{"id":267801,"date":"2009-01-06T00:00:00","date_gmt":"2009-01-05T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/nathi-singh-vs-mannu-khan-and-others-on-6-january-2009"},"modified":"2015-04-29T01:50:36","modified_gmt":"2015-04-28T20:20:36","slug":"nathi-singh-vs-mannu-khan-and-others-on-6-january-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/nathi-singh-vs-mannu-khan-and-others-on-6-january-2009","title":{"rendered":"Nathi Singh vs Mannu Khan And Others on 6 January, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Nathi Singh vs Mannu Khan And Others on 6 January, 2009<\/div>\n<pre id=\"pre_1\">      IN THE HIGH COURT OF PUNJAB AND HARYANA AT\n                     CHANDIGARH.\n\n\n                                                              CR NO.6 of 2009\n                                                      Date of Decision:6.1.2009.\n\nNathi Singh\n                                         ..........Petitioner.\n\n              Versus\n\nMannu Khan and others.\n                                     ..........Respondents.\n\n\nCORAM:        HON'BLE MR.JUSTICE JASWANT SINGH.\n\nPresent:      Mr.Sandeep Jasuja,Advocate for the petitioner.\n\n\nJASWANT SINGH,J.\n<\/pre>\n<p id=\"p_1\">              Present Revision Petition under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the Constitution<\/p>\n<p>of India has been filed by the petitioner for setting aside the order dated<\/p>\n<p>9.2.2008 (Annexure P3) and 8.11.2008 (Annexure P7) passed by the learned<\/p>\n<p>Motor Accident Claims Tribunal, Gurgaon (for short Tribunal), whereby the<\/p>\n<p>claim of the petitioner for releasing the remaining amount of compensation<\/p>\n<p>(lying deposited in Fixed Deposit Receipt) granted by the learned Tribunal<\/p>\n<p>vide its award dated 5.11.2007, on account of injuries suffered by the<\/p>\n<p>petitioner, has been rejected.\n<\/p>\n<p id=\"p_1\">              The case of the petitioner is that on account of 90% permanent<\/p>\n<p>disability suffered by him in a motor vehicle accident, the learned Tribunal<\/p>\n<p>had partly allowed his application and awarded compensation of<\/p>\n<p>Rs.2,86,000\/- only alongwith costs and interest @ 9% per annum from the<\/p>\n<p>date of institution of the petition till the final realisation thereof. It is further<\/p>\n<p>the case of the petitioner that it was nowhere provided in the award that the<\/p>\n<p>compensation was to be partly disbursed and partly put in a Fixed Deposit<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> CR NO.6 of 2009                                           2<\/span><\/p>\n<p>Receipt (FDR) in a nationalised bank. However, on the application filed by<\/p>\n<p>the petitioner for the release of compensation the learned Tribunal vide<\/p>\n<p>order dated 9.2.2008 (Annexure P3) ordered that 75% of the awarded<\/p>\n<p>amount shall be deposited in the name of the petitioner-claimant in some<\/p>\n<p>nationalised bank in STDR, fetching a maximum interest for a period of<\/p>\n<p>three years and remaining 25% shall be disbursed in cash. It is admitted by<\/p>\n<p>the petitioner-claimant that    he has received 25% of the compensation<\/p>\n<p>amount and the remaining amount of Rs.1,59,825\/- was deposited in the<\/p>\n<p>FDR in State Bank of Patiala.\n<\/p>\n<p id=\"p_2\">            It is further the case of the petitioner that after the petitioner<\/p>\n<p>had suffered 90% disability which resulted in amputation of his right foot,<\/p>\n<p>he developed severe infection in his foot and consequently had to remain in<\/p>\n<p>hospital for treatment from 13.10.2008 to 17.10.2008 and incurred huge<\/p>\n<p>amount on his treatment\/operation. Since the petitioner needed money for<\/p>\n<p>his treatment and sustenance he moved an application before the learned<\/p>\n<p>Tribunal for release of the remaining amount of compensation which was<\/p>\n<p>declined vide the impugned orders dated 9.2.2008 (Annexure P3) and<\/p>\n<p>8.11.2008 (Annexure P7).\n<\/p>\n<p id=\"p_3\">            Learned counsel for the petitioner submits that the petitioner<\/p>\n<p>requires remaining amount of compensation awarded to him for his further<\/p>\n<p>treatment and therefore, the deposit of the balance amount in FDR for a<\/p>\n<p>period of three years would not serve any purpose. In support of the same<\/p>\n<p>he relies upon Nazar Mohammad v. Harbans Singh, The Punjab Law<\/p>\n<p>Reporter (2006-2) 818; Mohinder Singh and others v. Kulbir Singh and<\/p>\n<p>others, The Punjab Law Reporter (2008-3) 736; <a href=\"\/doc\/115822\/\" id=\"a_1\">H.S.Ahammed Hussain v.<\/p>\n<p>Irfan Ahammed<\/a>, 2002(34) RCR (Civil) 563; and <a href=\"\/doc\/1683465\/\" id=\"a_2\">General Manager,<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> CR NO.6 of 2009                                            3<\/span><\/p>\n<p>Kerala State Road Transport Corporation, Trivandrum V. Susamma<\/p>\n<p>Thomas (Mrs.) and others<\/a>, (1994-2) 107 PLR 1.\n<\/p>\n<p id=\"p_4\">            It cannot be disputed that the petitioner has suffered serious<\/p>\n<p>injuries on his leg which has resulted in 90% disability. It is also clear that<\/p>\n<p>the petitioner has remained in hospital for various periods and his right foot<\/p>\n<p>has been amputated.     It also cannot be disputed that        the petitioner is<\/p>\n<p>undergoing further treatment for which he requires money.<\/p>\n<p id=\"p_5\">            The Hon&#8217;ble Supreme Court in H.S.Ahammed Hussain&#8217;s case<\/p>\n<p>(supra) has observed that deposit of compensation in Fixed Deposit<\/p>\n<p>Schemes is not proper in the case of adults and if invested in Fixed Deposit,<\/p>\n<p>it has to be withdrawn prematurely. Further, the Hon&#8217;ble Apex Court in<\/p>\n<p>General Manager, Kerala State Road Transport&#8217;s case (supra) has laid<\/p>\n<p>down guidelines stating that in case of personal injuries for further<\/p>\n<p>treatment the necessary amounts from the FDRs should be permitted to be<\/p>\n<p>withdrawn. In Nazar Mohammad&#8217;s and Mohinder Singh&#8217;s case (supra) in<\/p>\n<p>similar circumstances the Courts have directed the release of the remaining<\/p>\n<p>amount of compensation which was lying deposited in the FDRs.<\/p>\n<p id=\"p_6\">            In view of the aforesaid facts of the case and the legal position,<\/p>\n<p>this revision petition is allowed and the impugned orders dated 9.2.2008<\/p>\n<p>(Annexure P3) and 8.11.2008 (Annexure P7) passed by the learned Tribunal<\/p>\n<p>are quashed and the remaining amount of compensation lying deposited in<\/p>\n<p>the FDRs alongwith interest is directed to be released to be petitioner-<\/p>\n<p>claimant.<\/p>\n<pre id=\"pre_1\">\n\n\n\n6.1.2009.
