When he reached<br \/>\n\thome his wife Khemiben and his sister-in-law (Bhabhi) Jadiben<br \/>\n\tstarted crying informing him that their pat dog is at the house of<br \/>\n\tthe opponent ?  accused No.1. On demanding pat dog from accused<br \/>\n\tNo.1, he replied that they would not get the bitch. The accused<br \/>\n\tabused and threatened to burn them. The incident took place on<br \/>\n\t22.3.2000 in the evening. On 23.3.2000 at about 9 O&#8217;clock in the<br \/>\n\tnight they went to his house and rebuked the opponents ?  accused.<br \/>\n\tAt that time the opponents ?  accused came with sticks and<br \/>\n\tthreatened the complainant to kill him and they insulted him by<br \/>\n\tcaste.\n<\/p>\n<p id=\"p_2\">On<br \/>\n\tregistration of complaint the investigation was moved. During the<br \/>\n\tcourse of investigation Panchnama of scene of offfence, panchnama of<br \/>\n\tmuddamal Articles, were drawn, statement of witnesses were recorded.\n<\/p>\n<p id=\"p_3\">At<br \/>\n\tthe end of the investigation, as sufficient incriminating evidence<br \/>\n\twas found against the accused for the commission of offence, the<br \/>\n\taccused was charge- sheeted in the Court of learned JMFC. As the<br \/>\n\toffence under Section 3(1)(10) of the Atrocities Act is exclusively<br \/>\n\ttriable by the Court of Sessions, the learned JMFC committed the<br \/>\n\tcase to the Court of Sessions.\n<\/p>\n<p id=\"p_4\">The<br \/>\n\tlearned Additional Sessions Judge, 9th Fast Track Court,<br \/>\n\tPalanpur (for short ?Sthe trial Court??) framed charge against the<br \/>\n\taccused. The accused pleaded not guilty to the charge and claimed to<br \/>\n\tbe tried. Therefore, he was put to trial and tried.\n<\/p>\n<p id=\"p_5\">To<br \/>\n\tprove the culpability of the accused, the prosecution has examined<br \/>\n\tthe witnesses i.e. Complainant, other eye witnesses, panch<br \/>\n\twitnesses, and the Investigating Officer. The prosecution has also<br \/>\n\tproduced number of documents to prove its case against the accused.\n<\/p>\n<p id=\"p_6\">After<br \/>\n\trecording the evidence of the prosecution witnesses was over, the<br \/>\n\tlearned trial Judge explained to the accused the circumstances<br \/>\n\tappearing against him in the evidence of the prosecution witnesses<br \/>\n\tand recorded the further statement under <a href=\"\/doc\/140515\/\" id=\"a_7\">Section 313<\/a> of the Code. In<br \/>\n\ttheir further statement the accused denied the prosecution case in<br \/>\n\ttoto. However, they did not produce any evidence nor examined any<br \/>\n\twitness to support their defence.\n<\/p>\n<p id=\"p_7\">On<br \/>\n\tappreciation, evaluation, analysis and scrutiny of the evidence on<br \/>\n\trecord the learned trial Judge held that the prosecution has failed<br \/>\n\tto prove the charge levelled against the accused and acquitted the<br \/>\n\taccused of the offence with which they were was charged. Against the<br \/>\n\tsaid Judgment and order of acquittal the State of Gujarat has filed<br \/>\n\tthis present Appeal.\n<\/p>\n<p id=\"p_8\">We<br \/>\n\thave considered the submissions advanced by Mr. K.C.Shah, learned<br \/>\n\tAPP for the applicant ?  appellant ?  State. We have also perused<br \/>\n\tthe impugned Judgment and Order. We have also undertaken a complete<br \/>\n\tand comprehensive appreciation of all vital features of the case and<br \/>\n\tthe entire evidence on record which have been referred to by the<br \/>\n\tlearned trial Judge in his Judgment with reference to broad and<br \/>\n\treasonable probabilities of the case. We have also perused the<br \/>\n\tRecords &amp; proceeding which have been called for from the trial<br \/>\n\tCourt.\n<\/p>\n<p id=\"p_9\">On<br \/>\n\tthread bare examination of the evidence of the prosecution witnesses<br \/>\n\tand on re-appreciation of evidence, oral as well as documentary, it<br \/>\n\tis seen that there was dispute with regard to pat dog. All the<br \/>\n\twitnesses are family members and no independent witnesses have been<br \/>\n\texamined. In cross examination of the complainant it is seen that<br \/>\n\tthe accused have dragged the complainant upto the out-skirt of<br \/>\n\tvillage. If that be so then the village people must have seen this<br \/>\n\tincident. But, the statement of no independent witnesses have been<br \/>\n\trecord nor they are examined.\n<\/p>\n<p id=\"p_10\">In<br \/>\n\tview of the unsatisfactory evidence led by the prosecution,<br \/>\n\taccording to us, the findings recorded by the learned trial judge<br \/>\n\tare absolutely just and proper and no illegality is committed by the<br \/>\n\tlearned trial Judge in acquitting the accused of the offence with<br \/>\n\twhich they were charged as well as we are in complete agreement with<br \/>\n\tthe findings, ultimate conclusion and resultant order of acquittal<br \/>\n\trecorded by the learned trial Judge, as, in our view, no other<br \/>\n\tconclusion is possible except the one reached by the learned trial<br \/>\n\tJudge.