     JUDGMENT:-\n<\/p>\n
                The Petitioner is a original Defendant-Tenant,<\/p>\n
     has     challenged     the    impugned order       of      Court       below<\/p>\n
     whereby,     the landlord\/Respondents’ case of subtenancy<\/p>\n
     under     Section 13(1)(b) of the Bombay Rents, Hotel and<\/p>\n
     Lodging     House     Rates (Control) Act, 1947 (for                 short,<\/p>\n
     “the     Bombay     Rent     Act”)   is   confirmed        and     thereby<\/p>\n
     allowed     the landlords case of eviction on that ground<\/p>\n
     only.\n<\/p>\n
     2.     The lease premises is situated at C.T.S.No.                     1873,<\/p>\n
     Bhamburda, Pune, consists of 2 blocks (for short, “the<\/p>\n
     suit     premises”).       The suit premises were let out                 for<\/p>\n
     running     a     hotel.     As averred, accepted by the               Court<\/p>\n
     below     that the petitioner’s have transferred the said<\/p>\n

     property        in     favour      of one      Krishna       Shetty        without<\/p>\n
     permission           and consent.        It is contended specifically<\/p>\n
     that     the Petitioners never parted with the possession<\/p>\n
     of     the property.           He is very much there and now he is<\/p>\n
     doing     business exclusively.                Though there is material<\/p>\n
     to show that he had assigned his business in favour of<\/p>\n
     one     Krishna Shetty, a deed of partnership Exhibit                               51<\/p>\n
     and     agreement           whereby it was accepted              that      Krishna<\/p>\n
     Shetty was his partner in the business of hotel.                                 That<\/p>\n
     was     a partnership between the Defendant, his                           brother<\/p>\n
     and the third person K.B.Shetty.\n<\/p>\n
     3.     Under priviso to Section 15(1), of the Bombay Rent<\/p>\n
     Act,     it     is permissible for the statutory                      tenant        to<\/p>\n
     transfer        his tenancy right, as a going concern,                           even<\/p>\n
     though        the agreement prevented such transfer                        without<\/p>\n
     previous        consent       of the landlord.             Admittedly,            the<\/p>\n
     person        running       business goodwill and stock in                     trade<\/p>\n
     had     been     assigned         as    permissible        under         the     said<\/p>\n
     provisions.            As     observed and held in Swastik                   Rubber<\/p>\n
     Products         Ltd.         &   Anr.         Vs.    Vasantrao            Mahadeo<\/p>\n
     Dhatingan,       2005        (1) Bom C.R.        327.\n<\/p>\n
                                                      327       by the         Division\n\n\n\n\n\n     Bench     of this Court, that such assignment of premises\n\n     whether       contract        contains         prohibition          or     without\n\n     consent       of landlord, is permissible.      assignment of leasehold premises by the Defendants was<\/p>\n
     not     subletting.            This Judgment is clearly cover                     the<\/p>\n
     case of the Petitioners also.\n<\/p>\n
     4.      It is brought to the notice during the course                               of<\/p>\n
     argument that said Sub-tenant Krishna Shetty had filed<\/p>\n
     Special         Civil       Suit    No.623      of    1986       against          the<\/p>\n
     Petitioner\/tenant is already dismissed.                          The reference<\/p>\n
     of the suit is made in the impugned order.\n<\/p>\n
     5.<\/p>\n
           In the present case, additional factor is that the<\/p>\n
     Petitioner never parted or left the premises.                              Being a<\/p>\n
     partner,        he     was also involved in the business.                         The<\/p>\n
     dominant        purpose of this agreement was not to sub-let<\/p>\n
     the     premises.           The    Apex    Court      in      Mahendra          Saree<\/p>\n
     Emporium        (II)     Vs.       G.V.Srinivasa          Murthy        2005      (1)<\/p>\n
     S.C.C.         481,
\n                    481      held that so long as              legal       possession<\/p>\n
     remains        with the tenant the mere factum of the tenant<\/p>\n
     having     entered          into an agreement of partnership                      for<\/p>\n
     the purpose of carrying on the business in the tenancy<\/p>\n
     premises        would       not amount to subletting,                 (Parvinder

     Singh     Vs.         Renu Gautam, 2004 (4) SCC 794).\n<\/p>\n
                                                     794                        In     the\n\n\n\n\n\n     present        case    also, in view of this Judgment                      I     see,\n\n     there     is     no     case      made    out   by      the      landlord,          of\n\n     subtenancy.           The    eviction order passed by the                       Court\n\n\n\n\n                                                          ::: Downloaded on - 09\/06\/2013 14:06:44 :::<\/span>\n                                       ( 5 )\n\n\n\n\n     below on this ground is, therefore, wrong.                    Therefore,\n\n     taking    all     this    into    account,    I    am       inclined        to\n\n\n\n\n                                                                          \n     interfere       with   the order passed by the Court                 below.\n\n     The   decree      of     eviction\/ possession,         is     therefore,\n\n\n\n\n                                                  \n     quashed     and set aside.        The suit of the plaintiffs is\n\n     dismissed.\n\n\n\n\n                                                 \n     6.    The Petition is, accordingly allowed in terms                         of\n\n     prayer    clause (b).       Rule made absolute.
