Agnihotri, J.\n<\/pre>\n<p id=\"p_1\">      Dated:19\/08\/2008<\/p>\n<p>:    Judgement<\/p>\n<p>WRIT PETITION UNDER <a href=\"\/doc\/1712542\/\" id=\"a_1\">ARTICLE 226<\/a> OF THE CONSTITUTION OF INDIA            <\/p>\n<p>                         ORAL ORDER<br \/>\n           (Passed on 19th  day of  August, 2008)<\/p>\n<p id=\"p_1\">  1.   Learned  counsel appearing for the petitioner submits<br \/>\n       that the respondent-authorities have failed to understand<br \/>\n       the  purport of the order wherein, before passing the<br \/>\n       impugned orders dated 23.05.2008 (Annexure P\/3 colly.),<br \/>\n       principles of natural justice was required to be complied<br \/>\n       with. It is further contended that show cause notice was<br \/>\n       issued  on  one ground and the impugned orders  dated<br \/>\n       23.05.2008 (Annexure P\/3 colly.) were passed on different<br \/>\n       ground. No show-cause-notice or opportunity of hearing was<br \/>\n       afforded to the petitioner in respect of the ground, which<br \/>\n       was taken for passing the impugned order.\n<\/p>\n<p id=\"p_2\">  2.   Be that as it may, since it involves question of facts<br \/>\n       which can be considered only by the appellate authority,<br \/>\n       thus, this case is not one of the case wherein departure<br \/>\n       from normal rule of resorting to statutory forum,  be<br \/>\n       allowed.\n<\/p>\n<p id=\"p_3\">  3.   On the question of availability of alternative remedy,<br \/>\n       the Hon&#8217;ble Supreme Court in the matter of <a href=\"\/doc\/674013\/\" id=\"a_1\">State of H.P. and<br \/>\n       others v. Gujarat Ambuja Cement<\/a> and another1, observed as<br \/>\n       under:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;17.  We  shall  first  deal  with  the  plea<br \/>\n            regarding alternative remedy as raised by the<br \/>\n            appellant  State. Except for  a  period  when<br \/>\n            <a href=\"\/doc\/1712542\/\" id=\"a_2\">Article  226<\/a>  was amended by the Constitution<br \/>\n            (Forty-second Amendment) Act, 1976, the power<br \/>\n            relating  to  alternative  remedy  has   been<br \/>\n            considered  to  be  a  rule  of  self-imposed<br \/>\n            limitation.  It  is  essentially  a  rule  of<br \/>\n            policy, convenience and discretion and  never<br \/>\n            a  rule of law. Despite the existence  of  an<br \/>\n            alternative   remedy,  it   is   within   the<br \/>\n            jurisdiction of discretion of the High  Court<br \/>\n            to  grant  relief under <a href=\"\/doc\/1712542\/\" id=\"a_3\">Article  226<\/a>  of  the<br \/>\n            Constitution. At the same time, it cannot  be<br \/>\n            lost sight of that though the matter relating<br \/>\n            to  an  alternative remedy has nothing to  do<br \/>\n            with  the  jurisdiction of the case, normally<br \/>\n            the  High Court should not interfere if there<br \/>\n            is   an   adequate  efficacious   alternative<br \/>\n            remedy. If somebody approaches the High Court<br \/>\n            without   availing  the  alternative   remedy<br \/>\n            provided the High Court should ensure that he<br \/>\n            has  made  out  a strong case or  that  there<br \/>\n            exist    good    grounds   to   invoke    the<br \/>\n            extraordinary jurisdiction.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>            21.  <a href=\"\/doc\/808713\/\" id=\"a_4\">In  G.Veerappa Pilla v.  Raman  &amp;  Raman<br \/>\n            Ltd<\/a>.;  <a href=\"\/doc\/678253\/\" id=\"a_5\">CCE  v.  Dunlop India  Ltd<\/a>.;  <a href=\"\/doc\/1254697\/\" id=\"a_6\">Ramendra<br \/>\n            Kishore Biswas v. State of Tripura<\/a>, <a href=\"\/doc\/517393\/\" id=\"a_7\">Shivgonda<br \/>\n            Anna   Patil   v.   State   of   Maharashtra<\/a>;<br \/>\n            <a href=\"\/doc\/1697169\/\" id=\"a_8\">C.A.Abraham v. ITO<\/a>, <a href=\"\/doc\/23675\/\" id=\"a_9\">Titaghur Paper Mills  Co.<br \/>\n            Ltd  v. State of  Orissa<\/a>; H.B.Gandhi v.  Gopi<br \/>\n            Nath  and Sons; <a href=\"\/doc\/172383107\/\" id=\"a_10\">Whirlpool Corpn. v. Registrar<br \/>\n            of  Trade Marks<\/a>; <a href=\"\/doc\/500776\/\" id=\"a_11\">Tin Plate Co. of India  Ltd.<br \/>\n            v.  State  of  Bihar<\/a>, <a href=\"\/doc\/1060913\/\" id=\"a_12\">Sheela Devi  v.  