ZAVED AZIZ, SECRETARY 74, MADARSA RAZOUTUL\n         ULUM, PAKAHI, EAST CHAMPARAN\n                                     -----------\n<\/pre>\n<p id=\"p_1\">3.   14.02.2011           Heard learned counsel for the petitioner, for the<\/p>\n<p>                  State and for the Bihar State Madarsa Board as also for<\/p>\n<p>                  respondent no. 9.\n<\/p>\n<p id=\"p_1\">                          The relief sought originally was for direction to<\/p>\n<p>                  remove respondent no. 9 from the post of Secretary of<\/p>\n<p>                  the 74, Madarsa Rozoutul Ulam, Pakahi stated to be<\/p>\n<p>                  holding the post illegally since 20 years without any<\/p>\n<p>                  reconstitution of the Managing Committee even though<\/p>\n<p>                  the   President     had   expired,   leading   to   alleged<\/p>\n<p>                  unauthorized activity by the Secretary.<\/p>\n<p id=\"p_2\">                          The counter affidavit filed by the Board states<\/p>\n<p>                  that general meeting of the local people of the area was<\/p>\n<p>                  held on 8.4.2007 and a fresh committee elected.        The<\/p>\n<p>                  Board has approved this fresh Managing Committee by<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               2<\/span><\/p>\n<p>           order dated 25.3.2009.\n<\/p>\n<p id=\"p_3\">                     Learned counsel for the petitioner however<\/p>\n<p>           submits     that   the   alleged   illegality   committed    by<\/p>\n<p>           respondent no. 9 and in respect of which audit of<\/p>\n<p>           accounts was requested done in accordance with law is<\/p>\n<p>           not being done.\n<\/p>\n<p id=\"p_4\">                     Now that a new elected Managing Committee is<\/p>\n<p>           in place, if the petitioner is aggrieved by the constitution<\/p>\n<p>           of the same, his remedy lies in challenging the<\/p>\n<p>           constitution first before the appellate authority. There<\/p>\n<p>           is no occasion for the Court to test the correctness of<\/p>\n<p>           the new Managing Committee in the present proceeding.<\/p>\n<p id=\"p_5\">                     Now that the new Managing Committee is in<\/p>\n<p>           place and the petitioner perceives any illegality by the<\/p>\n<p>           erstwhile   Secretary,    he   may    represent    before   the<\/p>\n<p>           Managing Committee which is expected to act in the<\/p>\n<p>           best interest of the Madarsa itself. In the event that the<\/p>\n<p>           Managing Committee does not pay heed to the grievance<\/p>\n<p>           of the petitioner, and he represents before the Board,<\/p>\n<p>           the Court expects the Board to act in the best financial<\/p>\n<p>           interest of the Madarsa.\n<\/p>\n<p id=\"p_6\">                     The writ application stands disposed.<\/p>\n<pre id=\"pre_1\">P.
