\nand Section 12(1)(io)<\/a>4<\/a>{d).(e) gift  1967 and the
\npetitioner was arirayied    spring the course of
\ninvestigation,the’Po:lice*::havejtseiaed-Iseveral properties from the
\npetitioner via’,  phone, H.i). laptop and
\nseverai other pQrcpertieVs._’.’4V the petitioner preferred an
\napplipcationilziyefore the’~\u00abt2Vh_i_ef.Metropolitan Magistrate, Bangalore<\/p>\n
for’:_release oV:f=.ti1e”‘*-passport, mobile phone and iaptop. The<\/p>\n
 learned ii\u00e9agistrate  rejected the said application.<\/p>\n
 4. Feelttingy aggrieved by the same, the petitioner has<\/p>\n
 Criminai Petition seeking for release of the<\/p>\n
A”4″.’jpa_ss’poit  his favour. The learned counsel for the petitioner<\/p>\n

S. It is the contention of the iearned counsei”f’f’o:f”L:’–thve<\/p>\n
petitioner that the Centrai Bureau of InvestigationT”(  ”<\/p>\n
short) does not have power to impound’ the   it<\/p>\n
passport can be impounded by the Passport’:<\/p>\n
Section 10(3)<\/a> of the Passports Act:  soon._.as_the p.asspo”rt is ” ‘<\/p>\n
seized, CBI cannot retain the same.— :””vAt”–\u00bbtLhe most.,. they maY
\nforward the same to the”  “Auf_tih:o’ri.ty for taking

6. Learnedt4_couvns’ei  CVIBI submits that the CBI has
\nvested the poi”\/ve.rV:Vto seize the incriminating documents.<\/p>\n
Avccordirigeittiy\/,  has seized the passport and other<\/p>\n
 docun'”‘ie.n’t’s_Vpwyhichwere used for the commission of the offence.<\/p>\n
 matter is=\u00a7un’d”er investigation. The CBI has aiso written a<\/p>\n
tu44’i_i’e’ttes:.::to.astheV”‘i5assport Authority to impound the passport in<\/p>\n
 “The matter is under active consideration before the<\/p>\n
  Passport Officer. It is the contention of the learned<\/p>\n

 C.B.I. reported in 2008 Crl.LJ 1599 wherein it is<\/p>\n

“While the poiice may have the power to seize<\/p>\n
a passport under Section 102(1)<\/a>, Cr.P.C<\/a>., it does not<\/p>\n
have the power to impound the same. Impounding <\/p>\n
of a passport can only be done by the paSspor_tic\u00bb.r”<\/p>\n
authority under Section 10(3)<\/a> of the Passport..~Act,.’,’__’ <\/p>\n
1967. Even the Court cannot impound a pa:-;.s.po,rt,V:
