No. 1098 of 2009\n                       `````````````````\n                         Dated: 6-4-2009\n\n                              O R D E R\n<\/pre>\n<p id=\"p_1\">     In this revision filed under Sec. 397 read with Sec. 401<\/p>\n<p><a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. the petitioner who is the accused in C.C. No. 713 of 2005<\/p>\n<p>on the file of the J.F.C.M. Kayamkulam for an offence punishable<\/p>\n<p>under <a href=\"\/doc\/724142\/\" id=\"a_1\">Section 324<\/a> I.P.C. challenges the conviction entered and<\/p>\n<p>the sentence passed against him by the lower appellate court for<\/p>\n<p>an offence punishable under Sec. 323 <a href=\"\/doc\/1569253\/\" id=\"a_2\">I.P.C<\/a>.<\/p>\n<p id=\"p_1\">     2.    The case of the prosecution can be     summarised as<\/p>\n<p>follows:\n<\/p>\n<p id=\"p_2\">     On 25-7-2005 at about 12 noon while P.W.1 Chellamma<\/p>\n<p>was proceeding along the pathway situated in Ward No. 8 in the<\/p>\n<p>company of CW2 a small baby, the accused out of his enmity<\/p>\n<p>towards P.W.1     assaulted her with a piece of   cutjan causing<\/p>\n<p>minor injuries    to P.W.1 and CW2.     The accused has thereby<\/p>\n<p>committed an offence punishable under Sec. 324 <a href=\"\/doc\/1569253\/\" id=\"a_3\">I.P.C<\/a>.<\/p>\n<p id=\"p_3\">     3.    On the accused pleading not guilty to the charge<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P. No. 1098 of 2009        -:2:-<\/span><\/p>\n<p>framed against him by the trial       court for the aforementioned<\/p>\n<p>offences, the prosecution was permitted to adduce evidence in<\/p>\n<p>support of its case.      The prosecution altogether examined 5<\/p>\n<p>witnesses as P.Ws 1 to 5 and got marked 5 documents as Exts.<\/p>\n<p>P1 to P5 and a cutjan as MO1.\n<\/p>\n<p id=\"p_4\">       4.     After the close of the prosecution evidence, the<\/p>\n<p>accused was questioned under Sec. 313 (1)(b) <a href=\"\/doc\/445276\/\" id=\"a_4\">Cr.P.C<\/a>. with<\/p>\n<p>regard to the incriminating circumstances appearing against him<\/p>\n<p>in the evidence for the prosecution.              He denied those<\/p>\n<p>circumstances and maintained his innocence. He did not adduce<\/p>\n<p>any defence evidence when called upon to do so.<\/p>\n<p id=\"p_5\">       5.       The learned Magistrate, after trial, as per judgment<\/p>\n<p>dated 15-3-2007 found the revision petitioner guilty of the<\/p>\n<p>ffences under Sec. 324 <a href=\"\/doc\/1569253\/\" id=\"a_5\">I.P.C<\/a>. and sentenced him to undergo<\/p>\n<p>simple imprisonment for six months and also to pay a<\/p>\n<p>compensation of Rs. 2,500\/- to P.Ws. 1 and 2 respectively. On<\/p>\n<p>appeal preferred by the revision petitioner before the Sessions<\/p>\n<p>Court, the Addl. Sessions Judge-I, Mavelikkara as per judgment<\/p>\n<p>dated        28\/2\/2008 altered the conviction into one punishable<\/p>\n<p>under Sec. 323 <a href=\"\/doc\/1569253\/\" id=\"a_6\">I.P.C<\/a>. and sentenced the revision petitioner to<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P. No. 1098 of 2009           -:3:-<\/span><\/p>\n<p>simple imprisonment for 15 days and to pay fine of Rs. 500\/-.<\/p>\n<p>Hence, this Revision.\n<\/p>\n<p id=\"p_6\">       6.     Eventhough the learned counsel appearing for the<\/p>\n<p>revision petitioner      assailed on various grounds the conviction<\/p>\n<p>entered against the revision petitioner, in as much as the<\/p>\n<p>conviction has been recorded by the courts below concurrently<\/p>\n<p>after a careful evaluation of the oral and documentary evidence<\/p>\n<p>in the case, this Court         sitting in revision will be loathe to<\/p>\n<p>interfere with the said conviction which is accordingly confirmed.<\/p>\n<p id=\"p_7\">       7.     What now survives for consideration is the question<\/p>\n<p>regarding the adequacy or otherwise of the sentence imposed on<\/p>\n<p>the revision petitioner. Having regard to the facts and<\/p>\n<p>circumstances of the case, I do not think that the revision<\/p>\n<p>petitioner deserves penal servitude by way of incarceration for<\/p>\n<p>the said conviction. I am of the view that         interest justice will<\/p>\n<p>be adequately met by            imposing a sentence to be passed<\/p>\n<p>hereinafter.           Accordingly,  for his conviction under Sec. 323<\/p>\n<p><a href=\"\/doc\/1569253\/\" id=\"a_7\">I.P.C<\/a>., the revision petitioner is sentenced to imprisonment till<\/p>\n<p>rising of the Court and to pay a sum of Rs. 3,500\/- each to<\/p>\n<p>P.W.1 and C.W.2 by way of compensation under Sec. 357 (3)<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">Crl.R.P. No. 1098 of 2009           -:4:-<\/span><\/p>\n<p><a href=\"\/doc\/445276\/\" id=\"a_8\">Cr.P.C<\/a>.