\n<\/p>\n<p id=\"p_11\">This<br \/>\n\tis an acquittal appeal. The principles which would govern and<br \/>\n\tregulate the hearing of appeal by the High Court against an order of<br \/>\n\tacquittal passed by the Trial Court have been very succinctly<br \/>\n\texplained by the Supreme Court in the matter of  AJIT SAVANT<br \/>\n\tMAJAGAVI VS. STATE OF KARNATAKA, reported in AIR 1997 SC<br \/>\n\t3255.\n<\/p>\n<p id=\"p_12\">(a)<br \/>\nIn an appeal against an order of acquittal, the High Court possesses<br \/>\nall the powers, and nothing less than the powers it possesses while<br \/>\nhearing an appeal against an order of conviction.\n<\/p>\n<p id=\"p_13\">(b)<br \/>\nThe High Court has the power to reconsider the whole issue,<br \/>\nreappraise the evidence and come to its own conclusion and findings<br \/>\nin place of the findings recorded by trial court, if the said<br \/>\nfindings are against the weight of the evidence on record, or in<br \/>\nother words, perverse.\n<\/p>\n<p id=\"p_14\">(c<br \/>\n)\tBefore reversing the finding of acquittal, the High Court has to<br \/>\nconsider each ground on which the order of acquittal was based and to<br \/>\nrecord its own reasons for not accepting those grounds not<br \/>\nsubscribing to the view expressed by the trial Court that the accused<br \/>\nis entitled to acquittal.\n<\/p>\n<p id=\"p_15\">(d)\tIn<br \/>\nreversing the finding of acquittal, the High Court has to keep in<br \/>\nview the fact that the presumption of innocence is still available in<br \/>\nfavour of the accused and the same stands fortified and strengthened<br \/>\nby the order of acquittal passed in his favour by the trial Court.\n<\/p>\n<p id=\"p_16\">(e)<br \/>\nIf the High Court, on a fresh scrutiny and reappraisal of the<br \/>\nevidence and other material on record, is of the opinion that there<br \/>\nis another view which can be reasonably taken, then the view which<br \/>\nfavours the accused should be adopted.\n<\/p>\n<p id=\"p_17\">(f)<br \/>\nThe High Court has also to keep in mind that the trial Court had the<br \/>\nadvantage of looking at the demeanour of witnesses and observing<br \/>\ntheir conduct in the Court, especially in the witness box.\n<\/p>\n<p id=\"p_18\">(g)<br \/>\nThe High Court has also to keep in mind that even at that stage, the<br \/>\naccused was entitled to benefit of doubt. The doubt should be such as<br \/>\na reasonable person would honestly and conscientiously entertain as<br \/>\nto the guilt of the accused.\n<\/p>\n<p id=\"p_19\">In<br \/>\n\tcase of  <a href=\"\/doc\/1258127\/\" id=\"a_8\">ANOKH SINGH vs. STATE OF PUNJAB<\/a>, reported in<br \/>\n\tAIR 1992 SC p.598, the Hon&#8217;ble Supreme Court has held that in<br \/>\n\tan appeal against acquittal, the High Court should attach greater<br \/>\n\tweight to appreciation of evidence by the trial Judge who had the<br \/>\n\toccasion to watch the demeanour of the witnesses.\n<\/p>\n<p id=\"p_20\">It<br \/>\n\tis a cardinal principle of criminal jurisprudence that in an<br \/>\n\tacquittal appeal if other view is  possible then also appellate<br \/>\n\tCourt cannot substitute its own view by reversing the acquittal into<br \/>\n\t conviction, unless the  findings  of  the trial Court are perverse,<br \/>\n\tcontrary to  the  material on  record, palpably wrong,  manifestly<br \/>\n\terroneous or demonstrably unsustainable.  (<a href=\"\/doc\/31041\/\" id=\"a_9\">See    Ramesh Babulal<br \/>\n\tDoshi  V. State of Gujarat<\/a> (1996) 9 SCC 225).  In the instant<br \/>\n\tcase, the learned APP has not been able to  point out to us as to<br \/>\n\thow the findings recorded by the learned trial Judge are perverse,<br \/>\n\tcontrary to material on record, palpably wrong, manifestly erroneous<br \/>\n\t or demonstrably unsustainable.\n<\/p>\n<p id=\"p_21\">On<br \/>\n\toverall appreciation of evidence,  this Court is satisfied  that<br \/>\n\tthere is no infirmity in the reasons assigned  by the learned trial<br \/>\n\tJudge  for acquitting the accused.   Suffice it to say that the<br \/>\n\tlearned trial Judge has given cogent and convincing  reasons  for<br \/>\n\tacquitting the accused and the learned A.P.P. has failed to dislodge<br \/>\n\tthe reasons given by the learned trial Judge and  convince  this<br \/>\n\tCourt to take  a  view contrary to the one taken by the learned<br \/>\n\ttrial Judge.\n<\/p>\n<p id=\"p_22\">Seen<br \/>\n\t in  the  above  context, we do not find any valid and cogent reason<br \/>\n\tor justifiable ground to interfere with the impugned  judgment<br \/>\n\tand order acquitting the accused of the offence with which they were<br \/>\n\tcharged.\n<\/p>\n<p id=\"p_23\">For<br \/>\n\tthe forgoing reasons, Leave to Appeal is refused and Accordingly<br \/>\n\tthis Appeal is dismissed in limine.\n<\/p>\n<p id=\"p_24\">(A.M.KAPADIA,J.)<\/p>\n<p>(Z.K.SAIYED,<br \/>\n J.)<\/p>\n<p>sas<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court The vs Fast Track Court on 11 August, 2008 Author: A.M.Kapadia,&amp;Nbsp;Honourable Mr.Justice Z.K.Saiyed,&amp;Nbsp;
