Pandya for applicant and learned<br \/>\nadvocate Mr.H.S.Munshaw for respondent.\n<\/p>\n<p id=\"p_1\">2.\tMain<br \/>\nSCA No.5756 of 2009 is filed by petitioner challenging award passed<br \/>\nby Labour Court, Ahmedabad in Reference No.1867 of 2001, Exh.27,<br \/>\ndated 3.12.2008 whereby Labour Court, Ahmedabad has granted<br \/>\nreinstatement  in favour of workman while maintaining terms and<br \/>\nconditions as imposed by Standing Committee Resolution No.1130 dated<br \/>\n30.3.2001 with cost of Rs.1000\/-.\n<\/p>\n<p id=\"p_2\">3.\tThis<br \/>\nCourt while issuing notice, granted ad-interim relief staying<br \/>\nimplementation and operation of impugned award on 24.6.2009.<br \/>\nThereafter, Rule has been issued on 18.9.2009 and interim relief has<br \/>\nalso been directed to remain continued till further orders.\n<\/p>\n<p id=\"p_3\">4.\tIn<br \/>\nlight of this stay granted by this Court, as referred above, present<br \/>\napplication is preferred by applicant with a prayer to grant benefit<br \/>\nunder <a href=\"\/doc\/770112\/\" id=\"a_1\">Section 17B<\/a> of I.D.Act,1947 as applicant is unemployed and not<br \/>\ngainfully employed. The averments made in Para.6 of application is<br \/>\nquoted as under :\n<\/p>\n<p id=\"p_4\"> 6.\tThe<br \/>\napplicant most respectfully states and submits that the applicant is<br \/>\n57 years old and is unemployed and has no source of his livelihood.<br \/>\nIt is further most respectfully stated and submitted that the<br \/>\napplicant is an illiterate person and was under the impression that<br \/>\npursuant to the award passed by Labour Court, the applicant will be<br \/>\nreinstated in service. It is further most respectfully stated and<br \/>\nsubmitted that though the notice issued by this Hon&#8217;ble Court is<br \/>\nserved upon him, due to his lack of knowledge and due to bad<br \/>\nfinancial position, the applicant could not engage any Advocate and<br \/>\nunder the impression that he is to be represented before the Hon&#8217;ble<br \/>\nCourt only through learned advocate and therefore the applicant could<br \/>\nnot remain present before the Hon&#8217;ble Court on 8.9.2009 and therefore<br \/>\nthe Hon&#8217;ble Court has been pleased to confirm the interim relief and<br \/>\nstayed the operation and implementation of the award passed by the<br \/>\nlearned Labour Court.\n<\/p>\n<p id=\"p_5\">5.\tThe<br \/>\naforesaid averments are support with affidavit and against that, no<br \/>\ncounter is filed by original petitioner. Therefore, considering<br \/>\nunemployment of applicant and not gainfully employed with<br \/>\nreinstatement has been stayed by this Court, it is the duty of<br \/>\noriginal petitioner to comply with provisions of <a href=\"\/doc\/770112\/\" id=\"a_1\">Section 17B<\/a> of the<br \/>\nI.D.Act,1947 with effect from date of award.\n<\/p>\n<p id=\"p_6\">6.\tTherefore,<br \/>\nit is directed to original petitioner   present opponent to pay<br \/>\nlast drawn wages as required under <a href=\"\/doc\/770112\/\" id=\"a_2\">Section 17B<\/a> of the I.D.Act,1947 to<br \/>\npresent applicant with effect from date of award   3.12.2008 till<br \/>\n31.3.2010, within a period of one month from date of receiving copy<br \/>\nof present order.
