Justice K.T.SANKARAN\n\n Dated :08\/01\/2010\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                       B.A. NO. 18 OF 2010\n             ------------------------------------------------------\n             Dated this the 8th day of January, 2010\n\n\n                                O R D E R\n<\/pre>\n<p id=\"p_1\">      This is an application for bail under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of<\/p>\n<p>Criminal Procedure.       The petitioner is the first accused in C.R.<\/p>\n<p>No.150 of    2009 of Nooranadu Excise Range, Alappuzha District.<\/p>\n<p id=\"p_1\">      2. The offences alleged against the petitioner and the other<\/p>\n<p>accused are under Sections 55(a), 56(b) and 57(a) of the Abkari Act.<\/p>\n<p id=\"p_2\">      3. The prosecution case is that on 25.12.2009, the Excise<\/p>\n<p>Officials inspected Toddy Shop No.14 of Nooranadu Excise Range.<\/p>\n<p>They found the first accused mixing some liquid with toddy. Samples<\/p>\n<p>of toddy were taken and the officials seized 385 litres of toddy kept in<\/p>\n<p>the toddy shop. The petitioner was arrested on 25.12.2009 and he<\/p>\n<p>was remanded to judicial custody.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">      4.     Learned counsel for the petitioner submitted that<\/p>\n<p>registration of the crime and arrest of the petitioner before getting a<\/p>\n<p>B.A. NO. 18 OF 2010<\/p>\n<p>                                       :: 2 ::\n<\/p>\n<p id=\"p_5\">report from the Chemical Examiner was premature. He relied on<\/p>\n<p>Rule 8(3) of the Abkari Shops (Disposal) Rules, 2002. The counsel<\/p>\n<p>points out that if ultimately it is found that the sample of toddy is free<\/p>\n<p>from any noxious substance, there would be no justification for the<\/p>\n<p>detention of the petitioner in judicial custody. Learned counsel for<\/p>\n<p>the petitioner submitted that if, on getting the report, it is found that<\/p>\n<p>the toddy was adulterated, still the investigating officer can seek for<\/p>\n<p>appropriate remedies for re-arrest of the petitioner.<\/p>\n<p id=\"p_6\">       5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the contentions put forward by the learned counsel for the<\/p>\n<p>petitioner and the fact that the report of the Chemical Examiner is not<\/p>\n<p>received, I am of the view that the petitioner is to be released on bail.<\/p>\n<p id=\"p_7\">       6. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the Judicial Magistrate of the First Class &#8211; II,<\/p>\n<p>Mavelikkara, subject to the following conditions:<\/p>\n<blockquote id=\"blockquote_1\"><p>       a)    The petitioner shall report before the investigating officer<br \/>\n             between 9 A.M.        and 11 A.M. on all Mondays, till the<br \/>\n             final report is filed or until further orders;\n<\/p><\/blockquote>\n<p id=\"p_8\">B.A. NO. 18 OF 2010<\/p>\n<p>                                     :: 3 ::\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">      b)     The petitioner shall appear before the investigating<br \/>\n             officer for interrogation as and when required;<\/p>\n<p id=\"p_11\">      c)     The petitioner shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;\n<\/p>\n<p id=\"p_12\">      d)     The petitioner shall not commit any offence or indulge in<br \/>\n             any prejudicial activity while on bail;\n<\/p>\n<p id=\"p_13\">      e)     In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed as above.\n<\/p>\n<p id=\"p_14\">      It is made clear that after receipt of the report of the Chemical<\/p>\n<p>Examiner, the investigating officer would be free to seek for<\/p>\n<p>appropriate reliefs, in the manner indicated above.<\/p>\n<p id=\"p_15\">                                                    (K.T.SANKARAN)<br \/>\n                                                            Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Rajeev vs State Of Kerala on 8 January, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 18 of 2010() 1.
