Advocate\n\nHon'ble Bala Krishna Narayana,J.\n<\/pre>\n<p id=\"p_1\">Heard\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0applicant\u00a0and\u00a0learned\u00a0A.G.A.\u00a0for\u00a0the\u00a0<br \/>\nState.\n<\/p>\n<p id=\"p_1\">It\u00a0is\u00a0contended\u00a0by\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0applicant\u00a0that\u00a0there\u00a0is\u00a0cross\u00a0<br \/>\nversion\u00a0of\u00a0the\u00a0incident\u00a0from\u00a0both\u00a0the\u00a0sides,\u00a0FIRs\u00a0have\u00a0been\u00a0registered\u00a0<br \/>\nand\u00a0both\u00a0sides\u00a0have\u00a0sustained\u00a0injuries.\u00a0From\u00a0the\u00a0side\u00a0of\u00a0the\u00a0<br \/>\nprosecution,\u00a0one\u00a0person\u00a0has\u00a0has\u00a0suffered\u00a0fire\u00a0arm\u00a0injuries\u00a0\u00a0and\u00a0from\u00a0<br \/>\nthe\u00a0side\u00a0of\u00a0the\u00a0applicant\u00a0two\u00a0persons\u00a0sustained\u00a0injuries.\u00a0It\u00a0is\u00a0very\u00a0<br \/>\ndifficult\u00a0to\u00a0decide\u00a0as\u00a0to\u00a0which\u00a0of\u00a0the\u00a0side\u00a0was\u00a0aggressor.\u00a0<br \/>\nThe\u00a0prosecution\u00a0has\u00a0not\u00a0come\u00a0with\u00a0clean\u00a0hands.\u00a0<br \/>\nThe\u00a0applicant\u00a0is\u00a0in\u00a0jail\u00a0since\u00a05.5.2007.\n<\/p>\n<p id=\"p_2\">It\u00a0was\u00a0next\u00a0contended\u00a0that\u00a0the\u00a0applicants\u00a0are\u00a0absolutely\u00a0innocent\u00a0and\u00a0<br \/>\nhave\u00a0been\u00a0falsely\u00a0implicated\u00a0in\u00a0the\u00a0instant\u00a0case.<br \/>\nIn\u00a0view\u00a0of\u00a0the\u00a0facts\u00a0and\u00a0circumstances\u00a0of\u00a0the\u00a0case\u00a0and\u00a0submissions\u00a0<br \/>\nmade\u00a0by\u00a0the\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0applicant\u00a0and\u00a0without\u00a0expressing\u00a0<br \/>\nany\u00a0opinion\u00a0on\u00a0the\u00a0merits\u00a0of\u00a0the\u00a0case\u00a0the\u00a0applicant\u00a0isentitled\u00a0to\u00a0be\u00a0<br \/>\nreleased\u00a0on\u00a0bail.\n<\/p>\n<p id=\"p_3\">Let\u00a0the\u00a0applicant\u00a0Ram\u00a0Bhajan\u00a0alias\u00a0Bhajan\u00a0Lal\u00a0,\u00a0alias\u00a0Bhaiya\u00a0Lal\u00a0alias\u00a0<br \/>\nBhaiyan\u00a0involved\u00a0in\u00a0case\u00a0crime\u00a0no.\u00a0255\u00a0of\u00a02007\u00a0under\u00a0Section\u00a0,\u00a0307,\u00a0<br \/>\n504,\u00a0506\u00a0<a href=\"\/doc\/1569253\/\" id=\"a_1\">I.P.C<\/a>.\u00a0\u00a0P.S.\u00a0Jalalabad\u00a0District\u00a0Shahjahanpur\u00a0be\u00a0released\u00a0on\u00a0<br \/>\nbail\u00a0on\u00a0his\u00a0executing\u00a0a\u00a0personal\u00a0bond\u00a0and\u00a0furnishing\u00a0two\u00a0sureties\u00a0each\u00a0<br \/>\nin\u00a0the\u00a0like\u00a0amount\u00a0to\u00a0the\u00a0satisfaction\u00a0of\u00a0the\u00a0court\u00a0concerned\u00a0subject\u00a0to\u00a0<br \/>\nthe\u00a0following\u00a0conditions:\u00ad<br \/>\nI.\u00a0The\u00a0applicant\u00a0shall\u00a0record\u00a0their\u00a0attendance\u00a0before\u00a0the\u00a0concerned<br \/>\nC.J.M.\u00a0On\u00a0the\u00a07th\u00a0day\u00a0of\u00a0every\u00a0month.\n<\/p>\n<p id=\"p_4\">II.\u00a0The\u00a0applicant\u00a0shall\u00a0not\u00a0tamper\u00a0with\u00a0the\u00a0prosecution\u00a0evidence.<br \/>\nIII.\u00a0The\u00a0applicant\u00a0shall\u00a0co\u00adoperate\u00a0in\u00a0the\u00a0early\u00a0conclusion\u00a0of\u00a0the\u00a0trial<br \/>\nand\u00a0will\u00a0not\u00a0seek\u00a0any\u00a0unnecessary\u00a0adjournments.<br \/>\nIn\u00a0case\u00a0of\u00a0breach\u00a0of\u00a0any\u00a0of\u00a0the\u00a0above\u00a0conditions,\u00a0the\u00a0trial\u00a0court\u00a0will\u00a0be\u00a0<br \/>\nat<br \/>\nliberty\u00a0to\u00a0cancel\u00a0the\u00a0bail.\n<\/p>\n<p id=\"p_5\">Order Date :- 12.7.2010<br \/>\ncps\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Ram Bhajan @ Bhajan Lal @ Bhaiyan &#8230; vs State Of U.P. on 12 July, 2010 Court No. &#8211; 49 Case :- CRIMINAL MISC.
