Justice S.SIRI JAGAN\n\n Dated :07\/01\/2011\n\n O R D E R\n                                 S.SIRI JAGAN, J.\n                         ==================\n                          W.P.(C).No.35832 of 2010\n                         ==================\n                 Dated this the 7th day of January, 2011\n                                 J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Petitioner&#8217;s grievance in this writ petition is that although the<\/p>\n<p>petitioner was suspended more than a year ago, the disciplinary<\/p>\n<p>proceedings pursuant to suspension have not been completed yet. At<\/p>\n<p>the same time, the petitioner is continued on suspension indefinitely.<\/p>\n<p>The petitioner, therefore, seeks the following reliefs:<\/p>\n<blockquote id=\"blockquote_1\"><p>      &#8220;i)    issue a writ of certiorari or any other appropriate writ, direction<br \/>\n             or order calling for the records leading to Ext.P6 and quashing<br \/>\n             the same.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      ii)    issue a writ of mandamus or any other appropriate writ,<br \/>\n             direction or order directing respondents 1 and 2 to reinstate the<br \/>\n             petitioner in service forthwith.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      iii)   declare that the action of the respondents in not reinstating the<br \/>\n             petitioner in service is discriminatory and violative of <a href=\"\/doc\/367586\/\" id=\"a_1\">Article 14<\/a><br \/>\n             of the Constitution of India.&#8221;<\/p><\/blockquote>\n<p id=\"p_1\">\n<p id=\"p_2\">      2.    By orders dated 17.12.2010 and 3.1.2011, I directed the<\/p>\n<p>learned Government Pleader to get instructions as to what proceedings<\/p>\n<p>have been taken in the disciplinary proceedings initiated by suspending<\/p>\n<p>the petitioner more than a year ago.\n<\/p>\n<p id=\"p_3\">      3.    Today, the learned Government Pleader submits that no<\/p>\n<p>further proceedings have been taken in the matter. I am of opinion<\/p>\n<p>that after suspending the petitioner, the respondents have to take the<\/p>\n<p>proceedings to its logical conclusion expeditiously.<\/p>\n<p id=\"p_4\">      4.    In the above circumstances, this writ petition is disposed of<\/p>\n<p>with the following directions:\n<\/p>\n<p id=\"p_5\"><span class=\"hidden_text\" id=\"span_1\">w.p.c.35832\/10                      2<\/span><\/p>\n<p id=\"p_6\">       The respondents shall see that the disciplinary proceedings<\/p>\n<p>initiated against the petitioner by suspending him shall be taken to its<\/p>\n<p>logical conclusion, as expeditiously as possible, at any rate, within four<\/p>\n<p>months from the date of receipt of a certified copy of this judgment.<\/p>\n<p>If, for any valid reason, the respondents are unable to complete the<\/p>\n<p>proceedings within the said four months, the petitioner shall be<\/p>\n<p>reinstated in service, after the expiry of the said four months, if the<\/p>\n<p>respondents do not decide to revoke the suspension earlier.<\/p>\n<p id=\"p_7\">                                                        Sd\/-\n<\/p>\n<pre id=\"pre_1\">sdk+                                              S.SIRI JAGAN, JUDGE\n\n          \/\/\/True copy\/\/\/\n\n\n\n\n                              P.A. to Judge\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court V.Radhakrishna Pillai vs State Of Kerala on 7 January, 2011 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 35832 of 2010(D) 1.
