Raju for Mr.A.B.<br \/>\nGateshaniya for the applicant submitted that the alleged<br \/>\noffence was committed on 13.12.2000 at about 23:00 hrs. at<br \/>\nnight. Initially, the investigation in the said offence was carried<br \/>\nout by the local police officer of Jetpur police station and<br \/>\nthereafter by C.I.D. (Crime Branch Rural). The chargesheet was<br \/>\ninitially filed against the other accused. The applicant was arrested<br \/>\non 27.07.2004 and sent to the judicial custody. A separate<br \/>\nchargesheet was filed qua the applicant and the case was registered<br \/>\nas Sessions Case No.78 of 2004 in the trial court. The applicant<br \/>\npreferred Criminal Misc. Application No.5928 of 2006 which was<br \/>\ndismissed by order dated 19.07.2006. The applicant filed another<br \/>\napplication being Criminal Misc. Application No.360 of 2007 and the<br \/>\nlearned trial court vide order 24.07.2007 dismissed the said<br \/>\napplication. It is submitted that the trial in the aforesaid case has<br \/>\nnot commenced and the applicant, without his fault, is imprisoned<br \/>\nand, therefore, he preferred bail application before the trial court<br \/>\nbeing Criminal Misc. Application No.93 of 2009 which was rejected on<br \/>\n11.06.2009. The learned advocate submitted that since more than five<br \/>\nyears, the trial in the above Sessions Case No.78 of 2004 has not<br \/>\ncommenced and, therefore, prayer, as set out in the<br \/>\napplication, be granted. The learned advocate submitted that because<br \/>\nof pendency of a quashing petition, stay has been granted by the High<br \/>\nCourt and, therefore, the sessions case has not proceeded. Even on<br \/>\nmerits, nothing is recovered from the applicant and he has been<br \/>\nfalsely implicated in the commission of offence punishable under<br \/>\n<a href=\"\/doc\/1560742\/\" id=\"a_6\">Sections 302<\/a>, <a href=\"\/doc\/838469\/\" id=\"a_7\">452<\/a>, <a href=\"\/doc\/37788\/\" id=\"a_8\">34<\/a> and <a href=\"\/doc\/1897847\/\" id=\"a_9\">120B<\/a> of the Indian Penal Code and <a href=\"\/doc\/1518620\/\" id=\"a_10\">Section<br \/>\n25(1)<\/a>A of the Arms Act. The learned advocate submitted that if bail<br \/>\nis not granted to the applicant then he would languish in jail till<br \/>\nquashing petition is decided by this Court. Thus, the learned<br \/>\nadvocate submitted that in view of the peculiar facts and<br \/>\ncircumstances of the case and even though it is a successive bail<br \/>\napplication, prayer for bail, as set out in the application, be<br \/>\ngranted and the applicant be enlarged on bail. The learned advocate<br \/>\nplaced reliance on the following judgments in support of the<br \/>\nsubmission that if the trial could not be proceeded for one reason or<br \/>\nthe other, then the applicant is required to be enlarged on bail.\n<\/p>\n<p id=\"p_2\">(i)<br \/>\nState, CBI\/SPE, New Delhi V\/s. Pal Singh and another reported in<br \/>\n(2001)1 SCC 247;\n<\/p>\n<p id=\"p_3\">(ii)<br \/>\nMehmood Mohammed Sayeed V\/s. State of   Maharashtra reported in<br \/>\n(2002)10 SCC 677;\n<\/p>\n<p id=\"p_4\">(iii)<br \/>\nMohd. Chand Mulani V\/s. Union of India and Another reported in<br \/>\n(2006)13 SCC 143;\n<\/p>\n<p id=\"p_5\">(iv)<br \/>\nNanjappa V\/s. Union of India reported in (2007)4 SCC 350;\n<\/p>\n<p id=\"p_6\">(v)<br \/>\nBal Krishna Pandey alias Vidur V\/s. State of U.P. reported in<br \/>\n(2003)12 SCC 186;\n<\/p>\n<p id=\"p_7\">(vi)Satya<br \/>\nBrat Gain V\/s. State of Bihar reported in (2000)9 SCC 398 and;\n<\/p>\n<p id=\"p_8\">(vii)<br \/>\nAkhtari BI (Smt.) V\/s. State of M.P. reported in (2001)4 SCC 355.\n<\/p>\n<p id=\"p_9\">3.\tLearned<br \/>\nA.P.P. Ms.M.L. Shah, representing the respondent-State, while<br \/>\nopposing the bail application, submitted that this is a successive<br \/>\nbail application and considering the role attributed to the applicant<br \/>\nand the manner in which the offence is committed by him under <a href=\"\/doc\/1560742\/\" id=\"a_11\">Section<br \/>\n302<\/a> of the Indian Penal Code, no discretionary relief be granted to<br \/>\nthe applicant. The learned A.P.P. submitted that because of the stay<br \/>\ngranted by the High Court in a quashing petition, the trial could not<br \/>\nbe proceeded and that cannot be the ground to prefer the successive<br \/>\nbail application, seeking enlargement of the applicant on regular<br \/>\nbail. The judgments cited by the learned Senior Advocate for the<br \/>\napplicant are not applicable to the facts and circumstances of the<br \/>\npresent case and, therefore, the learned A.P.P. submitted that<br \/>\nconsidering the role attributed to the applicant, manner in which the<br \/>\noffence is committed by him and since the present application is a<br \/>\nsuccessive bail application, no interference is called for in the<br \/>\napplication and the same be dismissed.\n<\/p>\n<p id=\"p_10\">4.\tI<br \/>\nhave heard learned Senior Advocate Mr.S.V. Raju for Mr.A.B.<br \/>\nGateshaniya for the applicant  and learned A.P.P. Ms.M.L. Shah<br \/>\nfor the respondent State at length and in great detail. I have<br \/>\nconsidered the role attributed to the applicant and the manner in<br \/>\nwhich the alleged offence of murder is committed by him along with<br \/>\nthe other accused. This application is a successive bail application<br \/>\nand, therefore, this Court would have very limited powers and scope<br \/>\nto interfere. It can be interfered with only if there is substantial<br \/>\nchange in the circumstances. Considering the role attributed to the<br \/>\napplicant and the manner in which the alleged offence is committed by<br \/>\nhim, I am of the view that no interference is called for in the<br \/>\napplication.\n<\/p>\n<p id=\"p_11\">5.\tI<br \/>\nhave also considered the judgments cited by learned Senior Advocate<br \/>\nMr.S.V. Raju for the applicant and there is no dispute about the<br \/>\nratio or proposition laid down in the said judgments. However,<br \/>\nconsidering the facts and circumstances of the case, the judgments<br \/>\nare not applicable to the present case.\n<\/p>\n<p id=\"p_12\">6.\tFor<br \/>\nthe foregoing reasons, there is no merit in the application and the<br \/>\nsame is hereby dismissed.
