YOGESH S LAKHANI\nfor Appellant \nMR BHARAT\nJANI for Respondents : 1 -\n2. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BHAGWATI PRASAD\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/07\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">(Per<br \/>\n: HONOURABLE MR.JUSTICE BHAGWATI PRASAD)<\/p>\n<p>Heard<br \/>\n\tlearned advocate for the parties.\n<\/p>\n<p id=\"p_1\">The<br \/>\n\tappellant by way of this Letters Patent Appeal under Clause 15 of<br \/>\n\tthe Letters Patent has approached this Court challenging the<br \/>\n\tjudgment and order dated 3.3.1997 passed by learned Single Judge in<br \/>\n\tSpecial Civil Application No. 5431 of 1994 to the extent the Special<br \/>\n\tCivil Application is dismissed.\n<\/p>\n<p id=\"p_2\">The<br \/>\n\tappellant-petitioner joined the services of respondent Bank on<br \/>\n\t6.1.1964, as a Cashier-cum-Clerk. After 8 years, the petitioner was<br \/>\n\tpromoted to the post of an Officer. The petitioner was issued two<br \/>\n\tchargesheets dated 15.11.1982 and 28.5.1983. After holding<br \/>\n\tDepartmental Inquiry, the petitioner&#8217;s services came to be<br \/>\n\tterminated. The petitioner was suspended on 26.4.1982. The appeal<br \/>\n\tpreferred against the order of termination was also rejected,<br \/>\n\ttherefore, the petitioner filed Special Civil Application No. 3769<br \/>\n\tof 1987, which is also dismissed and against same, Letters Patent<br \/>\n\tAppeal is also filed.\n<\/p>\n<p id=\"p_3\">It<br \/>\n\tis the case of the petitioner that respondent Bank was suppose to<br \/>\n\tpay the amount of Provident Fund and the respondent Bank wanted to<br \/>\n\tillegally deduct the amount of Rs.12,000\/- towards misappropriation,<br \/>\n\tout of the amount paid to the petitioner. It is the submission of<br \/>\n\tthe petitioner through out that there was no loss to the Bank and<br \/>\n\tthe respondent bank was not in a position to explain as to how the<br \/>\n\tamount of Rs.12,000\/- was to be deducted. Accordingly, the<br \/>\n\tpetitioner filed Special Civil Application No. 5431 of 1994 and the<br \/>\n\tlearned Single Judge by impugned order partly allowed the Special<br \/>\n\tCivil Application and ordered the respondent Bank to pay an interest<br \/>\n\tat the rate of 12% p.a., on the amount of Rs.19482-66 from 1.1.1987<br \/>\n\ttill the date when the said amount has been paid to him in pursuance<br \/>\n\tof the order dated 26.7.1994 of this Court.\n<\/p>\n<p id=\"p_4\">We<br \/>\n\thave heard learned counsel for the parties at length and perused the<br \/>\n\timpugned order. This appeal is followed by earlier appeal being<br \/>\n\tLetters Patent Appeal No. 369 of 1997 decided by this Court today,<br \/>\n\twherein the appeal was dismissed after departmental appeal, and<br \/>\n\tfindings were upheld by the appellate authority, learned Single<br \/>\n\tJudge and this Court in Letters Patent Appeal. The appellant in this<br \/>\n\tappeal has asked for release of Rs.12,000\/- which have been withheld<br \/>\n\tby the bank on the ground that this amount was withheld due to the<br \/>\n\tloss incurred to the bank. When this Court has upheld the finding<br \/>\n\tthat because of act of appellant, the bank has caused loss and<br \/>\n\ttherefore, there is no force in the appeal and is dismissed<br \/>\n\taccordingly.
