The learned Single Judge<br \/>\ndismissed the petition, discharged notice and vacated interim order.<br \/>\nThis Court [Coram: R.A. Mehta, Acting C.J. &amp; C.K. Thakker, J. (as<br \/>\nhe then was)] issued notice on 3rd February 1997<br \/>\nreturnable on 17th February 1997.  After a couple of<br \/>\nadjournments, on 9th April 1997, the Court passed the<br \/>\nfollowing order:\n<\/p>\n<p id=\"p_1\">?SHeard the learned<br \/>\nadvocates for the parties.  Appeal is admitted.  Hearing is<br \/>\nexpedited.??\n<\/p>\n<p id=\"p_2\">2.\tFrom<br \/>\nthe record, it transpires that an application being Civil Application<br \/>\nNo.4001 of 1996, was filed wherein the Court was pleased to pass the<br \/>\nfollowing order on 9th April 1997:\n<\/p>\n<p id=\"p_3\">?SHeard Mr.Shah for<br \/>\nthe applicants, Mr.Jhaveri for resp. no.1 and Mr.Jani for resp. no.3.<br \/>\nOn the facts and in the circumstances of the case, the interim relief<br \/>\nas prayed for cannot be granted.  This CA is, therefore, rejected.??\n<\/p>\n<p id=\"p_4\">3.\tThe<br \/>\nlearned advocate, who filed the Letters Patent Appeal is elevated to<br \/>\nthe Bench of this Court and therefore, the office issued notices to<br \/>\nthe appellants on 6th November 2006, to the effect that,<\/p>\n<p>?STake notice that<br \/>\nthe advocate Mr.Mukesh R. Shah engaged by you in the aforesaid<br \/>\nLetters Patent Appeal No.446 of 1996 has been elevated to the bench<br \/>\nof this High Court.  Therefore, you are hereby informed to remain<br \/>\npresent before this Hon&#8217;ble Court personally or by an advocate or by<br \/>\nsome one by law authorised to act for you, within one month from the<br \/>\ndate of service of this notice to you.   If no appearance<br \/>\nis made on your behalf, your advocate or by some one by law<br \/>\nauthorised to act for you, the Court will hear the said petition ex<br \/>\nparte.??                                               (emphasis<br \/>\nsupplied) <\/p>\n<p>The<br \/>\nsaid notices are served on the appellants on 21st and 22nd<br \/>\nNovember 2006.  Despite service of the notices, the appellants chose<br \/>\nnot to cause any appearance before this court.  The matter was taken<br \/>\nup for hearing.  Learned advocate Mr.Sarthak Vyas for Mr.P.K. Jani<br \/>\ninvited attention of the Court to the judgement and order  dated 26th<br \/>\nMarch 1996 passed by the learned Single Judge.  On perusal of the<br \/>\nsame and on perusal of the contentions raised in the appeal, the<br \/>\nCourt finds no reason to interfere with the judgement and order dated<br \/>\n26th March 1996 passed by the learned Single Judge.\n<\/p>\n<p id=\"p_5\">4.\tIn<br \/>\nthe result, the Letters Patent Appeal fails and the same is<br \/>\ndismissed.\n<\/p>\n<p id=\"p_6\">(RAVI R.
