(ORAL)\n<\/pre>\n<p id=\"p_1\">            On January 6, 2009, this Court had passed the following order:\n<\/p>\n<p id=\"p_1\">            &#8220;This is a strange case. Present petition was filed by<br \/>\n      Harpal Singh and Manpreet Kaur. They have filed a petition<br \/>\n      seeking that a seven days notice be given in case petitioner<br \/>\n      Harpal Singh is sought to be arrested in any criminal case.\n<\/p>\n<p id=\"p_2\">            Mr. Sukhija appearing for the parents of Manpreet Kaur,<br \/>\n      submitted that Harpal Singh is already married and has<br \/>\n      induced Manpreet Kaur. He has further submitted that<br \/>\n      Manpreet Kaur is minor. According to Mr.Sukhija, Manpreet<br \/>\n      Kaur, due to inducement of Harpal Singh, has been taken<br \/>\n      away from the custody of her parents and thus offence under<br \/>\n      <a href=\"\/doc\/619940\/\" id=\"a_1\">Section 363<\/a>, <a href=\"\/doc\/796352\/\" id=\"a_1\">366<\/a> IPC has been committed by Harpal Singh<br \/>\n      and case FIR No. 137 dated 25.12.2008 has been registered<br \/>\n      at Police Station Sudhar, District Ludhiana Rural.\n<\/p>\n<p id=\"p_3\">            Mr.Liaqat Ali appearing for Harpal Singh and Manpreet<br \/>\n      Kaur has stoutly controverted the submissions made by Mr.<br \/>\n      Sukhija. He has stated that Manpreet Kaur has categorically<br \/>\n      stated that her father Bhagwan Singh had an evil eye upon<br \/>\n      her and had made various attempts to sexually molest her.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\"> Criminal Misc. No. M-34618 of 2008                                        2<\/span><\/p>\n<p id=\"p_4\">      Therefore, Manpreet Kaur has left the house of Bhagwan<br \/>\n      Singh at her own violation. A Coordinate Bench of this Court,<br \/>\n      on 31st December, 2008, had passed the following order:\n<\/p>\n<pre id=\"pre_1\">             'Present:    Liqat Ali, Advocate\n                          for the petitioner.\n                   The     petitioner   No.2    has   leveled   serious\n<\/pre>\n<p id=\"p_5\">             allegations against her parents- respondent No.5 and 6<br \/>\n             without going into the veracity of the same and deemed<br \/>\n             it appropriate. Let the petitioner No.2 who is present in<br \/>\n             Court be kept in custody of Nari Niketan, Chandigarh.<br \/>\n             Since the apprehensions of the petitioner No.1 were<br \/>\n             only with regard to association with the petitioner No.2,<br \/>\n             now the said apprehensions would not arise because<br \/>\n             the petitioner No.2 is with the custody of the Court.\n<\/p>\n<p id=\"p_6\">                   Notice to the respondents No.5 &amp; 6 for 6.1.2009.<br \/>\n                   Let the respondents No.5 &amp; 6 be served dasti.&#8217;<\/p>\n<p>             In pursuance of the same, Manpreet Kaur is present in<br \/>\n      the Court. She has reiterated the allegations leveled by her in<br \/>\n      her petition. Members of panchayat are also present in the<br \/>\n      Court, namely Mr.Harjit Singh member panchayat; Labh Singh<br \/>\n      member panchayat and Atar Singh member panchayat. They<br \/>\n      have shown their helplessness and are unable to verify the<br \/>\n      allegations and vouchsafe the interest of Manpreet Kaur.\n<\/p>\n<p id=\"p_7\">             Respondent No.6, Gurmeet Kaur, mother of Manpreet<br \/>\n      Kaur is also present in Court. She has stated that whatever<br \/>\n      has been stated by Manpreet Kaur has been stated under the<br \/>\n      influence of Harpal Singh. She has stated that she is ready<br \/>\n      and willing to leave her husband Bhagwan Singh and other<br \/>\n      children and she may be allowed to live along with Manpreet<br \/>\n      Kaur in Nari Niketan, so that she is away from the influence of<br \/>\n      Harpal Singh.\n<\/p>\n<p id=\"p_8\">             I have heard counsel for the parties. I am of the view<br \/>\n      that Manpreet Kaur is of impressionable age and she is not<br \/>\n      mature enough to understand the gravity of the allegations<br \/>\n      leveled. There is equally a chance that she may have been led<br \/>\n      astray by Harpal Singh. Therefore to vouchsafe her interest, it<br \/>\n      is in her betterment that she stays at Nari Niketan,<br \/>\n      Chandigarh. Gurmeet Kaur, mother of Manpreet Kaur is also<br \/>\n      allowed to stay at Nari Niketan. Both shall remain in the Nari<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Criminal Misc. No. M-34618 of 2008                                          3<\/span><\/p>\n<p>      Niketan, Chandigarh for one week. Nobody shall be permitted<br \/>\n      to meet them and they shall not leave the Nari Niketan,<br \/>\n      Chandigarh.\n<\/p>\n<p id=\"p_9\">              Case to come up for further hearing on 14th January,<br \/>\n      2009.\n<\/p>\n<p id=\"p_10\">              Copy of this order, under the signatures of the Court<br \/>\n      Secretary, be given to the Counsel for the State for<br \/>\n      compliance and staff of Nari Niketan.&#8221;\n<\/p>\n<p id=\"p_11\">              Today Manpreet Kaur and her mother Gurmeet Kaur are<\/p>\n<p>present in Court, along with Harjit Singh ex-member Panchayat. Gurmeet<\/p>\n<p>Kaur mother has stated that she has resided with her daughter in Nari<\/p>\n<p>Niketan for one week. She agree that her daughter Manpreet Kaur should<\/p>\n<p>be allowed to live separately.\n<\/p>\n<p id=\"p_12\">              Age of Manpreet Kaur is 17 years and 2 months. Till she<\/p>\n<p>becomes 18 years old, she is to be taken in the care of Guardian. Mother<\/p>\n<p>Gurmeet Kaur has stated that her sister Manjeet Kaur be appointed as<\/p>\n<p>Guardian of Manpreet Kaur. She further undertakes that father of Manpreet<\/p>\n<p>Kaur will not visit her. Manjeet Kaur, maternal aunt, is also present in Court.\n<\/p>\n<p id=\"p_13\">She is ready and willing to take care and custody of Manpreet Kaur.\n<\/p>\n<p id=\"p_14\">              Accordingly, Manjeet Kaur is appointed Guardian of Manpreet<\/p>\n<p>Kaur till Manpreet Kaur attains the age of 18 years. As stated by Manpreet<\/p>\n<p>Kaur, she will reside with Manjeet Kaur. Accordingly, custody of Manpreet<\/p>\n<p>Kaur is given to her maternal aunt, Manjeet Kaur with the consent of her<\/p>\n<p>parents and members of Panchayat, who are present in Court.
