JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/11\/2011  \nORAL ORDER<\/pre>\n<p id=\"p_1\">\tMr.N.K.Majmudar,<br \/>\nlearned advocate for the petitioners has moved a draft amendment. The<br \/>\nsame is granted and may be carried out, within a period of two days<br \/>\nfrom today.\n<\/p>\n<p id=\"p_1\">\tHeard<br \/>\nMr.N.K.Majmudar, learned advocate for the petitioners. It is<br \/>\nsubmitted by him that the petitioners were granted a contract for<br \/>\ncutting of trees by way of auction. The petitioners deposited an<br \/>\namount of Rs.4,32,800\/- towards the contract, as required. On<br \/>\n25.10.2007, the petitioners were informed that a de-novo<br \/>\nprocess would take place. The petitioners filed a Civil Suit and on<br \/>\nthe application below Exhibit-5, a status-quo order came to be passed<br \/>\nby way of interim injunction. The Suit was later withdrawn by the<br \/>\npetitioners, as agreed upon by the petitioners and the respondents.<br \/>\nSubsequently, permission was granted to the petitioners for cutting<br \/>\ntrees as per the contract, as a special case. However, by<br \/>\ncommunication dated 21.6.2011 the petitioners were informed not to<br \/>\ntransport the timber outside the Range. By communication dated<br \/>\n20.06.2011 a decision was taken by the respondent to suspend the<br \/>\noperation of the contract. It is further submitted that this decision<br \/>\nregarding suspension of contract was revoked by communication dated<br \/>\n23.09.2011. Thereafter, the petitioners were orally informed not to<br \/>\ncut trees. The petitioners have paid a further amount by way of<br \/>\nenhancement of the contract amount by 10%, as per communication dated<br \/>\n11.05.2011. The learned advocate for the petitioners further submits<br \/>\nthat in spite of the revocation of the suspension of the contract, a<br \/>\ndecision has been unilaterally taken by the respondents by<br \/>\ncommunications dated 17.10.2011 and 20.10.2011 to cancel the<br \/>\ncontract. It is submitted that the petitioners were not heard before<br \/>\ntaking these decisions. Though, by communication dated 11.11.2011,<br \/>\nthe petitioners have been informed regarding the decision to conduct<br \/>\na fresh auction and have been called to present their case, the said<br \/>\ndecision has been taken without granting an opportunity of hearing to<br \/>\nthem. It is further submitted, that it has not been pointed out that<br \/>\nthe petitioners have committed any breach of the conditions of the<br \/>\ncontract.
