2.   12.08.2010.             Heard      learned      counsel       for     the<\/p>\n
                   petitioner and counsel appearing for the State.<\/p>\n
                             The     petitioner     is   apprehending      his<\/p>\n
                   arrest in a case registered under Sections 406<\/a>,<\/p>\n
                   409<\/a>, 420<\/a> and 120B<\/a> of the I.P.C.\n<\/p>\n
                             It is alleged that during distribution<\/p>\n
                   of      flood     relief       fund      the   petitioner<\/p>\n
                   misappropriated of the fund. The enquiry was<\/p>\n
                   made by the S.D.O., Saharsa, who found that<\/p>\n
                   certain persons misappropriated some sort of<\/p>\n
                   fund.    Though    in   the    enquiry    report   nothing<\/p>\n
                   specific against the petitioner as contained in<\/p>\n
                   Annexure-2 but in the F.I.R. the petitioner has<\/p>\n
                   been named which has been lodged on the basis<\/p>\n
                   of the enquiry report as contained in Annexure-<\/p>\n
                   2.<\/span><\/p>\n
                             Considering      the   aforesaid     facts,   let<\/p>\n
                   the clear carbon copy of the case diary of<\/p>\n
                   Basanahi P.S. Case No. 11 of 2010 be called for<\/p>\n
                   from the court of the learned C.J.M., Saharsa<\/p>\n
                   and put up this case after receipt of the case<\/p>\n
                   diary.\n<\/p>\n
                             Let no coersive steps be taken against
\n                       2<\/span><\/p>\n
       the   petitioner   in   the   meantime,    in   Basanahi<\/p>\n
       P.S. Case No. 11 of 2010 from the court of the<\/p>\n
       learned C.J.M., Saharsa.\n<\/p>\n
