BARKATH ALI, JJ.\n                    ----------------------------------------------------------\n                             M.A.C.A No. 782 OF 2004\n                             ---------------------------------------\n                   DATED THIS THE 29TH DAY OF JULY, 2010\n\n\n                                        JUDGMENT\n<\/pre>\n<p id=\"p_1\">Barkath Ali, J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">                In this appeal under <a href=\"\/doc\/147367599\/\" id=\"a_1\">Section 173<\/a> of Motor Vehicles<\/p>\n<p>    Act, the claimants in OP(MV)No. 619\/2000 on the file of Motor<\/p>\n<p>    Accidents Claims Tribunal, Kottayam who are the mother, sister<\/p>\n<p>    and brother of deceased Aji challenge the judgment and award<\/p>\n<p>    of the Tribunal dated January 31, 2004 awarding a<\/p>\n<p>    compensation of Rs.1,72,000\/- for the loss caused to them on<\/p>\n<p>    account of the death of deceased Aji in a motor accident.<\/p>\n<p id=\"p_3\">           2.   The facts leading to this appeal in brief are these:<\/p>\n<p id=\"p_4\">                On April 4, 2000 at about 4.45 P.M. while                         the<\/p>\n<p>    deceased was driving his autorickshaw bearing registration<\/p>\n<p>    No.KL5 P\/4397, it collied head on with a bus bearing registration<\/p>\n<p>    No. KL5 F\/1476 at O.P Junction, M.C.Road, Kottayam.                           He<\/p>\n<p>    sustained serious injuries and he succumbed to the injuries<\/p>\n<p>    sustained on February 6, 2000 while undergoing treatment at the<\/p>\n<p>M.A.C.A NO. 782 OF 2004<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                2<\/span><\/p>\n<p>Medical College Hospital, Kottayam. Claimants have filed O.P<\/p>\n<p>before the M.A.C.T, Kottayam claiming a compensation of Rs. 7<\/p>\n<p>lakhs alleging negligence against the first respondent, driver of<\/p>\n<p>the offending bus.\n<\/p>\n<p id=\"p_5\">      3.   Respondents 1 and 2, the driver and owner of the<\/p>\n<p>offending bus remained absent before the Tribunal and were set<\/p>\n<p>ex-parte by the Tribunal. The 3rd respondent, the insurer of the<\/p>\n<p>offending bus filed a written statement admitting the policy and<\/p>\n<p>further contended that there was also negligence on the part of<\/p>\n<p>the driver of the autorickshaw.\n<\/p>\n<p id=\"p_6\">      4.   This O.P was tried jointly along with two other O.Ps<\/p>\n<p>filed by other injured persons in the same accident. Exts. A1 to<\/p>\n<p>A46 were marked on the side of the claimants. No evidence<\/p>\n<p>was adduced by the contesting 3rd respondent. The Tribunal on<\/p>\n<p>an appreciation of evidence found that the accident occurred<\/p>\n<p>due to the rash and negligent driving of the offending bus by first<\/p>\n<p>respondent and awarded a compensation of Rs. 1,72,000\/- with<\/p>\n<p>interest at the rate of 6% per annum from the date of petition till<\/p>\n<p>M.A.C.A NO. 782 OF 2004<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                3<\/span><\/p>\n<p>realization and a cost of Rs. 3500\/-. The claimants have now<\/p>\n<p>come up in appeal challenging the quantum of compensation<\/p>\n<p>awarded by the Tribunal.\n<\/p>\n<p id=\"p_7\">     5.    Heard the counsel for the appellants\/claimants and<\/p>\n<p>the counsel for the Insurance Company.\n<\/p>\n<p id=\"p_8\">     6.    The accident is not disputed.      The finding of the<\/p>\n<p>Tribunal that the accident occurred due to the negligence on the<\/p>\n<p>part of the first respondent is not challenged in this appeal.<\/p>\n<p>Therefore, the only question which arises for consideration is<\/p>\n<p>whether    the   claimants  are   entitled   to    any  enhanced<\/p>\n<p>compensation ?\n<\/p>\n<p id=\"p_9\">     7.    The Tribunal awarded a total compensation of Rs.