Justice M.SASIDHARAN NAMBIAR\n\n Dated :13\/11\/2008\n\n O R D E R\n                  M.SASIDHARAN NAMBIAR, J.\n                    ...........................................\n                  CRL.R.P.NO. 3657 OF 2008\n                    ............................................\n     DATED THIS THE            13th DAY OF NOVEMBER, 2008\n\n                                   ORDER\n<\/pre>\n<p id=\"p_1\">     Revision petitioner is the accused and second respondent,<\/p>\n<p>the complainant in S.T.213 of 2004 on the file of Judicial First<\/p>\n<p>Class Magistrate, Vaikom.                Petitioner was convicted and<\/p>\n<p>sentenced     to simple imprisonment for six months and a<\/p>\n<p>compensation of Rs.39,360\/- for the offence under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of<\/p>\n<p>N.I.Act. Conviction was challenged before Sessions Court,<\/p>\n<p>Kottayam in     Crl.A.139 of 2006. Learned Sessions Judge, on<\/p>\n<p>reappreciation of evidence, confirmed the conviction and<\/p>\n<p>sentence and dismissed the appeal. It is challenged in this<\/p>\n<p>revision petition.\n<\/p>\n<p id=\"p_1\">     2. Learned counsel appearing for petitioner was heard.<\/p>\n<p>Learned counsel submitted that revision petitioner is not<\/p>\n<p>challenging the conviction and the sentence may be modified.<\/p>\n<p>Learned counsel made an endorsement that revision petitioner is<\/p>\n<p>not challenging the conviction. So long as sentence is not varied<\/p>\n<p>or modified against the interest of second respondent, it is not<\/p>\n<p>necessary to issue notice to second respondent.                   Interest of<\/p>\n<p>justice will be met, if sentence is modified to imprisonment till<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRRP 3657\/2008                   2<\/span><\/p>\n<p>rising of court and fine         directing payment of fine as<\/p>\n<p>compensation.\n<\/p>\n<p id=\"p_2\">      3. Revision petition is allowed. Sentence is modified.<\/p>\n<p>Petitioner is sentenced to imprisonment till rising of court and a<\/p>\n<p>fine of Rs.45,000\/- and in default, simple imprisonment for two<\/p>\n<p>months. On realisation of fine, Rs.40,000\/- to be paid to second<\/p>\n<p>respondent as compensation under <a href=\"\/doc\/1644380\/\" id=\"a_1\">Section 357(1)<\/a> of Code of<\/p>\n<p>Criminal Procedure. Petitioner is granted three months time<\/p>\n<p>from today to pay the fine.
