RAMKUMAR , J.\n               = = = = = = = = = = = = = = = =\n                    Crl.A.No.147 of 2007\n              = = = = = = = = = = = = = = = = =\n          Dated this the 24th day of November, 2009.\n\n                          JUDGMENT\n<\/pre>\n<p id=\"p_1\">     In this appeal filed by the complainant in S.T.No.432 of<\/p>\n<p>2003 of Chief Judicial Magistrate Court, Kollam renumbered<\/p>\n<p>as S.T.No.44 of 2006 on the file of the Judicial First Class<\/p>\n<p>Magistrate-III, Kollam, he challenges the order dated<\/p>\n<p>2.11.2006 passed by the Magistrate acquitting the accused<\/p>\n<p>under <a href=\"\/doc\/1988204\/\" id=\"a_1\">Section 256(1)<\/a> Cr.P.C due to the non-appearance of<\/p>\n<p>the complainant. The prosecution was one under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section<\/p>\n<p>138<\/a> of the Negotiable Instruments Act, 1881 involving a<\/p>\n<p>cheque for Rs.9,011\/-.\n<\/p>\n<p id=\"p_1\">     2. Heard both sides. No doubt, there has been some<\/p>\n<p>latches on the part of the appellant in not appearing before<\/p>\n<p>the court below.    But, that certainly did not deserve an<\/p>\n<p>acquittal of the accused otherwise than on merits.<\/p>\n<p>Accordingly, the impugned order is set aside and the matter<\/p>\n<p>is remitted to the court below for disposal afresh.<\/p>\n<p>Crl.Appeal No.147 of 2007<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                2<\/span><\/p>\n<p>S.T.No.432 of 2003 of Chief Judicial Magistrate Court,<\/p>\n<p>Kollam renumbered as S.T.No.44 of 2006 on the file of<\/p>\n<p>J.F.C.M-III, Kollam shall stand restored to file and shall be<\/p>\n<p>disposed of in accordance with law after giving both sides<\/p>\n<p>an opportunity of being heard.
