Against<\/p>\n<p>2* which the revenue had come up in revision petition<\/p>\n<p>:Vbef&#8217;o.re_g2 court in STRP 121\/2004. A Division<\/p>\n<p>Bench o\ufb01 this court on 29.6.2006 considering the<\/p>\n<p>V&#8221;d arguments advanced by both the parties allowed the<\/p>\n<p>&#8220;rewision petition of the revenue and remanded the<\/p>\n<p>_ matter to the tribunal without answering the<\/p>\n<p>.5&#8243;\/&#8217;;&#8217;<\/p>\n<p>&#8220;=.\n<\/p>\n<p id=\"p_1\">\n<p>tr<\/p>\n<p>questions of law &#8220;to re&#8211;consider &#8216;the question of<br \/>\njurisdiction only without reconsidering the matter<br \/>\non merits. This order is called in question in<\/p>\n<p>this revision petition.\n<\/p>\n<p id=\"p_2\">3. The only point to be considered by usfin this<\/p>\n<p>revision petition is&#8217;whether the order oassed by<br \/>\nthis court on an earlier occasion \ufb01n #9.6.2006 was<br \/>\nan order of remandl to dthed,tribunal only to<br \/>\nconsider thek question do\ufb01drj\ufb01\ufb01igdiction of the<br \/>\nrevisionaii\ufb02authorit\ufb01l and leg; also required to<br \/>\nconsider the gntire ease oi the parties afresh.<\/p>\n<p id=\"p_3\">4. iwe=jhe\u00a7\u00e9fi\u00a7ef\ufb01a\u00a7di the order passed by this<br \/>\ncourt. vrlnn pgrg\u00e9i &amp; 9 this court without<\/p>\n<p>considering the nmrits of the matter has allowed<\/p>\n<p>&#8216; the revision petition and remanded the matter to<\/p>\n<p>&#8216;the trihunal to consider all points. In para&#8211;7 it<\/p>\n<p>h&#8217; is held that they were not willing to go into the<\/p>\n<p>it nerits of the matter in the absence of actual<\/p>\n<p>&#8216;finding with regard to jurisdiction of the<\/p>\n<p>\u00ab~.i<br \/>\niv<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">6<\/span><\/p>\n<p id=\"p_4\">5. Accordingly, the petition is allowed.
