     Appellant   is   the   plaintiff   in   O.S.1226\/1998   on<\/p>\n
the   file   of   the   Munsiff   Court,   Alappuzha.\n<\/p>\n
Respondents           are          the         defendants.                    Appellant<\/p>\n
instituted            the         suit         seeking         a         decree         for<\/p>\n
declaration   that   Ext.A4     order   issued   by     first<\/p>\n
respondent   dismissing   him   from   service   of   second<\/p>\n
respondent    as   an   Instructor   is   null   and   void   and<\/p>\n
not enforceable in law and therefore he is entitled<\/p>\n
to   be   reinstated   in   service.     He   also   sought   a<\/p>\n
decree         for           mandatory              injunction                directing<\/p>\n
respondents to reinstate him in service.  Appellant<\/p>\n
was   appointed                as   an   Instructor   in                         second<\/p>\n
respondent   Aravukad   Industrial   Training   Centre,<\/p>\n
Punnapra on 14.6.1990.  On 10.8.1998, he was placed<\/p>\n
under   suspension   under   Ext.A1   order     and   after   an<\/p>\n
enquiry   pursuant   to   Ext.A3   memo   of   charges   he   was<\/p>\n
dismissed   from   service.     It   was   challenged   in   the<\/p>\n
R.S.A.No.435\/2003               2<\/span><\/p>\n
suit   contending   that   the   dismissal   was   illegal   and<\/p>\n
the   procedures   were   not   complied   with   before<\/p>\n
dismissing him from service and as the dismissal is<\/p>\n
in   violation   of   the   principles   of   natural   justice,<\/p>\n
it   is   to   be   declared   null   and   void.     Respondents<\/p>\n
filed   a   written   statement   contending   that   the   suit<\/p>\n
itself is not maintainable and if at all the remedy<\/p>\n
is   to   claim   damages.     It   was   contended   that   first<\/p>\n
respondent is an unregistered voluntary association<\/p>\n
and employment of appellant is not protected by any<\/p>\n
statute and after due enquiry he was dismissed from<\/p>\n
service   and   it   cannot   be   challenged   in   the   civil<\/p>\n
court   and   therefore   appellant   is   not   entitled   to<\/p>\n
the decree sought for.\n<\/p>\n
      2. Learned Munsiff framed the necessary issues.\n<\/p>\n
On the evidence of Pws. 1 to 5, DW1 and Exts.A1 to<\/p>\n
A12   and   Exts.B1   to   B4,   learned   Munsiff   dismissed<\/p>\n
the  suit  holding  that  appellant  is  not  entitled  to<\/p>\n
the   protection   of   any   statute   and   therefore   he   is<\/p>\n
not   entitled   to   the   decree   sought   for.     Appellant<\/p>\n
challenged   the   decree   and   judgment   before   Sub<\/p>\n

Court,         Alappuzha         in         A.S.166\/2000.              Learned<\/p>\n
Additional   Sub   Judge   on   reappreciation   of   evidence<\/p>\n
confirmed   the   finding   of   the   learned   Munsiff   and<\/p>\n
dismissed   the   appeal.     It   is   challenged   in   the<\/p>\n
Second Appeal.\n<\/p>\n
      3.     Notice   was   issued   to   respondents   before<\/p>\n
admission.\n<\/p>\n
      4.     Learned   counsel   appearing   for   appellant<\/p>\n
was heard after the respondents appeared.\n<\/p>\n
      5.    The  arguments  of  learned counsel  appearing<\/p>\n
for   appellant   was   that     findings   of     courts   below<\/p>\n
establish that due enquiry was not conducted before<\/p>\n
appellant   was   dismissed   from   service   and   the   order<\/p>\n
of   dismissal   without   complying   with   the   principles<\/p>\n
of   natural   justice   is   unsustainable   and   therefore<\/p>\n
courts below should have granted the  decree sought<\/p>\n
for.   Relying on the decision of the Apex Court in<\/p>\n
A.Sundarambal   v.   Govt.   of   Goa,   Daman   &   Diu<\/a>   (AIR<\/p>\n
1988 SC 1700) it was argued that though the Supreme<\/p>\n
Court   found   the   employee   was   entitled   to   the<\/p>\n

protection   from   dismissal   damages   was     awarded   and<\/p>\n
in   such   circumstances,   as   appellant   was   dismissed<\/p>\n
from   service   in   violation   of     natural   justice,<\/p>\n
courts   below   should   have   granted   atleast     damages<\/p>\n
to him.\n<\/p>\n
      6.  On hearing the counsel for the appellant, I<\/p>\n
do   not   find   any   substantial   question   of   law<\/p>\n
involved in the appeal.\n<\/p>\n
      7.   Even   according   to   appellant,   he   is   not<\/p>\n
protected   by   any   of   the   statute.   He   is   not   a<\/p>\n
workman   as   provided   under   the   Industrial   Disputes<\/p>\n
Act<\/a>   and   is   not   entitled   to   get   protection   of   the<\/p>\n
said   Act.   The   courts   below   rightly   found   that<\/p>\n
appellant is not entitled to challenge the order of<\/p>\n
dismissal,   in   the   absence   of   any   statutory<\/p>\n
protection   available   to   him.            Though   learned<\/p>\n
counsel   appearing   for     appellant   argued   that   the<\/p>\n
dismissal   was   a   wrongful   dismissal,   it   was   not<\/p>\n
pointed out as to   how the dismissal was wrongful.\n<\/p>\n
Even   according   to   appellant,   the   terms   of<\/p>\n
employment does not provide for any mode of enquiry<\/p>\n

to  be  conducted,  before  he  could  be  dismissed  from<\/p>\n
service.  Respondents conducted an enquiry to their<\/p>\n
satisfaction   and   dismissed   appellant     from   service<\/p>\n
finding   that   his   continuance   in   their   service   is<\/p>\n
not  condusive.    In  such  circumstance,    civil  court<\/p>\n
cannot   interfere   with   the   order   of   dismissal   and<\/p>\n
appellant   is   not   entitled   to   get   a   decree   for<\/p>\n
reinstatement in service.\n<\/p>\n
      8.   Though   it   was   argued   that     Apex   Court   had<\/p>\n
granted   damages   in   a   case   where   an     employee   was<\/p>\n
dismissed   from   service   eventhough   he   is   not   a<\/p>\n
workman  as   defined   under     the   Industrial   Disputes<\/p>\n
Act<\/a>   in  Sundarambal’s   case   (supra),    the   facts   are<\/p>\n
entirely   different.     In   that   case,     damages   of<\/p>\n
Rs.40,000\/-   was   granted   in   full   and   final<\/p>\n
settlement of the claims of the employee not on the<\/p>\n
basis   of   any   legal   right.       As   is   clear   from<\/p>\n
paragraph   12   of   the   judgment,   it   was     on   the<\/p>\n
voluntary   statement   made   by   the   counsel   who<\/p>\n
appeared   for   the   management   that   the   said   amount<\/p>\n

could   be   given   to   the   appellant,   damages   was<\/p>\n
awarded.  It cannot be said that Sundarambal’s case<\/p>\n
lays   down   a     law   to   the   effect   that,   even   if   a<\/p>\n
person   is   not   entitled   to   any   statutory   protection<\/p>\n
and   is   dismissed   from   service,   he   is   entitled   to<\/p>\n
get damages.  I find no substantial question of law<\/p>\n
involved in the appeal.\n<\/p>\n
      Appeal is dismissed.\n<\/p>\n
