Justice R.BASANT\n\n Dated :11\/10\/2007\n\n O R D E R\n                            R.BASANT, J.\n                         ----------------------\n                      W.P.C.No.30412 of 2007\n                     ----------------------------------------\n               Dated this the 11th day of October 2007\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioner is the de facto complainant in a crime<\/p>\n<p>registered for offences punishable inter alia under <a href=\"\/doc\/1591527\/\" id=\"a_1\">Sections 403<\/a>,<\/p>\n<p><a href=\"\/doc\/1436241\/\" id=\"a_1\">420<\/a> and <a href=\"\/doc\/556166\/\" id=\"a_2\">468<\/a> I.P.C. The crime has been registered on the basis of a<\/p>\n<p>private complaint filed by the learned Magistrate and referred by<\/p>\n<p>the learned Magistrate to the police under <a href=\"\/doc\/99487\/\" id=\"a_3\">Section 156(3)<\/a> Cr.P.C.<\/p>\n<p>The police conducted the investigation.                   After conducting the<\/p>\n<p>investigation, the investigating officer appears to have come to the<\/p>\n<p>decision that no charge sheet need be filed. Negative final report<\/p>\n<p>deserves to be filed. The petitioner has been informed of that<\/p>\n<p>decision as per Ext.P4.\n<\/p>\n<p id=\"p_1\">      2.    I should think that it is for the petitioner to appear<\/p>\n<p>before the learned Chief Judicial Magistrate and raise his<\/p>\n<p>objections, if any, against the negative final report filed by the<\/p>\n<p>investigating officer .      He can appear personally or through<\/p>\n<p>counsel and raise all his objections against the final report. It is<\/p>\n<p>trite that in such objections he can request the learned Magistrate<\/p>\n<p>to send the matter back to the investigating officer to continue the<\/p>\n<p>investigation.   He can also request the learned Magistrate to<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.C.No.30412\/07                 2<\/span><\/p>\n<p>accept the report and take cognizance notwithstanding the fact<\/p>\n<p>that it is a negative report. Needless to say, the petitioner has<\/p>\n<p>the third alternative of filing a protest complaint also.       The<\/p>\n<p>learned counsel for the petitioner submits that the petitioner is<\/p>\n<p>employed abroad and there are practical difficulties in filing a<\/p>\n<p>protest complaint now before the learned Magistrate.<\/p>\n<p id=\"p_2\">      3.    Be that as it may, the petitioner can certainly appear<\/p>\n<p>before the learned Magistrate personally or through counsel and<\/p>\n<p>raise all his objections against acceptance of the final report. He<\/p>\n<p>can urge before the learned Magistrate that no proper<\/p>\n<p>investigation has been conducted and the matter deserves to be<\/p>\n<p>referred back to the investigating officer      to conduct proper<\/p>\n<p>investigation. The objections of the petitioner will have to be<\/p>\n<p>considered and appropriate decision taken by the learned<\/p>\n<p>Magistrate.\n<\/p>\n<p id=\"p_3\">      4.
