                 The petitioner was appointed as U.P.S.A. at St.Raphel’s High<\/p>\n
School, Ezhupunna, an aided school managed by the first respondent, with<\/p>\n
effect from 1.6.2005.   It is stated that she was appointed in the vacancy of Smt.<\/p>\n
Sheeba Varghese who was promoted as HSA in the vacancy of Smt.Bridgit<\/p>\n
Thomas who retired on 31.3.2005. Ext.P1 is the appointment order. Originally<\/p>\n
the District Educational Officer, Cherthala declined approval of appointment of<\/p>\n
the petitioner on the ground that there was no sanctioned post. The petitioner<\/p>\n
filed an appeal before the Deputy Director of Education, Alappuzha. The Deputy<\/p>\n
Director of Education called for a report from the District District Educational<\/p>\n
Officer, Cherthala. It is stated that the District Educational Officer submitted<\/p>\n
Ext.P2 reported dated 26.6.2006 stating that there was a vacancy to<\/p>\n
accommodate the petitioner.         Thereafter, the Deputy Director of Education<\/p>\n
allowed the appeal filed by the petitioner as per Ext.P3 order dated 29.6.2006<\/p>\n
and approved the appointment of the petitioner with effect from 1.6.2005. It was<\/p>\n
found that there was a vacancy for accommodating the petitioner with effect from<\/p>\n
1.6.2005. On the basis of Ext.P3 order dated 29.6.2006, the District Educational<\/p>\n
Officer approved the appointment of the petitioner with effect from 1.6.2005.<\/p>\n

                                          2<\/span><\/p>\n
                     2.      The Director of Public Instruction conducted an audit<\/p>\n
in the Office of the Deputy Director of Education, Alappuzha. An objection was<\/p>\n
raised that the Manager unauthorisedly shifted approved UPSAs as LPSAs for<\/p>\n
making fresh appointments without obtaining departmental sanction.              The<\/p>\n
Deputy Director of Education, on the basis of the audit objection, issued Ext.P5<\/p>\n
letter dated 15.5.2008 to the District Educational Officer stating that the Director<\/p>\n
of Public Instruction has directed the Deputy Director of Education to cancel the<\/p>\n
approval of appointment of the petitioner and till a final decision is taken by the<\/p>\n
Director of Public Instruction, not to disburse the salary to the petitioner. The<\/p>\n
petitioner has challenged Ext.P5 letter dated 15.5.2008 in this Writ Petition.<\/p>\n
                     3.      In the counter affidavit filed by the Deputy Director of<\/p>\n
Education, it is stated as follows:-\n<\/p>\n<\/p>\n
                                       \"2.       It  is    respectfully\n\n                     submitted     that  the  petitioner    Smt.Maijo\n\n<\/pre>\n
                     Kuruvila and Sri.John Ditto were appointed as<\/p>\n
                     Upper Primary School Assistants with effect<\/p>\n
                     from 1.6.2005 onwards against the promotion<\/p>\n
                     vacancy of Smt.Sheeba Varghese and in the<\/p>\n
                     transfer    vacancy   of   Smt.      Thankamma<\/p>\n
                     respectively.      At   the   time     of   these<\/p>\n
                     appointments there were only 16 UPSA’s on<\/p>\n
                     the roll, including Smt.Maijo Kuruvila and Sri.<\/p>\n
                     John Ditto, against the sanctioned post of 16<\/p>\n
                     UPSA’s. However later Government by G.O.<\/p>\n
                     (Rt) No.4260\/05\/Gl.Edn. Dated 1.10.05 have<\/p>\n

