SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tBy<br \/>\nway of the present petition under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the Constitution of<br \/>\nIndia the petitioner-original complainant has prayed for an<br \/>\nappropriate writ, order or direction quashing and setting aside the<br \/>\nimpugned order dated 25\/10\/2010 passed by the learned Additional<br \/>\nSessions Judge, Ahmedabad (Rural) in Criminal Revision Application<br \/>\nNo. 61\/2010 by which the learned revisional Court has reserved the<br \/>\nliberty in favour of respondent no. 1-original accused to lead the<br \/>\nevidence in trial in respect of <a href=\"\/doc\/1255223\/\" id=\"a_1\">Section 507<\/a> of the Indian Penal Code<br \/>\nand to cross examine the witness of  the prosecution side.\n<\/p>\n<p id=\"p_1\">2.\tThe<br \/>\nlearned advocate appearing on behalf of the petitioner has submitted<br \/>\nthat as such the petitioner  is not aggrieved by the impugned order<br \/>\npassed by the learned revisional Court, however, it is apprehended<br \/>\nthat by the aforesaid there will be delay in conducting the trial as<br \/>\neven otherwise  it is already delayed by 11 years.  The learned<br \/>\nadvocate appearing on behalf of the petitioner has submitted that if<br \/>\na suitable direction is  issued   to  the learned trial Court to<br \/>\nconclude the trial  at the earliest and within the stipulated time<br \/>\nthe petitioner will be satisfied  and he does not press the present<br \/>\npetition.\n<\/p>\n<p id=\"p_2\">3.\tIn<br \/>\nview of the above, by a suitable direction directing the learned<br \/>\ntrial Court to conclude the  trial at the earliest and within the<br \/>\nstipulated time  the apprehension of the  petitioner can be very well<br \/>\ntaken care of.  In view of the above, the present petition is<br \/>\ndismissed as not pressed.  Considering the fact that trial is<br \/>\nalready delayed and more than 11 years have passed,  the learned<br \/>\ntrial Court is hereby directed to finally decide, dispose of and<br \/>\nconclude the trial of Criminal Case No. 1366\/1999 at the earliest and<br \/>\nin no case later than four months from the date of receipt of the<br \/>\npresent order.
