1983 it can be<br \/>\nstated that  the question  of jurisdiction of the appellant-<br \/>\nCommissioner would not survious for serious consideration as<br \/>\nthe claimant-respondent No.2 has been ordered to be paid the<br \/>\nfull amount  of compensation  claimed  by  her\tagainst\t the<br \/>\nrespondent No.1. Still however as the appellant is aggrieved<br \/>\nby the\tdecision of  the  High\tCourt  on  the\tquestion  of<br \/>\njurisdiction which  affects large  number of claim petitions<br \/>\nunder the  Act, we  now proceed\t to examine  the controversy<br \/>\nabout the  jurisdiction of  the appellant  to entertain\t the<br \/>\noriginal claim\tpetition of  the respondent  No.2. So far as<br \/>\nthis question  is concerned,  we must  note that  before the<br \/>\nHigh Court  in the  review proceeding  it was submitted that<br \/>\nthere was already notification issued by the State of Orissa<br \/>\nconferring jurisdiction\t on the\t appellant to entertain such<br \/>\nclaims\tunder\tthe  Workmen&#8217;s\t<a href=\"\/doc\/1113485\/\" id=\"a_1\">Compensation  Act<\/a>,  1923  in<br \/>\nconnection with\t the accidents\twhich might have occurred in<br \/>\nany part  of the  State of Orissa.  When such a notification<br \/>\nwas pressed  in service\t we fail to appreciate as to how the<br \/>\nHigh Court  was justified  in not  entertaining\t the  review<br \/>\npetition  when\te  relevant  notification  was\tearlier\t not<br \/>\nbrought to  its notice\tspecially when the appellant was not<br \/>\ngiven an  opportunity to  point out  the notification before<br \/>\nthe High  Court, as  he was  not a  party nor any notice was<br \/>\nissued to  him in  connection with that case.  Therefore, it<br \/>\nmust be\t held that the order on review petition dated August<br \/>\n17, 1981  passed by  the High  Court cannot be sustained and<br \/>\nhas to be set aside.\n<\/p>\n<p id=\"p_6\">     The moot  question is  as to whether the High Court was<br \/>\nright in  rejecting on\tthe ground  of jurisdiction  of\t the<br \/>\nCommissioner the  claim of  the respondent  No.2 against the<br \/>\nrespondent No.1 in connection with the fatal accident caused<br \/>\nto her deceased husband during the course of and arising out<br \/>\nof  the\t  employment  of  respondent  No.2&#8217;s  husband  under<br \/>\nrespondent No.1\t  it  is true  that the\t accident had  taken<br \/>\nplace near  Rourkela.\tOur attention  was  invited  to\t the<br \/>\nnotification issued  on July  2, 1965 by the State of Orissa<br \/>\nin Labour,  Employment and  Housing Department.\t   The\tsaid<br \/>\nnotification was  issued in  exercise of the overs conferred<br \/>\non the\tState by  sub-section  (1)  of\t<a href=\"\/doc\/385099\/\" id=\"a_1\">section\t 20<\/a>  of\t the<br \/>\nWorkmen&#8217;s  <a href=\"\/doc\/1113485\/\" id=\"a_2\">Compensation\t Act<\/a>,  1923.\tThe  Offices  listed<br \/>\ntherein in  column (1)\twere ordered to be Commissioners for<br \/>\nworkmen&#8217;s  compensation\t  with\trespective  jurisdiction  as<br \/>\nspecified in  column (2)  of the  said notification  against<br \/>\neach of\t the listed  officers.\t At Column  (2) in  the said<br \/>\nnotification was  listed the  Deputy  Commissioner,  Orissa,<br \/>\nBhubaneswar, the  appellant  herein  and  the  area  of\t his<br \/>\njurisdiction is\t shown to  be the  whole  of  the  State  of<br \/>\nOrissa.\t   Therefore,  the  appellant  had  jurisdiction  to<br \/>\nentertain  the\t claims\t for   workmen&#8217;s  compensations\t  in<br \/>\nconnection with\t the accidents\tarising in  any part  of the<br \/>\nState of Orissa for which claims were to be lodged under the<br \/>\nAct against  the employers.   If  this notification had been<br \/>\nseen by\t the High  Court it  could never  have held that the<br \/>\nappellant had no jurisdiction to entrain the claim petition.<br \/>\nit is  not in dispute that though the accident took place in<br \/>\n1974 the  aforesaid notification  of July  2, 1965  held the<br \/>\nfield,\t Therefore, there  is no  escape from the conclusion<br \/>\nthat the  appellant at\tthe relevant  time in  1974 when the<br \/>\naccident took place had jurisdiction to entertain the claims<br \/>\npetition.   The order  of the High Court taking the contrary<br \/>\nview is\t therefore, quashed  and set  aside.   The appeal is<br \/>\naccordingly allowed.
