No. 513 of 2010\n                ===================\n         Dated this the 15th day of February, 2010.\n\n                             O R D E R\n<\/pre>\n<p id=\"p_1\">      In this revision filed under <a href=\"\/doc\/1571667\/\" id=\"a_1\">Section 401<\/a> Cr.P.C. the revision<\/p>\n<p>petitioner who was the accused in C.C. No.225 of 2006 on the<\/p>\n<p>file of the Judicial First Class Magistrate-IV, Kozhikode   for an<\/p>\n<p>offence punishable under <a href=\"\/doc\/68146\/\" id=\"a_1\">Section 509<\/a> IPC challenges the<\/p>\n<p>conviction entered and the sentence passed against him for the<\/p>\n<p>said offence.\n<\/p>\n<p id=\"p_1\">      2.    The case of the prosecution can be summarised as<\/p>\n<p>follows:\n<\/p>\n<p id=\"p_2\">      On 09.06.2006, at about 7 p.m., from the vicinity of a<\/p>\n<p>stationery shop by name Fouz stores near the English Church in<\/p>\n<p>Kacheri Amsom and Desom of Kozhikode Taluk, when PW1, a<\/p>\n<p>woman police Constable not in her uniform, came for purchasing<\/p>\n<p>articles from the said shop, the revision petitioner made gestures<\/p>\n<p>and uttered words intending to outrage the modesty of PW1. The<\/p>\n<p>accused has thereby committed an offence punishable under<\/p>\n<p><a href=\"\/doc\/68146\/\" id=\"a_2\">Section 509<\/a> IPC.\n<\/p>\n<p id=\"p_3\"><span class=\"hidden_text\" id=\"span_1\">Crl.R.P. No. 513\/2010           -:2:-<\/span><\/p>\n<p id=\"p_4\">      3.      On the accused pleading not guilty to the charge<\/p>\n<p>framed against him by the trial court for the aforementioned<\/p>\n<p>offences, the prosecution was permitted to adduce evidence in<\/p>\n<p>support of its case.     The prosecution altogether examined 6<\/p>\n<p>witnesses as P.Ws 1 to 6 and got marked 2 documents as Exts.<\/p>\n<p>P1 and P2.\n<\/p>\n<p id=\"p_5\">      4.      After the close of the prosecution evidence, the<\/p>\n<p>accused was questioned under Sec. 313 (1)(b) <a href=\"\/doc\/445276\/\" id=\"a_3\">Cr.P.C<\/a>. with<\/p>\n<p>regard to the incriminating circumstances appearing against him<\/p>\n<p>in the evidence for the prosecution.             He denied those<\/p>\n<p>circumstances and maintained his innocence. He did not adduce<\/p>\n<p>any defence evidence when called upon to do so.<\/p>\n<p id=\"p_6\">      5.      The learned Magistrate, after trial, as per judgment<\/p>\n<p>dated 16.08.2008 found the revision petitioner guilty of the<\/p>\n<p>offence and sentenced him to simple imprisonment for three<\/p>\n<p>months and to pay a fine of Rs.500\/- and on default to pay the<\/p>\n<p>fine, to suffer simple imprisonment for 18 days.        On appeal<\/p>\n<p>preferred by him as Crl. Appeal No. 772 of 2008 before the<\/p>\n<p>Sessions Court, Kozhikode the learned Additional Sessions Judge<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P. No. 513\/2010              -:3:-<\/span><\/p>\n<p>as per judgment dated 11.11.2009 has confirmed the conviction<\/p>\n<p>entered and the sentence passed against the revision petitioner.<\/p>\n<p>Hence, this Revision.\n<\/p>\n<p id=\"p_7\">      6.      Eventhough the learned counsel appearing for the<\/p>\n<p>revision petitioner    assailed on various grounds the conviction<\/p>\n<p>entered against the revision petitioner, in as much as the<\/p>\n<p>conviction has been recorded by the courts below concurrently<\/p>\n<p>after a careful evaluation of the oral and documentary evidence<\/p>\n<p>in the case, this Court        sitting in revision will be loathe to<\/p>\n<p>interfere with the said conviction which is accordingly confirmed.<\/p>\n<p id=\"p_8\">      7.      What now survives for consideration is the question<\/p>\n<p>regarding the adequacy or otherwise of the sentence imposed on<\/p>\n<p>the revision petitioner. Having regard to the facts and<\/p>\n<p>circumstances of the case, I do not think that the revision<\/p>\n<p>petitioner deserves penal servitude by way of incarceration for<\/p>\n<p>the said conviction. I am of the view that        interests of justice<\/p>\n<p>will be adequately met by imposing a sentence to be passed<\/p>\n<p>hereinafter.      Accordingly, for his conviction under <a href=\"\/doc\/68146\/\" id=\"a_4\">Section 509<\/a><\/p>\n<p>IPC, the revision petitioner is sentenced to imprisonment till the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">Crl.R.P. No. 513\/2010             -:4:-<\/span><\/p>\n<p>rising of the court and to pay a compensation of Rs.10,000\/- to<\/p>\n<p>PW1 under <a href=\"\/doc\/640437\/\" id=\"a_5\">Section 357(3)<\/a> Cr.P.C.
