NO. 37381 OF 2004\n\n                  ---------------------------------------\n\n                 Dated this the 6th day of June, 2007.\n\n\n                              J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The   subject   matter   of   both   writ   petitions   pertains   to   the<\/p>\n<p>alleged pollution caused by the writ petitioner in the former writ<\/p>\n<p>petition in running a saw mill.   The said writ petitioner has been<\/p>\n<p>running the saw mill for the last more than two decades.   There<\/p>\n<p>is serious dispute on that by the writ petitioner in the latter writ<\/p>\n<p>petition.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      2.  Be that as it may, it is seen that the Appellate Authority<\/p>\n<p>has   passed     Exhibit   P8   judgment   setting   aside   the   order   dated<\/p>\n<p>11.03.2004   passed   by   the   Pollution   Control   Board   refusing<\/p>\n<p>consent to operate the saw mill and has remitted the matter for<\/p>\n<p>fresh consideration.  After having extensively heard the parties, I<\/p>\n<p>am   of   the   view   that   the   interest   of   all   the   parties   can   be<\/p>\n<p>safeguarded,   if   the   Pollution   Control   Board   is   directed   to   pass<\/p>\n<p>fresh orders pursuant to Exhibit P8 in W.P.(C). No. 37381\/2004<\/p>\n<p>with   notice   to   all   the   parties,   untramelled   by   the   observations<\/p>\n<p>therein.  Accordingly, these writ petitions are disposed of with the<\/p>\n<p>following directions.\n<\/p>\n<p id=\"p_3\">\nW.P.(C). NOs. 37175\/03 &amp; 37381\/04       2<\/p>\n<p id=\"p_4\">               1)     There    will   be   a  direction to the Kerala State<\/p>\n<p>                      Pollution   Control   Board  to  consider the issue<\/p>\n<p>                      afresh   and   pass   orders,  untramelled by the<\/p>\n<p>                      observation in Ext. P8 in   W.P.(C).No.37381\/04,<\/p>\n<p>                      with    notice    to    the     parties   to     the     writ<\/p>\n<p>                      petitions  including    the  Grama Panchayath.<\/p>\n<p id=\"p_5\">               2)     There   will  also   be  a direction to a  competent<\/p>\n<p>                      officer  under   the Pollution Control   Board   to<\/p>\n<p>                      conduct   a   site   inspection  with notice to both<\/p>\n<p>                      the  writ petitioners and  the Grama Panchayath<\/p>\n<p>                      before passing  orders as  above.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">               3)     Depending   on   the   order  thus  passed  by the<\/p>\n<p>                      Kerala  State   Pollution   Control    Board,    the<\/p>\n<p>                      required orders will   be   passed   by the Grama<\/p>\n<p>                      Panchayath.\n<\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">               4)     The  writ  petitioner in W.P.(C). No. 37381\/2004<\/p>\n<p>                      will   also   be    afforded  sufficient   opportunity<\/p>\n<p>                      while   considering   the    application   by     the<\/p>\n<p>                      Panchayath   for  the   renewal  of licence,  if   it<\/p>\n<p>                      requires   such  consideration based on the order<\/p>\n<p>                      by the Pollution Control Board.\n<\/p>\n<p id=\"p_10\">\n<p id=\"p_11\">               5)     The   orders    as    above   shall   be  passed  by<\/p>\n<p>                      the   Pollution   Control   Board   within  a  period<\/p>\n<p>                      of   four   months   from   the   date  of receipt of<\/p>\n<p>                      a copy of this judgment.  Consequential   orders,<\/p>\n<p>W.P.(C). NOs. 37175\/03 &amp; 37381\/04       3<\/p>\n<p>                      if      required,  will    be    passed  by the Grama<\/p>\n<p>                      Panchayath   within  a period    of   another  two<\/p>\n<p>                      months.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">               6)     It   is   made   clear   that   in  case the petitioner<\/p>\n<p>                      in W.P.(C). No. 37175\/2003   provides   for  the<\/p>\n<p>                      remedial measures for abatement of  pollution   as<\/p>\n<p>                      directed  by the Pollution Control Board, renewal<\/p>\n<p>                      shall  not  be  refused  since the refusal to renew<\/p>\n<p>                      the   licence   is   only   on   the   ground of non-<\/p>\n<p>                      compliance  of    the    directions   issued  by the<\/p>\n<p>                      Pollution  Control      Board.    Until   orders  are<\/p>\n<p>                      passed   as   above   by   the   Pollution  Control<\/p>\n<p>                      Board    and     Grama Panchayath, interim  order<\/p>\n<p>                      passed by this Court in W.P.(C).No.  37175\/2003<\/p>\n<p>                      will   continue.    The functioning of the saw mill<\/p>\n<p>                      shall   not    be    disturbed  since it is said to   be<\/p>\n<p>                      functioning   as per  the directions issued by  this<\/p>\n<p>                      Court in W.P.(C).