                   ordered to approve the appointments of<\/p>\n
                   Sri.Dennis   George     and   Smt.Annie.  M.J.<\/p>\n
\n                   (Whose appointments were approved as<\/p>\n
                   LPSA     with   effect   from   29.11.04   and<\/p>\n
                   continuing as LPSA in the school) as UPSA<\/p>\n
                   with effect from 5.6.02.    Hence, the District<\/p>\n
                   Educational Officer, Cherthala has rejected<\/p>\n
                   the appointment of Smt.Maijo Kuruvila and<\/p>\n
                   Sri. John Ditto stating that there were no<\/p>\n
                   sanctioned post of UPSA to provide the<\/p>\n
                   appointees.     However appeal filed by the<\/p>\n
                   Manager was allowed by this Office as the<\/p>\n
                   objection raised by the District Educational<\/p>\n
                   Officer, Cherthala was occured      due to the<\/p>\n
                   issuance    of   G.O.(Rt)   No.4260\/05\/Gl.Edn.<\/p>\n
                   dated 1.10.05 and the Manager has made<\/p>\n
                   necessary arrangements in this regard whcih<\/p>\n
                   is detailed as follows:-\n<\/p>\n<\/p>\n
                                      3.       Smt. Annie. M.J.\n<\/p>\n
                   and Sri.Dennis George were appointed as<\/p>\n
                   UPSA in St.Raphel’s        H.S.Ezhupunna with<\/p>\n
                   effect from 5.6.02 and these appointments<\/p>\n
                   were rejected at first by the department on the<\/p>\n
                   reason that protected HSA’s of the school who<\/p>\n
                   were deployed in the Government schools<\/p>\n
                   should have been absorbed against these<\/p>\n
                   vacancies, in terms of para (3) of G.O(P)<\/p>\n
                   No.178\/02\/Gl.Edn. dated 28.6.2002. Hence<\/p>\n
                   after recalling these protected High School<\/p>\n

                                       4<\/span><\/p>\n
                   Assistants to the parent school, the Manager<\/p>\n
                   re-appointed the above two teachers against<\/p>\n
                   the available vacancies of Lower Primary<\/p>\n
                   School Assistants w.e.f.29.11.2004 and the<\/p>\n
                   District Educational Officer, Cherthala has<\/p>\n
                   approved their appointments as LPSA from<\/p>\n
                   29.11.04 and they were continued in the<\/p>\n
                   school as such. However, they filed W.P.(c)<\/p>\n
                   No.16092\/05 before the Hon’ble High Court<\/p>\n
                   for their approval of appointment as UPSA<\/p>\n
                   from 5.6.02 onwards. Meanwhile Smt.Maijo<\/p>\n
                   Kuruvila and Sri.John Ditto were appointed as<\/p>\n
                   UPSA w.e.f. 1.6.05 in the vacancies of UPSA<\/p>\n
                   during 2005. However, on the basis of the<\/p>\n
                   Hon’ble    High Court direction in judgment<\/p>\n
                   dated 30.5.05 in W.P.(c) 16092\/05 the<\/p>\n
                   Government            vide           G.O.(Rt)<\/p>\n
                   No.4620\/05\/Gl.Edn. dated 1.10.05 directed<\/p>\n
                   the District Educational Officer, Cherthala to<\/p>\n
                   approve the appointment of Smt. Annie M.J.<\/p>\n
                   and Sri.Dennis George as UPSA w.e.f. 5.6.02<\/p>\n
                   itself.   Hence by the issuance of the<\/p>\n
                   Government Order dated 1.10.05 the total<\/p>\n
                   number of UPSA’s become 18 against the<\/p>\n
                   sanctioned post 16, even though Smt.Annie<\/p>\n
                   M.J. and Sri.Dennis George worked as LPSA<\/p>\n
                   from 29.11.04 with the earlier approval from<\/p>\n
                   the District Educational Officer, Cherthala.<\/p>\n
                   Hence on immediate receipt of the G.O(Rt)<\/p>\n
                   dated 1\/10\/05 in order to arrange the excess<\/p>\n
                   two    UPSA’s   the  Manager      has  issued<\/p>\n

