And Others\nPetitioner   Counsel :- Suneet Kumar\nRespondent   Counsel :- C.S.C.\n\nHon'ble Devendra Pratap Singh,J.\n<\/pre>\n<p id=\"p_1\">Heard learned counsel for the petitioner and the<br \/>\nlearned Standing counsel.\n<\/p>\n<p id=\"p_1\">Despite time being granted on 26.5.2005 to the<br \/>\nlearned Standing counsel to file counter affidavit,<br \/>\nno counter affidavit has been filed till date even<br \/>\nthough more than five years have expired and as such<br \/>\nfurther prayer for grant of time is rejected.\n<\/p>\n<p id=\"p_2\">The counsel for the petitioner has made a statement<br \/>\nthat he does not want to press this petition as<br \/>\nagainst respondent no. 5 and accordingly, his name<br \/>\nis deleted from the array of parties.\n<\/p>\n<p id=\"p_3\">It appears that D.A.V. Inter College, Muzaffar Nagar<br \/>\nis a duly recognized and aided institution wherein<br \/>\non the strength of the students 57 posts of Teacher<br \/>\nincluding the Principal was sanctioned along with 6<br \/>\nposts of clerk and 23 class IV employees. Nine<br \/>\nvacancies occurred on class IV posts and after<br \/>\ntaking prior approval of the District Inspector of<br \/>\nSchools, the same were advertised in two daily<br \/>\nnewspapers. However, a local M.P. wrote a letter to<br \/>\nthe District Inspector of Schools on 5.12.2004<br \/>\nrecommending name of one Parvesh Kumar to be<br \/>\nappointed on one said post. This was followed by<br \/>\nseveral other letters but the selection committee<br \/>\ndid not select the recommendees of the local M.P. as<br \/>\nthey were not found fit and after making due<br \/>\nselection, the papers were transmitted to the<br \/>\nDistrict Inspector of Schools seeking his approval<br \/>\nvide covering letter dated 16.9.2004. Nevertheless,<br \/>\nthe District Inspector of Schools, without any<br \/>\nauthority of law passed an order dated 24.3.2005<br \/>\nrelying upon a report of the Finance and Accounts<br \/>\nOfficer that there were eight excess class IV posts<br \/>\nin the institution and despite showing all the<br \/>\npapers, the District Inspector of Schools did not<br \/>\ntake any action and therefore, this petition<br \/>\nchallenging the order dated 24.3.2005 and seeking a<br \/>\nmandate to grant approval for the appointments.<br \/>\n During the pendency of this case, a supplementary<br \/>\naffidavit has been filed by the petitioner stating<br \/>\nthat the Director of Education (Secondary) himself<br \/>\nhas issued a circular letter dated 10.2.2005<br \/>\nreiterating that it is only the Director of<br \/>\nEducation, who can create or abolish any posts in<br \/>\nany recognized aided institution and none other has<br \/>\nthe jurisdiction to do so. In pursuance of fresh<br \/>\nnorms circulated by the Education Department,<br \/>\nexercise has been initiated for fixing the number of<br \/>\nposts and a report has also been sent by the<br \/>\nDistrict Inspector of Schools dated 2.12.2006 to the<br \/>\nJoint Director of Education with regard to the<br \/>\npetitioner institution also and the matter is still<br \/>\nengaging   the   attention   of   the  Director   of<br \/>\n(Secondary) Education, U.P., Lucknow.\n<\/p>\n<p id=\"p_4\">In view of the aforesaid facts, the Director of<br \/>\n(Secondary) Education is directed to take a reasoned<br \/>\ndecision in the case of the petitioner within a<br \/>\nperiod of three months from the date of submission<br \/>\nof a certified copy of this order after giving him a<br \/>\nreasonable opportunity of hearing and thereafter<br \/>\nprocess the recommendations already made by the<br \/>\ninstitution.\n<\/p>\n<p id=\"p_5\">Subject to the aforesaid, writ petition is finally<br \/>\ndisposed off.\n<\/p>\n<p id=\"p_6\">Order Date :- 9.8.2010<br \/>\nAK\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Principal D.A.V.
