Noor Alam Mian, Son of Adalat Mian, R\/o-Vill.-Pipra, P.S.-Darpa, District-\n              East Champaran.                                          -Petitioners.\n                                      VERSUS\n              The State of Bihar                                      -Opposite Party.\n                                      -----------\n<\/pre>\n<p id=\"p_1\">02   14.03.2011                        In both these cases the petitioners are in custody in<\/p>\n<p>                       relation to Chiraiya P.S. Case No.132 of 2010 instituted under various<\/p>\n<p>                       sections<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of the Indian Penal Code<\/a>, read with <a href=\"\/doc\/1934415\/\" id=\"a_1\">Arms Act<\/a>, Explosive<\/p>\n<p>                       Substance Act and <a href=\"\/doc\/258943\/\" id=\"a_2\">Criminal Law Amendment Act<\/a>, 1908.<\/p>\n<p id=\"p_1\">                                       I have perused the order as passed by the 1st Additional<\/p>\n<p>                       Sessions Judge, East Champaran, Motihari by which their bail<\/p>\n<p>                       applications have been rejected. I cannot restrain myself but observe<\/p>\n<p>                       that the said order is an apology for an order. An order rejecting bail<\/p>\n<p>                       is nevertheless a judicial order passed by a Judicial Officer in his<\/p>\n<p>                       judicial capacity. Unfortunately, the order reflects as if it has been<\/p>\n<p>                       passed in a casual manner by an Officer not trained in judicial matters<\/p>\n<p>                       and it totally lacks judicial temperament. There is absolutely non-<\/p>\n<p>                       application of mind.      The order only says that witnesses have<\/p>\n<p>                       supported the incident and the case diary shows involvement of the<\/p>\n<p>                       petitioners and chargesheets have been submitted.         The Judicial<\/p>\n<p>                       Officer and, that too, of the rank of Additional Sessions Judge should<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  -2-<\/span><\/p>\n<p>           keep in mind that these orders are subject to judicial review by the<\/p>\n<p>           High Court. They are supposed to apply their mind and disclose as to<\/p>\n<p>           what is the material as against the petitioner, which persuades the<\/p>\n<p>           Court not to grant bail. It cannot throw its responsibility on the High<\/p>\n<p>           Court to call of all the records and reexamine the thing. When all the<\/p>\n<p>           records were available to him that only shows that the Officers though<\/p>\n<p>           writes three pages order is shirking his responsibility, either he lacks<\/p>\n<p>           the courage for conviction or refuses to apply his mind judicially.<\/p>\n<p>           There must be cogent reasons recorded which can be examined by the<\/p>\n<p>           High Court from the order sheet itself.\n<\/p>\n<p id=\"p_2\">                          In such view of the matter, I am left with no option but<\/p>\n<p>           to remit the matter back to the learned Judge for reconsideration in<\/p>\n<p>           proper perspective without shirking his responsibility and showing his<\/p>\n<p>           incompetence in the matter. The learned Judge would be well advised<\/p>\n<p>           to reconsider the matter and pass fresh orders within two weeks of<\/p>\n<p>           filing of fresh application before him.\n<\/p>\n<p id=\"p_3\">                          Let the order be communicated by FAX to the learned<\/p>\n<p>           Judge at the cost of the petitioners.\n<\/p>\n<p id=\"p_4\">                          Let the order also be sent to the Bihar Judicial<\/p>\n<p>           Academy so that they may consider teaching the Judicial Officers<\/p>\n<p>           about the right approach in writing such orders.\n<\/p>\n<p id=\"p_5\">                          Both the applications are, accordingly, disposed of.<\/p>\n<pre id=\"pre_1\">Trivedi\/                         (Navaniti Prasad Singh, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Nek Moihammed And Anr. vs The State Of Bihar on 14 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
