Pawar, learned counsel appearing for the applicant<br \/>\n\tand Ms.D.S. Pandit, learned Additional Public Prosecutor, appearing<br \/>\n\ton behalf of the opponent-State.\n<\/p>\n<p id=\"p_1\">Rule.\n<\/p>\n<p id=\"p_2\">\tThe formal service of notice of Rule is waived by Ms.D.S. Pandit,<br \/>\n\tlearned Additional Public Prosecutor, on behalf of the<br \/>\n\topponent-State.\n<\/p>\n<p id=\"p_3\">Apparently,<br \/>\n\tthis is a case of gross delay of 833 days in preferring appeal by<br \/>\n\tthe applicant. Normally in a case of gross delay which cannot be<br \/>\n\tsaid to be very satisfactorily explained by the applicant, the Court<br \/>\n\tshould not condone the delay for the sake of condoning it. But it is<br \/>\n\talso true that the approach of the Court in such cases should be<br \/>\n\tliberal and pragmatic. However, the backbone of the argument of Shri<br \/>\n\tPawar is that this Court while dealing with the point of delay<br \/>\n\tshould also consider the strength in the case of the applicant. It<br \/>\n\tis rightly submitted by Shri Pawar, learned counsel appearing for<br \/>\n\tthe applicant, that if prima facie the case of the applicant is not<br \/>\n\targuable at all and has very remote chances of success, then the<br \/>\n\tCourt should not condone the delay for the sake of condoning it even<br \/>\n\tif the delay period is of much less than the delay caused in the<br \/>\n\tpresent case.\n<\/p>\n<p id=\"p_4\">This<br \/>\n\tis a case of delay of 833 days in preferring appeal against the<br \/>\n\tjudgment and order of conviction and sentence by the applicant. This<br \/>\n\tapplication has been received through Jail Authorities. It is<br \/>\n\tcontended by the applicant that as he was not aware that he can also<br \/>\n\tget legal aid if he intends to prefer appeal, he could not prefer<br \/>\n\tappeal well in time.  The Court has considered the nature of offence<br \/>\n\twhich has been found proved by the learned trial Judge and the total<br \/>\n\tperiod of imprisonment imposed by the learned trial Judge. On plain<br \/>\n\treading of the judgment and order of conviction and sentence and<br \/>\n\twithout entering into the nature of evidence led during the course<br \/>\n\tof trial, it is possible to reach to a prima facie conclusion that<br \/>\n\tthe applicant has comparatively a good arguable case and, therefore,<br \/>\n\this appeal should not be thrown out only on the ground of delay.\n<\/p>\n<p id=\"p_5\">Though<br \/>\n\tthere is strong resistance from Ms.D.S. Pandit, learned Additional<br \/>\n\tPublic Prosecutor, and it is submitted that the applicant is the<br \/>\n\tperson responsible who had put the victim girl into a precarious<br \/>\n\tcondition and the delay should not be condoned on the ground of<br \/>\n\tliberal approach and the Court should not be too liberal in dealing<br \/>\n\twith such applications.\n<\/p>\n<p id=\"p_6\">The<br \/>\n\tCourt is of the view that this is not a case of showing any leniency<br \/>\n\tto the applicant, but the Court is inclined to offer an opportunity<br \/>\n\tto the applicant so that he can convince the Court that there is<br \/>\n\tsome strength in his case which has been placed before the Court by<br \/>\n\tway of the appeal. The person in prison is under some legal<br \/>\n\timpediment and basically when the applicant belongs to some other<br \/>\n\tState, he may have passed through a confused state of mind<br \/>\n\tconsidering the allegations which were made against him by the<br \/>\n\tprosecution.\n<\/p>\n<p id=\"p_7\">So<br \/>\n\taccepting the submissions made by Shri Chirag Pawar, learned counsel<br \/>\n\tappearing for the applicant, the present application is hereby<br \/>\n\tallowed.  The delay of 833 days in filing the appeal is hereby<br \/>\n\tcondoned as prayed for. Rule is made absolute.\n<\/p>\n<p id=\"p_8\">It<br \/>\n\tis submitted by Shri Chirag Pawar that this Court should take up the<br \/>\n\tadmission hearing of the appeal today itself and as Ms.D.S.
