THE MANAGING DIRECTOR, THE SIWAN CO-\n                OPERATIVE SPINNING MILLS HAVING ITS HEAD\n                OFFICE AT 5TH FLOOR, LALIT BHAWAN, BAILEY\n                ROAD, PATNA\n                                         -----------\n<\/pre>\n<p id=\"p_1\">8   20.6.2011                  The present appeal has been filed against the order<\/p>\n<p>                   dated 10.9.2009 passed by the learned Single Judge in C.W.J.C.<\/p>\n<p>                   No.4511 of 2009, whereby a direction was given to absorb the<\/p>\n<p>                   petitioner, respondent herein in one of the department of the State<\/p>\n<p>                   Government on the ground that he was an employee of Siwan Co-<\/p>\n<p>                   operative Spinning Mills Limited and as the said Spinning Mills<\/p>\n<p>                   has became defunct and its other employees were absorbed in<\/p>\n<p>                   other Government services, the petitioner, respondent herein is<\/p>\n<p>                   also entitled for the same treatment.\n<\/p>\n<p id=\"p_1\">                               The matter was contested very vehemently by the<\/p>\n<p>                   appellant-department before the learned Single Judge. However,<\/p>\n<p>                   the learned Single Judge having gone into the merits of the case<\/p>\n<p>                   has not agreed with the contentions raised by the department that<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                       2<\/span><\/p>\n<p>the petitioner, respondent herein is not entitled for absorption in<\/p>\n<p>view of law laid down by the Apex Court in the case of &#8216;State of<\/p>\n<p>Assam Vs. Barak Upatyaka D.U. Karmachari anstha&#8217; reported<\/p>\n<p>in (2009) 5 SCC 694. The learned Single Judge has further<\/p>\n<p>directed the department to absorb the petitioner in the same<\/p>\n<p>manner as other co-employees of the said Spinning Mills have<\/p>\n<p>been absorbed within a period of one month from the date of<\/p>\n<p>order. In the said order the learned Single Judge has also made it<\/p>\n<p>clear that the Siwan Co-operative Spinning Mills shall be<\/p>\n<p>responsible for compliance of orders passed by this Court.<\/p>\n<p id=\"p_2\">            Before us it has been contented by the learned counsel<\/p>\n<p>appearing on behalf of the appellants that there is no policy<\/p>\n<p>decision of the State Government to absorb an employee of the<\/p>\n<p>defunct Spinning Mills. On the other hand, learned counsel<\/p>\n<p>appearing on the petitioner, respondent herein has contended that<\/p>\n<p>other employees of the said Spinning Mills have already been<\/p>\n<p>absorbed in the different departments of the State Government and<\/p>\n<p>as such the petitioner, respondent herein is also entitled for similar<\/p>\n<p>treatment. There should not be any discrimination on the ground<\/p>\n<p>that there is no any policy decision of the State Government to<\/p>\n<p>absorb the petitioner in the different departments of the State<\/p>\n<p>Government.\n<\/p>\n<p id=\"p_3\">            We had the occasion to go through the judgment of the<\/p>\n<p>learned Single Judge. We are of the opinion that the judgment of<\/p>\n<p>the learned Single judge is well considered judgment on the facts<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    3<\/span><\/p>\n<p>              and law and warrants no interference at all.\n<\/p>\n<p id=\"p_4\">                          Accordingly, this L.P.A. is dismissed.<\/p>\n<pre id=\"pre_1\">\n\n\n                                                   ( T.