                                        5<\/span><\/p>\n
                   proceedings Dated 4.10.05 by adjusting 2<\/p>\n
                   T.T.C.    holder    UPSA’s     namely     Smt.\n<\/p>\n
                   P.V.Thresia   and    Sri. N.T.Ralpy    to  the<\/p>\n
                   available vacancies in the L.P.Section. Hence<\/p>\n
                   it was clear that there were vacancies for the<\/p>\n
                   appointments    of  Smt.Majo     Kuruvila  and<\/p>\n
                   Sri.John Ditto with effect from 1.6.05 (there<\/p>\n
                   were only 16 UPSA’s in the roll as on 1.6.05<\/p>\n
                   against the sanctioned post of 16, including<\/p>\n
                   the appointee), the shifting of UPSA’s made<\/p>\n
                   by the Manager on 4.10.05 was for the<\/p>\n
                   compliance of the Government Order Dated<\/p>\n
                   1.10.05.   However the Manager had not<\/p>\n
                   obtained prior sanction from the District<\/p>\n
                   Educational Officer, Cherthala for the shifting<\/p>\n
                   of UPSA. Hence this Office has ratified the<\/p>\n
                   action of the Manager for the shifting of<\/p>\n
                   UPSA’s exercising the power of the appellate<\/p>\n
                   authority and directed the District Educational<\/p>\n
                   Officer, Cherthala to approve the appointment<\/p>\n
                   of Smt.Maijo Kuruvila and Sri. John Ditto as<\/p>\n
                   UPSA with effect from 1.6.05.\n<\/p>\n<\/p>\n
                                       4.     However the audit<\/p>\n
                   cell  of the Director of Public Instruction,<\/p>\n
                   Thiruvananthapuram      has  objected    these<\/p>\n
                   appointments. Reply furnished by this office<\/p>\n
                   was also not accepted by the audit cell<\/p>\n
                   pointing that at the time of issuance of the<\/p>\n
                   G.O.(Rt) No.4260\/05 dated 1.10.05 there<\/p>\n

                    were 18 UPSA’s in the roll (including the two<\/p>\n
                    unapproved UPSA’s (Smt.Maijo Kuruvila and<\/p>\n
                    Sri.John Ditto) against the sanctioned post of<\/p>\n
                    16 UPSA’s.\n<\/p>\n<\/p>\n
                                      5.        In    the     above\n\n                    circumstances     the   Deputy     Director   of\n\n                    Education    as    per   letter No.B1.3361\/08\n\n<\/pre>\n
                    dt.15.5.08 had requested Director of Public<\/p>\n
                    Instruction, Thiruvananthapuram to cancel the<\/p>\n
                    appointments of Smt.Maijo Kuruvila and<\/p>\n
                    Sri.John Ditto as UPSA’s from 1.6.05 and<\/p>\n
                    directed District Educational Officer, Cherthala<\/p>\n
                    to stop payments of salary to these teachers,<\/p>\n
                    now the matter is pending with the Director of<\/p>\n
                    Public    Instruction,    Thiruvananthapuram.<\/p>\n
                    Therefore Writ Petition is devoid of merit.”.<\/p>\n
                 4.        A perusal of the counter affidavit shows that the<\/p>\n
matter is not finally decided by the Director of Public Instruction. Ext.P5 letter<\/p>\n
was issued without hearing the petitioner. The Director of Public Instruction has<\/p>\n
also not heard the petitioner as well as the Manager. At the same time, till a final<\/p>\n
decision is taken in the matter, the Director of Public Instruction has directed the<\/p>\n
Deputy Director of Education, Alappuzha to withhold the salary of the petitioner.<\/p>\n
The Deputy Director has in turn issued Exhibit P5 letter to the District<\/p>\n
Educational Officer with copy to the Manager, the Headmaster and the<\/p>\n
petitioner.  To my mind, the direction to withhold the salary is illegal.      The<\/p>\n

                                           7<\/span><\/p>\n
appointment of the petitioner from 1.6.2005 was approved by the competent<\/p>\n
authority. Unless and until it is found after hearing the petitioner as well as the<\/p>\n
Manager that the approval of appointment of the petitioner was illegal, it is not<\/p>\n
proper to withhold the salary of the petitioner. At the same time, the matter has<\/p>\n
to be finalised by the Director of Public Instruction. In these circumstances, the<\/p>\n
Writ Petition is disposed of in the following manner:-<\/p>\n
                     (1)   The Director of Public Instruction shall issue notice to<\/p>\n
the petitioner as well as the Manager, hear them and finally decide the matter<\/p>\n
after considering all the contentions put forward by the petitioner as well as the<\/p>\n
Manager.\n<\/p>\n<\/p>\n
                     (2)    Till a final decision is taken by the Director of Public<\/p>\n
Instruction, Ext.P5 shall be kept in abeyance and the direction to withhold the<\/p>\n
salary of the petitioner shall not be implemented. Needless to say that this<\/p>\n
direction will have the effect of taking necessary steps by the respondents to<\/p>\n
continue to pay the salary of the petitioner.<\/p>\n
