SHAH\n\t\t\n\t\n\n \n\nDate\n: 05\/08\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">1.\tRule.\n<\/p>\n<p id=\"p_1\">Shri Girish Patel, learned advocate for the respondent No.1 and Shri<br \/>\nVipul Mistry, learned AGP, for the respondent No. 3 wavies service of<br \/>\nnotice of admission on behalf of the respondents. With the consent of<br \/>\nthe learned advocate appearing for the respective parties, the matter<br \/>\nis taken up for final hearing today.\n<\/p>\n<p id=\"p_2\">2.\tBy<br \/>\nway of this petition under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the Constitution of India,<br \/>\nthe petitioners-original defendants have prayed for an appropriate<br \/>\nwrit, direction and \/ or order quashing and setting aside the<br \/>\nimpugned oder passed by the learned Civil Judge, (S.D.), Palanpur<br \/>\nbelow Exh. 1 in Regular Civil Suit No. 112 of 1995 rejecting the said<br \/>\napplication and not transferring the said suit to the Civil Court at<br \/>\nPatan which would be having the territorial jurisdiction.\n<\/p>\n<p id=\"p_3\">3.\tRespondent<br \/>\nNo.1 herein had instituted the Regular Civil Suit No. 112 of 1995 in<br \/>\nthe Court of learned Civil Judge (S.D.), Palanpur for declaration and<br \/>\nconsequential relief. It appears that the cause of action had arisen<br \/>\nat Varahi, Tal: Santalpur, Dist. Banaskantha. At the relevant time,<br \/>\nVarahi was in Tal: Santalpur, Dist. Banaskantha and, therefore, the<br \/>\nsaid  suit was instituted in the Court at Palanpur. It appears that<br \/>\nsubsequently new District Patan is established and all the suits came<br \/>\nto be transferred as per the new territorial jurisdiction, however,<br \/>\nat the relevant time by mistake the present suit in question was not<br \/>\ntransferred to the Court of learned Civil Judge (S.D.), Patan and,<br \/>\ntherefore, petitioners submitted an application before the learned<br \/>\ntrial Court to transfer the said suit to the learned Civil Judge<br \/>\n(S.D.), Patan. However, the said application  came to be dismissed by<br \/>\nthe learned trial Court by holding that the said Court has no<br \/>\njurisdiction to transfer the suit from one District to another<br \/>\nDistrict and the said powers are only with the High Court and also on<br \/>\nthe ground that earlier the High Court has directed to treat the<br \/>\nissue with respect  to the jurisdiction as a preliminary issue. Being<br \/>\naggrieved with the order passed below Exh. 1 dated 27.12.2007 passed<br \/>\nin Regular Civil Suit No. 112 of 1995, petitioners-original<br \/>\ndefendants No.1 have preferred present Special Civil Application<br \/>\nunder <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the Constitution of India.\n<\/p>\n<p id=\"p_4\">4.\tShri<br \/>\nPopat, learned advocate appearing for the petitioners has submitted<br \/>\nthat the cause of action had arisen in Varahi which was at the<br \/>\nrelevant time in  Tal: Santalpur, Dist.\n<\/p>\n<p id=\"p_5\">Banaskantha and, therefore, the said suit was instituted in the Court<br \/>\nat Palanpur. However, subsequently as per the Government Resolution\/<br \/>\nNotification dated 30.7.2002 on establishment of District Patan, the<br \/>\nsaid suit was required to be transferred to the Court at<br \/>\nPatan,however by mistake the same suit was not transferred to the<br \/>\nlearned Civil Court, Patan and, therefore, it is requested to<br \/>\ntransfer the suit from learned Civil Court, Palanpur to learned Civil<br \/>\nCourt (S.D.), Patan, who have the territorial jurisdiction.\n<\/p>\n<p id=\"p_6\">5.\tShri<br \/>\nGirish Patel, learned advocate appearing for the respondent No.1 has<br \/>\nsubmitted that as earlier the application of the petitioners was<br \/>\ndismissed and even this Court has directed to decide the question<br \/>\nwith respect to jurisdiction as preliminary issue, the learned trial<br \/>\nCourt has rightly rejected the application and the said issue is<br \/>\nrequired to be decided as a preliminary issue, therefore, it is<br \/>\nrequested to dismiss the present Special Civil Application.\n<\/p>\n<p id=\"p_7\">6.\tHeard<br \/>\nthe learned advocate appearing for the respective parties. It is<br \/>\nrequired to be noted that the cause of action had arisen in Varahi<br \/>\nwhich was in Tal: Santalpur, Dist. Banaskantha and, therefore, the<br \/>\naforesaid suit came to be instituted in the Court at Palanpur,<br \/>\nhowever subsequently due to the establishment of new Patan District,<br \/>\nthe cases were required to be transferred at Patan having the<br \/>\njurisdiction and all other cases came to be transferred as per new<br \/>\nterritorial jurisdiction. It appears that by mistake the suit in<br \/>\nquestion was not transferred and therefore, application was submitted<br \/>\nby the petitioners to transfer the said suit to the learned Civil<br \/>\nCourt, Patan having the territorial jurisdiction. It is not in<br \/>\ndispute that as per the Notification dated 30.7.2002 on establishment<br \/>\nof Patan District for the suit in question only the Court at Patan<br \/>\nwould have the territorial jurisdiction and, therefore, the suit in<br \/>\nquestion is required to be transferred to Court of learned Civil<br \/>\nJudge (S.D.), Patan. Now, the learned Civil Judge (S.D.) would not<br \/>\nhave any jurisdiction to decide and dispose of the suit. It is true<br \/>\nthat in earlier proceedings, this Court directed to treat the issue<br \/>\nwith respect to jurisdiction as a preliminary issue but when on the<br \/>\nface of it, it is found that the learned Civil Court, Palanpur would<br \/>\nnot have any jurisdiction now and only the Court at Patan would have<br \/>\njurisdiction, the said order cannot come in the way of transferring<br \/>\nthe suit to the Court having the jurisdiction.\n<\/p>\n<p id=\"p_8\">8.\tConsidering<br \/>\nthe above, the Regular Civil Suit No. 112 of 1995 requires to be<br \/>\ntransferred to the Court of learned Civil Judge (S.D.) Patan, who<br \/>\nwill have territorial jurisdiction to decide and dispose of the<br \/>\ncontroversy involved in the suit.\n<\/p>\n<p id=\"p_9\">9.\tFor<br \/>\nthe reasons stated above, petition succeeds. It is hereby ordered to<br \/>\ntransfer the Regular Civil Suit No. 112 of 1995 pending in the Court<br \/>\nof learned Civil Judge (S.D.) Palanpur to the learned Civil  Judge<br \/>\n(S.D.), Patan. Rule is made absolute.
