Agarwal,J.\n<\/pre>\n<p id=\"p_1\">Heard Sri Mohit Singh, learned counsel for the revisionists and learned AGA for the State.\n<\/p>\n<p id=\"p_1\">This revision has been preferred against the order dated 17.7.2010 passed by the Chief Judicial<br \/>\nMagistrate, Shahjahanpur in crime no. 280 of 2008 ( wrongly mentioned as 280 of 2009 in the<br \/>\nimpugned order) under <a href=\"\/doc\/409589\/\" id=\"a_1\">section 304<\/a>, <a href=\"\/doc\/555306\/\" id=\"a_1\">504<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_2\">506<\/a> IPC P.S. Khudaganj District Shahjahanpur.\n<\/p>\n<p id=\"p_2\">In the aforesaid case crime number, the police submitted final report in favour of the revisionists.<br \/>\nThe respondent no. 2, complainant filed protest petition. After hearing the complainant as well as<br \/>\nAssistant Public Prosecutor, the final report was rejected. The protest petition was allowed and<br \/>\nthe revisionists were summoned to face trial.\n<\/p>\n<p id=\"p_3\">It is submitted by the learned counsel for the revisionists that the learned Magistrate, while<br \/>\nsummoning the revisionists, neither relied on the material available in the case diary nor treated<br \/>\nthe protest petition as complaint case and did not even record the statement of the complainant<br \/>\nand his witnesses under <a href=\"\/doc\/444619\/\" id=\"a_3\">section 200<\/a> and <a href=\"\/doc\/1149595\/\" id=\"a_4\">202<\/a> Cr.P.C. therefore, impugned order is bad in law.<br \/>\nReliance has been placed on a decision of a Division Bench of this court in the case of<br \/>\nPAKHANDU and others Vs. STATE OF U.P. and another, reported in [ 2001 (43 ) ACC 1096].<br \/>\nWherein, it has been held that after receipt of final report, on the protest petition the Magistrate<br \/>\nhas to follow any of the four courses;\n<\/p>\n<p id=\"p_4\">(i) He may accept the final report and may drop the proceedings.\n<\/p>\n<p id=\"p_5\">(ii) He may take cognizance under <a href=\"\/doc\/276703\/\" id=\"a_5\">section 190<\/a> (1) (b) <a href=\"\/doc\/445276\/\" id=\"a_6\">Cr.P.C<\/a>., if there is sufficient material in the<br \/>\ncase diary.\n<\/p>\n<p id=\"p_6\">(iii) He may order further investigation, if he satisfies that investigation was made in a<br \/>\nperfunctory manner, or<\/p>\n<p id=\"p_7\">(iv) He may treat protest petition as a complaint case and proceed to the Act under <a href=\"\/doc\/444619\/\" id=\"a_7\">section 200<\/a><br \/>\nand <a href=\"\/doc\/1149595\/\" id=\"a_8\">202<\/a> Cr.P.C. and thereafter decide whether complaint should be dismissed or process should<br \/>\nbe issued.\n<\/p>\n<p id=\"p_8\">A perusal of the record reveals that learned Magistrate neither relied on the material available in<br \/>\ncase diary nor proceeded to take action under <a href=\"\/doc\/444619\/\" id=\"a_9\">section 200<\/a> and <a href=\"\/doc\/1149595\/\" id=\"a_10\">202<\/a> Cr.P.C. but summoned the<br \/>\nrevisionists. The order does not indicate that on what the evidence the impugned order has been<br \/>\npassed.\n<\/p>\n<p id=\"p_9\">The impugned order cannot sustained and is liable to be set aside.\n<\/p>\n<p id=\"p_10\">The revision is allowed. The impugned order dated 17.7.2010 summoning the revisionists is set<br \/>\naside and the learned Magistrate is directed to pass a fresh order in the following manner;\n<\/p>\n<p id=\"p_11\"> (i) If there is sufficient material in the case diary to proceed against the revisionists, learned<br \/>\nMagistrate shall pass an order accordingly under <a href=\"\/doc\/686759\/\" id=\"a_11\">section 190<\/a> (i) (b) <a href=\"\/doc\/445276\/\" id=\"a_12\">Cr.P.C<\/a>.\n<\/p>\n<p id=\"p_12\">(ii) If sufficient material is not present in the case diary, the learned Magistrate may treat the<br \/>\nprotest petition as complaint and shall provide an opportunity to the complainant to adduce<br \/>\nevidence under <a href=\"\/doc\/444619\/\" id=\"a_13\">section 200<\/a> and <a href=\"\/doc\/1149595\/\" id=\"a_14\">202<\/a> Cr.P.C. and thereafter pass an appropriate order in<br \/>\naccordance with law.\n<\/p>\n<p id=\"p_13\">This revision is disposed of accordingly.\n<\/p>\n<p id=\"p_14\">Order Date :- 2.8.2010<br \/>\nGss\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Ramanpal Singh &amp; Others vs State Of U.P. &amp; Another on 2 August, 2010 Court No. &#8211; 50 Case :- CRIMINAL REVISION No. &#8211; 2949 of 2010 Petitioner :- Ramanpal Singh &amp; Others Respondent :- State Of U.P. &amp; Another Petitioner Counsel :- Mohit Singh Respondent Counsel :- Govt.
