Justice S.S.SATHEESACHANDRAN\n\n Dated :22\/10\/2009\n\n O R D E R\n                     S.S.SATHEESACHANDRAN, J.\n                     -----------------------------------\n                      W.P.(C).No.557 of 2009 - N\n                      ---------------------------------\n              Dated this the 22nd day of October, 2009\n\n                             J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     The writ petition is filed seeking the following reliefs:<\/p>\n<p id=\"p_1\">              &#8220;i)   To call for the records, which may leads to<\/p>\n<p>       the passing of Ext.P3 order and quash the same as<\/p>\n<p>       illegal, arbitrary nd one passed without any application<\/p>\n<p>       of mind.\n<\/p>\n<p id=\"p_2\">              ii)   To issue a writ of mandamus or other<\/p>\n<p>       appropriate writ direction or order commanding the 1st<\/p>\n<p>       Additional Sub Court, Thiruvananthapuram to reconsider<\/p>\n<p>       I.A.No.6759\/2008 and pass orders in the same in its<\/p>\n<p>       merits after giving a posting to the said I.A. before court<\/p>\n<p>       and after affording the petitioner an opportunity to<\/p>\n<p>       present his case.\n<\/p>\n<p id=\"p_3\">              iii)  To issue a writ of mandamus or other<\/p>\n<p>       appropriate writ direction or order commanding the 1st<\/p>\n<p>       Additional Sub Court, Thiruvananthapuram to reconsider<\/p>\n<p>       I.A.No.6640\/2008 and pass orders on the same after<\/p>\n<p>       taking note that the petitioner has every right to adduce<\/p>\n<p>       evidence through his witness and the witness was<\/p>\n<p>       discharged by the trial court holding that he is a<\/p>\n<p>       stranger to the agreement.&#8221;\n<\/p>\n<p id=\"p_4\">     2.     Petitioner is the defendant in O.S.No. 338 of 2001 on<\/p>\n<p>the file of the First Additional Sub Court, Thiruvananthapuram.<\/p>\n<p>W.P.(C).No.557 of 2009 &#8211; N<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                 2<\/span><\/p>\n<p>Suit is one for money and the respondents are the plaintiffs.<\/p>\n<p>Challenge in the writ petition is against Ext.P3 order passed by<\/p>\n<p>the learned Sub Judge declining the request made by the<\/p>\n<p>petitioner in two applications, one for staying the trial of the suit<\/p>\n<p>till completion of the proceedings before the Consumer Disputes<\/p>\n<p>Redressal Forum, Kollam, and the other application for reviewing<\/p>\n<p>the order passed by the court for closing the evidence in the<\/p>\n<p>case.    Both the applications moved by the defendant were<\/p>\n<p>dismissed vide Ext.P3 order. Propriety and correctness of Ext.P3<\/p>\n<p>order is challenged in the writ petition invoking the supervisory<\/p>\n<p>jurisdiction vested with this Court under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the<\/p>\n<p>Constitution of India.\n<\/p>\n<p id=\"p_5\">      3.   I heard the counsel for the petitioner.     Though the<\/p>\n<p>respondent has entered appearance none turned up to argue on<\/p>\n<p>behalf of the respondents.\n<\/p>\n<p id=\"p_6\">      4.   I heard the counsel for the petitioner.\n<\/p>\n<p id=\"p_7\">      5.   Counsel for the petitioner submitted that the suit was<\/p>\n<p>previously dismissed for default. But later, restored subject to<\/p>\n<p>payment of cost of Rs.25,000\/-. When the case was posted for<\/p>\n<p>remitting the cost ordered there was a change in the presiding<\/p>\n<p>W.P.(C).No.557 of 2009 &#8211; N<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                  3<\/span><\/p>\n<p>officer of the court and without giving respect to the earlier order<\/p>\n<p>the successor officer proceeded with the trial of the case. Till<\/p>\n<p>date the cost ordered for restoring the suit has not been paid by<\/p>\n<p>the respondents\/plaintiffs is the submission of the counsel. After<\/p>\n<p>closing of the evidence of the plaintiffs and their witness an agent<\/p>\n<p>of the defendant was presented for examination as his witness.<\/p>\n<p>The court below declined to examine that witness holding that<\/p>\n<p>the defendant who has not personally appeared cannot give<\/p>\n<p>evidence in the case.       The evidence of the defendant was<\/p>\n<p>thereupon closed, is the submission of the counsel. To review<\/p>\n<p>that order, an application was moved later. While that review<\/p>\n<p>petition was pending consideration another application was also<\/p>\n<p>moved in view of the decision rendered by the State Consumer<\/p>\n<p>Forum in an appeal over the very same disputes covered by the<\/p>\n<p>suit, for staying the trial of the suit till a decision is rendered by<\/p>\n<p>the Consumer Redressal Forum to which the State commission<\/p>\n<p>has remitted the matter for fresh consideration. The court below<\/p>\n<p>ignoring the facts and circumstances involved passed Ext.P3<\/p>\n<p>order dismissing both petitions, according to the counsel.<\/p>\n<p>Perusing Ext.P3 order passed by the court below, it is seen, that<\/p>\n<p>W.P.(C).No.557 of 2009 &#8211; N<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                  4<\/span><\/p>\n<p>once the court declined examination of the witness produced by<\/p>\n<p>the defendant, the learned counsel appearing for the defendant<\/p>\n<p>had represented that the evidence could be closed as there was<\/p>\n<p>no further evidence for the defendant. So much so, what is given<\/p>\n<p>expression to in the order of the court, as to what had transpired<\/p>\n<p>in the trial before court, cannot be canvassed before this Court as<\/p>\n<p>not correct.    If it was incorrect petitioner should have filed a<\/p>\n<p>review before the court concerned. However, having regard to<\/p>\n<p>the submissions made by the counsel with reference to what is<\/p>\n<p>stated in Ext.P3 order, I find the refusal of the court to examine<\/p>\n<p>the witness produced by the defendant for the reason that he has<\/p>\n<p>not personally appeared to give evidence cannot be approved. It<\/p>\n<p>is also brought to my notice that the witness produced was<\/p>\n<p>named in the witness schedule filed by the defendant. Naturally,<\/p>\n<p>an opportunity should have been extended to the defendant to<\/p>\n<p>examine his witness. The defendant did not mount the box and<\/p>\n<p>gave evidence in support of his contentions cannot be taken as a<\/p>\n<p>ground to deny opportunity to him to examine any other witness<\/p>\n<p>in the case. So much so, the order passed by the court below for<\/p>\n<p>closing the evidence and, later, rejecting the review petition<\/p>\n<p>W.P.(C).No.557 of 2009 &#8211; N<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                  5<\/span><\/p>\n<p>moved by the defendant cannot be sustained. However, I do not<\/p>\n<p>find any impropriety in the order passed by the court below in<\/p>\n<p>declining to stay the trial of the suit pending disposal of the<\/p>\n<p>proceedings before the Consumer Disputes Redressal Forum. So<\/p>\n<p>much so, Ext.P3 order is liable to be interfered only in respect of<\/p>\n<p>the closing of the evidence without giving opportunity to the<\/p>\n<p>defendant to lead evidence, and it is ordered accordingly.