<\/p>\n<p>1,72,000\/-. The break up of the award amount is as under:<\/p>\n<pre id=\"pre_1\">     For loss of dependency          : Rs. 1,54,000\n\n     For pain and sufferings         : Rs.   10,000\n\n     For love and affection          : Rs.     5,000\n\n     For funeral expenses            : Rs.     2,000\n\n     For Transportation              : Rs.     1,000\n\n                                           ------------\n                           Total     :Rs. 1,72,000\n                                           =======\n\nM.A.C.A NO. 782 OF 2004\n<span class=\"hidden_text\" id=\"span_2\">                                4<\/span>\n\n<\/pre>\n<p id=\"p_10\">     8.    The counsel for the claimant sought enhancement of<\/p>\n<p>the compensation awarded for loss of dependency, loss of love<\/p>\n<p>and affection and loss of estate.\n<\/p>\n<p id=\"p_11\">     9.    The Tribunal took the monthly income of the<\/p>\n<p>deceased as Rs. 1750\/- which comes to Rs. 21,000\/- per month<\/p>\n<p>and after deducting 1\/3 for his personal expenses, took Rs.<\/p>\n<p>14,000\/- per annum as his annual contributions to his family and<\/p>\n<p>adopted a multiplier of 11 as his mother was aged 54 at the time<\/p>\n<p>of accident and awarded a compensation of Rs. 1,54,000\/- for<\/p>\n<p>loss of dependency. The deceased was an autorickshaw driver.<\/p>\n<p>Ext.A19 is the copy of his driving license. Exts. A16 to A18<\/p>\n<p>show that he is having technical qualifications in Welding<\/p>\n<p>technology. Exts. A12 to A15 show that he is an NCC Cadet.<\/p>\n<p>Taking into consideration of all these aspects, we feel that his<\/p>\n<p>monthly income can be reasonably fixed at Rs. 3,000\/- which<\/p>\n<p>comes to Rs. 36,000\/- per annum. After deducting 1\/3 of his<\/p>\n<p>personal expenses, balance amount of Rs. 24,000\/- per annum<\/p>\n<p>can be taken as his annual contributions to his family. The<\/p>\n<p>M.A.C.A NO. 782 OF 2004<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                 5<\/span><\/p>\n<p>Multiplier of 11 adopted by the Tribunal is not seriously<\/p>\n<p>challenged. Thus, calculated, for the loss of dependency, the<\/p>\n<p>claimants are entitled to a compensation of Rs. 2,64,000\/-<\/p>\n<p>(Rs.24,000 x 11). Thus, on this count, claimants are entitled to<\/p>\n<p>an additional compensation of Rs. 1,10,000\/-.<\/p>\n<p id=\"p_12\">      10. The Tribunal awarded a compensation of Rs. 5,000\/-<\/p>\n<p>for loss of love and affection. The deceased was the only son of<\/p>\n<p>the claimants 1 and 2. Therefore, we feel that a compensation<\/p>\n<p>of Rs. 15,000\/- would be reasonable for loss of love and<\/p>\n<p>affection. Thus, the claimants are entitled to an additional<\/p>\n<p>compensation of Rs. 10,000\/- on this count.<\/p>\n<p id=\"p_13\">      11. No compensation was seen awarded for loss of<\/p>\n<p>estate.   In the circumstances of the case, we feel that a<\/p>\n<p>compensation of Rs. 2,500\/- would be reasonable for loss of<\/p>\n<p>estate. As regards, compensation awarded under other heads,<\/p>\n<p>we find the same to be reasonable and therefore, we are not<\/p>\n<p>disturbing the same.\n<\/p>\n<p id=\"p_14\">M.A.C.A NO. 782 OF 2004<br \/>\n<span class=\"hidden_text\" id=\"span_4\">                               6<\/span><\/p>\n<p id=\"p_15\">     12. Thus, the claimants are found entitled to an additional<\/p>\n<p>compensation of Rs. 1,22,500\/-. They are entitled to interest @<\/p>\n<p>6% per annum from the date of petition till realization and<\/p>\n<p>proportionate cost. The 3rd respondent, being the insurer of the<\/p>\n<p>offending vehicle shall deposit the amount before the Tribunal<\/p>\n<p>within two months from the date of receipt of a copy of this<\/p>\n<p>judgment. The award of the Tribunal is modified to the above<\/p>\n<p>extent.\n<\/p>\n<p id=\"p_16\">     The appeal is disposed of as found above.\n<\/p>\n<p id=\"p_17\">\n<p id=\"p_18\">                                         A.K.
