On 9.4.1996 when<br \/>\npetitioner was on duty from Pavagadh to Baroda route, the Checking<br \/>\nOfficer has carried out checking of the bus. It was alleged against<br \/>\npetitioner that petitioner had issued 5 unpunched tickets being<br \/>\nNos.9910069 to 9910073 of Rs.7.50 ps. denomination and even same was<br \/>\nnot shown in the way bill. On 27.4.1996, charge sheet was issued to<br \/>\nthe petitioner and after completion of departmental proceedings,<br \/>\nultimately petitioner was held guilty and dismissed from service on<br \/>\n15.2.1996. Against dismissal order, departmental first appeal was<br \/>\npreferred by petitioner wherein the first appellate authority by an<br \/>\norder dated 25.5.1998 modified the punishment of dismissal and<br \/>\npetitioner was ordered to be reinstated in service with continuity of<br \/>\nservice and it was decided to treat the period of dismissal as leave<br \/>\nwithout pay and it was also held that the petitioner is not entitled<br \/>\nto get any financial benefit for the period of dismissal and he was<br \/>\nordered to be reinstated on original pay scale of conductor.<br \/>\nThereafter, industrial dispute was raised by petitioner challenging<br \/>\norder passed by first appellate authority which was adversely<br \/>\naffected right of petitioner which referred for adjudication to<br \/>\nIndustrial Tribunal, Baroda and registered as Reference (IT) No.117<br \/>\nof 1999. The reply was filed by respondent   Corporation and denied<br \/>\nthe averments made in statement of claim by petitioner. The<br \/>\nIndustrial Tribunal, Baroda has dismissed the said Reference on<br \/>\n25.10.2004. Therefore, he submitted that petitioner has not committed<br \/>\nany irregularity and it was absolutely false allegations were<br \/>\nlevelled against petitioner by Corporation. Therefore,  Industrial<br \/>\nTribunal, Baroda has committed gross error in not interfering with<br \/>\npunishment imposed by first appellate authority. Therefore, present<br \/>\npetition is filed.\n<\/p>\n<p id=\"p_3\">4.\tI<br \/>\nhave considered submissions made by learned advocate Mr.Majmudar and<br \/>\nalso perused the award passed by  Industrial Tribunal, Baroda. It is<br \/>\nnecessary to note that present petition has been preferred by<br \/>\npetitioner after a period of six years from date of award passed by<br \/>\nIndustrial Tribunal, Baroda. The Reference (IT) No.117 of 1998 was<br \/>\ndismissed on 25.10.2004 and therefore, SCA is preferred on 1.2.2010.<br \/>\nTherefore, there is six years&#8217; delay in filing present petition by<br \/>\npetitioner. The petitioner has not explained delay in filing present<br \/>\npetition. There is no averment made by petitioner in present petition<br \/>\nas to why delay has been occurred in filing present petition.<br \/>\nTherefore, in absence of explanation about more than 6 years&#8217; delay,<br \/>\nthis petition cannot be entertained by this Court only on that ground<br \/>\nin view of decision of this Court reported 2006 (2) GLH 472 and also<br \/>\nthe decision of Apex Court reported in 2006 SCC *L&amp;S) 791.\n<\/p>\n<p id=\"p_4\">5.\tApart<br \/>\nfrom that, allegations which are made against present petitioner<br \/>\nwhere on 9.4.1996 when petitioner was on route from Pavagadh to<br \/>\nBaroda, he has issued unpunched tickets of Rs.7.50 ps. denomination<br \/>\nto passenger after seeing checking staff and on the spot statement,<br \/>\npetitioner has admitted misconduct in presence of checking staff.<br \/>\nThereafter, charge sheet was served to petitioner and after<br \/>\ncompletion of departmental inquiry, the petitioner was dismissed from<br \/>\nservice. In departmental appeal, petitioner was given an opportunity<br \/>\nto improve the conduct and reinstated without back wages of interim<br \/>\nperiod and with punishment of minimum scale of conductor category.<br \/>\nBefore  Industrial Tribunal, Baroda, legality and validity of<br \/>\ndepartmental inquiry was not challenged by petitioner. The written<br \/>\nstatement was filed by Corporation vide Exh.9 raising contention that<br \/>\npetitioner has committed misconduct of dishonesty and<br \/>\nmis-appropriation which was found to be proved in departmental<br \/>\ninquiry and thereafter, giving reasonable opportunity of hearing, he<br \/>\nwas dismissed from service. Before  Industrial Tribunal, Baroda, vide<br \/>\nExh.12 pursis was given by petitioner that petitioner is not<br \/>\nchallenging legality and validity of departmental inquiry but,<br \/>\nchallenging legality and validity of finding. The Corporation has<br \/>\nproduced papers of departmental inquiry vide Exh.11 and  Industrial<br \/>\nTribunal, Baroda has considered spot statement given by petitioner<br \/>\nwhere admission was made by him that at the time of checking, after<br \/>\nseeing checking staff, hurriedly punch was made in ticket which<br \/>\ntickets were taken back by checking staff and after recovering<br \/>\nRs.101\/- from passenger, 5 adults and 3 children, Rs.40\/- has been<br \/>\ngiven back to the passenger. But tickets were not issued  upto<br \/>\nchecking point and these tickets were not shown as sold in way bill<br \/>\nand punch is also not properly made. Therefore, considering spot<br \/>\nstatement of petitioner,  Industrial Tribunal, Baroda has come to<br \/>\nconclusion that charge levelled against petitioner are found to be<br \/>\nproved in departmental inquiry and finding which was recorded by<br \/>\nInquiry Officer is also legal and valid and it is the case of<br \/>\ndishonesty and mis-appropriation committed by petitioner and admitted<br \/>\nby petitioner in spot statement. Therefore, no interference is<br \/>\nrequired because one opportunity has been given by first appellate<br \/>\nauthority giving reinstatement without back wages of interim period<br \/>\nand put in minimum time scale of conductor category. Therefore, no<br \/>\nfurther interference is required while exercising powers under<br \/>\n<a href=\"\/doc\/1968818\/\" id=\"a_1\">Section 11A<\/a> of the I.D.Act,1947.\n<\/p>\n<p id=\"p_5\">6.\tTherefore,<br \/>\naccording to my opinion, the  Industrial Tribunal, Baroda has rightly<br \/>\nnot interfered with punishment imposed by first appellate authority<br \/>\nand it is a clear case of dishonesty and mis-appropriation, which was<br \/>\nadmitted by petitioner before the checking staff while giving spot<br \/>\nstatement. Therefore, considering recent decision of Apex Court in<br \/>\ncase of Kamruddin reported in 2009 AIR SCW 4410 and 2004 AIR SCW<br \/>\n7850, contentions raised by learned advocate Mr.Majmudar cannot be<br \/>\naccepted and hence, rejected.  Therefore,  Industrial Tribunal,<br \/>\nBaroda has not committed any error which requires interference by<br \/>\nthis Court while exercising powers under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the<br \/>\nConstitution of India. Therefore, on both ground; unexplained delay<br \/>\nof six years in filing present petition and misconduct of dishonesty<br \/>\nand mis-appropriation, which is proved as per finding given by<br \/>\nIndustrial Tribunal, Baroda, present petition cannot be entertained<br \/>\nby this Court.
