DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tRule.\n<\/p>\n<p id=\"p_1\">Learned APP, waives service of notice of Rule for respondent &#8211;<br \/>\nState.\n<\/p>\n<p id=\"p_2\">2.\tThis<br \/>\napplication is filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-187 of 2010 with Kuvadva Road Police Station, Rajkot, for the<br \/>\noffences punishable under <a href=\"\/doc\/1439698\/\" id=\"a_1\">Sections 66(1)<\/a>B, 65AE and 116B of<br \/>\nProhibition Act.\n<\/p>\n<p id=\"p_3\">3.\tLearned<br \/>\ncounsel appearing for the applicant submits that considering the<br \/>\nnature of offence, role attributed to the applicant and punishment<br \/>\nprescribed, this application for bail may kindly be considered.\n<\/p>\n<p id=\"p_4\">4.\tHeard<br \/>\nlearned APP for the respondent &#8211; State who opposed grant of<br \/>\nbail looking to the nature and gravity of offence.\n<\/p>\n<p id=\"p_5\">5.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the accused and punishment prescribed<br \/>\nfor the alleged offences, I am inclined to enlarge the applicant on<br \/>\nbail.\n<\/p>\n<p id=\"p_6\">6.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_7\">7.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith first information report registered at CR No.I-187 of 2010 with<br \/>\nKuvadva Road Police Station, Rajkot, on executing a bond of<br \/>\nRs.5,000\/- (Rupees Five Thousand only) with one surety of the like<br \/>\namount to the satisfaction of the trial Court and subject to the<br \/>\nconditions that he shall;\n<\/p>\n<p id=\"p_8\">(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p id=\"p_9\">(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_10\">(c)\tsurrender<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p id=\"p_11\">(d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p id=\"p_12\">(e)\tmark<br \/>\npresence at the concerned police station on the first Sunday of every<br \/>\nmonth between 10.00 a.m. and 3.00 p.m. till the trial commences;\n<\/p>\n<p id=\"p_13\">(f)\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_14\">8.\tThe<br \/>\nAuthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_15\">9.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_16\">10.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p id=\"p_17\">11.\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_18\">12.\tRule<br \/>\nis made absolute to the aforesaid extent.