Jaspal<br \/>\n            Singh<\/a>    and   <a href=\"\/doc\/1968473\/\" id=\"a_13\">Punjab   National   Bank    v.<br \/>\n            O.C.Krishnan<\/a>,  this  Court  held  that  where<br \/>\n            hierarchy  of  appeals  is  provided  by  the<br \/>\n            statute,  party  must exhaust  the  statutory<br \/>\n            remedies    before    resorting    to    writ<br \/>\n            jurisdiction. &#8221;\n<\/p><\/blockquote>\n<p id=\"p_4\">  4.   Further,  applying the said ratio in  the  matter  of<br \/>\n       <a href=\"\/doc\/314912\/\" id=\"a_14\">U.P.State Spinning Co. Ltd. v. R.S.Pandey<\/a> and another2, the<br \/>\n       Supreme Court observed as under:\n<\/p>\n<blockquote id=\"blockquote_2\"><p>            &#8220;21.  <a href=\"\/doc\/1452602\/\" id=\"a_15\">In  U.P.State  Bridge  Corpn.  Ltd.  v.<br \/>\n            U.P.Rajya  Setu Nigam S.Karmachari Sangh<\/a>,  it<br \/>\n            was  held  that when the dispute  relates  to<br \/>\n            enforcement  of  a right or obligation  under<br \/>\n            the   statute   and   specific   remedy   is,<br \/>\n            therefore,  provided under the  statute,  the<br \/>\n            High  Court  should  not  deviate  from   the<br \/>\n            general view and interfere under <a href=\"\/doc\/1712542\/\" id=\"a_16\">Article  226<\/a><br \/>\n            except  when a very strong case is  made  out<br \/>\n            for   making  a  departure.  The  person  who<br \/>\n            insists  upon  such remedy can avail  of  the<br \/>\n            process as provided under the statute. To the<br \/>\n            same  effect  are  the decisions  in  <a href=\"\/doc\/321104\/\" id=\"a_17\">Premier<br \/>\n            Automobiles Ltd. v. Kamlekar Shantaram Wadke<\/a>,<br \/>\n            <a href=\"\/doc\/1696077\/\" id=\"a_18\">Rajasthan  SRTC v. Krishna Kant<\/a>,  <a href=\"\/doc\/677526\/\" id=\"a_19\">Chandrakant<br \/>\n            Tukaram   Nikam   v.  Municipal   Corpn.   of<br \/>\n            Ahmedabad<\/a>  and  in <a href=\"\/doc\/1365916\/\" id=\"a_20\">Scooters  India  v.  Vijai<br \/>\n            E.V.Eldred<\/a>. &#8221;\n<\/p><\/blockquote>\n<p id=\"p_5\">  5.   In another decision on the concept of maintainability<br \/>\n       of writ petition vis&#8211;vis availability of alternative<br \/>\n       remedy, the Supreme Court in the matter of <a href=\"\/doc\/64057\/\" id=\"a_21\">Secy. U.P. High<br \/>\n       School &amp; Intermediate Education, Allahabad &amp; another v.<br \/>\n       H.K.Lal3<\/a>, observed as under:\n<\/p>\n<blockquote id=\"blockquote_3\"><p>            &#8220;4. From the records it is borne out that the<br \/>\n            question  asto whether the respondent  has  a<br \/>\n            legal  right  to  alter  his  date  of  birth<br \/>\n            recorded  in the certificate granted  by  the<br \/>\n            Board  was  pending consideration before  the<br \/>\n            appellate Court. The writ petition  filed  by<br \/>\n            the  respondent should, therefore,  not  have<br \/>\n            been entertained particularly in view of  the<br \/>\n            fact   that   the  appeal  thereagainst   was<br \/>\n            pending.  Writ  jurisdiction is discretionary<br \/>\n            jurisdiction  and  should not  ordinarily  be<br \/>\n            exercised if there is an alternative remedy.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_6\">  6.   A common thread running into the dicta laid down by the<br \/>\n       Supreme Court in the aforementioned cases is that, normally<br \/>\n  the High Court should not interfere if there is an adequate<br \/>\n       efficacious alternative remedy where hierarchy of appeals is<br \/>\n       provided by the statute, party must exhaust the statutory<br \/>\n       remedy before resorting to writ jurisdiction, except when a<br \/>\n       very strong case is made out for making a departure.\n<\/p>\n<p id=\"p_7\">  7.   Applying  the  well-settled dicta laid  down  by  the<br \/>\n       Supreme Court on the issue of availability of alternative<br \/>\n       remedy to the facts of the case, this petition is dismissed<br \/>\n       as not maintainable as no strong case has been made out for<br \/>\n       exercise of extraordinary discretionary jurisdiction in<br \/>\n       favour of the petitioners. However, liberty is reserved to<br \/>\n       the petitioners to take recourse to alternative statutory<br \/>\n       forum,  raising  all the grounds,  available  to  the<br \/>\n       petitioners, if so advised.
